On September 15, 2011, Dave Parnell of the Raleigh Regional Office (RRO), Surface Water Protection
Section, and Jennifer Jones of the Stormwater Permitting Unit (SPU) conducted a site visit in order to
address the possibility of this facility (NCG200354) being granted Representative Outfall Status (ROS).
At that time, new Stormwater discharge outfalls (SDO) were designated. We agreed at that time, that
sampling during the next two sample periods would be conducted at all of the newly designated outfalls,
in order to determine the makeup of each sample. After the two sample periods, a determination would
be made by the RRO, of whether your facility could be granted ROS.
There are currently six stormwater discharge outfalls (SDO) being sampled. Five are
discharging to the stormwater system, which flows to the drainage ditch which passes under
much of your facility. The sixth SDO is the outfall that has been sampled historically and is the
referenced drainage ditch that flows into and out of your property.
During the site visit, it was noted that you have a clear understanding of the requirements of the
NCG200000 permit and are currently monitoring all of the outtalls as required. An evaluation of each
SDO was conducted and sampling techniques at each SDO were agreed upon. Alter reviewing sample
results and outfall locations, it is understandable that the similarities among the outfalls would allow for
ROS designation.
Your most recent sample results from May 9, 2012, were received by this office on June 4, 2012. SDO
41, 92, 93) and 94 were found to be within the required parameters set forth by the permit. SDO 45
continues to have parameters above the acceptable range for the parameters of Copper and Total
Suspended Solids. These elevated sample results are similar to the results that you have been reporting to
its in past years - that resulted in your facility being placed on "Fier 2 found in Section 2, Part 13 of your
stormwater permit.

Therefore; it is determined that the following outfall can be representative of other outfalls at this time:
The drainage areas of Outfall # 1, 2, 3 and 4 are contiguous. All of the outfalls have similar activities and
contain similar materials in their drainage areas. SDO # 1 is granted ROS for SDO # I, 2, 3 and 4.
Outfall #5 (the former SDO) is influenced by outside sources of contaminants and will no longer be
required to be sampled.
Analytical sampling is required at the frequency and for the parameters set forth in the permit for SDO 45
— formerly the only SDO designated.
In the event that topography and activities change at the facility, the above approval of the representative
outfall may be revisited/re-opened by the Division of Water Quality. Sampling is required if new outfalls

locations, DWQ may revisit the request for representative outfall status.
Please note that the representative outfall designation is only for analytical monitoring requirements of
the General Stormwater Permit. The qualitative monitoring requirements are still effective for all
stormwater outfalls.
In addition to this ROS certification, it is permitted that Rocky Mount Recyclers be taken off of Tier 2
Response Actions, of Section 2, Part B of your permit. You may begin sampling as required by the
permit when there is no Tiered Response Actions required.

Hope all is well with you. Attached you will see the second set of results that you requested we do on site for all five
outfalls. As you can see the# 1 thru# 4 are well below the benchmarks .Of course # 5 the original outfall is high. I hope
this meets the requirement for a second sample under the benchmarks. It cost us close to $1000.00 for all five sample
outfalls. We hope we don't have to do it again. I would suggest that we use the # 1 outfall (see site map) as the sample
outfall site going forward. I recommend this because it recovers the most flow from the yard, and be more
representative then the other locations. I look forward to hearing from you. Thanks for all your help during this process.

On October 14, 2011, the Division of Water Quality (DWQ), Raleigh Regional Office (RRO), received your
documented laboratory results from analysis at specified sample sites taken on October 6, 2011. The
accompanying map had the sample sites noted and labeled as Jennifer Jones and I had requested during our
technical support visit on September 15, 2011. During the visit, we had agreed that you should sample at five
points within your facility, in addition to your current Stormwater Discharge Outfall (SDO). All of the sample
sites are now considered to be SDO and must be sampled as directed by your permit. Q
After reviewing your sample results and comparing them with the baseline upstream and downstream values
you had provided from prior sampling, it is apparent that the high copper values you have been receiving, are
coming upstream from your facility. All five of the sample sites within your facility had values below the
copper benchmark and the SDO continued to exceed the benchmark.
Therefore, it is permissible for you to resume sampling as required by your permit, prior to placing yourself into
the tier system. As stated above, there will now be six SDO. The site map of your facility should reflect the
SDO, numbered 1-6. Please sample all SDO as required by your permit. After receiving another set of sample
results, and if they are consistent with the October 6, 2011 results, you may apply for representative outfall
status (ROS), which would allow you to sample at one site which would represent the production area of your
facility.

This letter is being written to comply with tier three requirements of the general storm water permit No.
NCG200000. The Certificate of Coverage number is NCG200354.
We have taken samples twice during the year 2010 and twice during the first two months of 2011, in
accordance with the permit. Each time my levels for my copper have exceeded the benchmark set by
our permit. The benchmark for copper is 0.007mg/L. The readings I am getting range from 0.009 to
0.021 mg/L.:All my other benchmarks are well in compliance.
The outfall that I am taking samples from is fed by a creek that flows into and through our property. I
recently spoke with Mr. Dave Parnell, and he recommended that I take a sample from the creek before
it gets to our property. I am currently awaiting the results from that sampling and the results from my
third consecutive grab sample for the month of March.
Our BMP's are extensive. We clean our floors and concrete pads at the entrance and throughout our
facility with a floor sweeper on a daily basis. We annually do a BMP inspection report for the city that is
conducted by a local engineering firm. The copper that is purchased by our our facility is kept inside,
under roof, to insure that there is no storm water run-off. I understand that there are some naturally
occurring levels of all metals in the ground. Taking a monthly sample can get expensive, but I do want to
make sure we are taking the right actions.

Inspection Summary:
This facility is actually compliant because they are on Tier 2 and are activly seeking resolution of their CU readings. Jan
Jones of SPU and I visit the site to offer assistance. We reviewed maps and walked the site. We suggested to Michael
Avent (252.903.1403) to sample as water enters 3 storm grates (stormwater only) and as water enters the stormwater
pond. A fourth sample would be at the SDO to compare with past samples. Michael Avant will contact Dave Parnell
when the results are in. Possiblility that RMR can be alleviated of the monthly sampling of CU.

Lucky for you, I still have some opinions left over from this week that I haven't used, yet! Here they are:
• Permittee requests relief from sampling on the basis of he can't meet the numbers? Of course
he can't meet the numbers if he does nothing. As Dave suggests, BMPs may ultimately be
appropriate.
• Further, his sample locations were not as Dave directed. Unless Dave or we can salvage some
meaning from them lie, unless we can interpret the two locations as upstream & discharge)
presumably half of those values are garbage in so far as meeting the objective of establishing
background Cu concentrations. Presumably the other half of the samples (discharge samples)
establish that he has exceeded the benchmark for copper.
• The Permittee has a valid line of exploration in the contention that copper is ubiquitous. But
again, his poor sampling has negated the attempt to support the argument, unless we can
interpret the sample locations as upstream and discharge locations. Also, we want to see the
whole data set, which was not included in this email string.
• Permittee has a valid consideration behind his request to cease extra monitoring in that it may
be that more testing, more data, will not really help us clarify what actions he needs to take.
We already know Cu is there; he needs to stop the discharge of copper from his site; that
requires BMPs. Or, he needs to construct an effective showing that he's not contributing Cu
from the site in excess of background concentrations.
• Copper is a cheap analysis. His burden is not great in the continued monthly sampling for one
sample for copper analysis. We should advise him that his testing has not established that the
background concentration of copper is in excess of the stormwater benchmark, yet.
• He cites 6 samples in the last 12 months, and an overall duration of 15 months sampling. How
many total samples? Seven?
• Looks like the hydraulics of this site may be problematic in that contributing flows appear to
come from off -site — both in the north -side ditch and storm sewer, and in the apparent sheet
flow from ag fields on the west and south (?) On -site confirmation needed as to the lay of the
land on the west and south.

Dear Permittee:
In response to your renewal application for continued coverage under general permit NCG200000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Due to resource constraints,
the Division has been unable to adequately consider appropriate modifications to the permit. Therefore, the permit
has been reissued without changes from the previous permit, so all conditions remain the same. The permit term for
the reissued permit is two years, expiring on September 30, 2008. The general permit may be modified and reissued
prior to its expiration. The permit is reissued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental
Protection Agency, dated December 6, 1983.

Your facility is currently covered for stormwater discharge under General Permit NCG200000. This permit expires on
October 31, 2005. The Division staff is currently in the process of renewing this permit. When a draft version is
available for notice and public comment, it will be posted on our website at http://h2o.enr.state.nc.us/su/. Once
the permit is reissued, your facility would be eligible for continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, enclosed you will find a
Permit Coverage Renewal Application Form. The application must be completed and returned by August 19, 2005 in
order to assure continued coverage under the general permit. Letters confirming our receipt of the completed
application will not be sent.
Failure to request renewal within the time period specified may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that "no exposure exclusion" is now available to all operators of industrial facilities in any of the
categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel
your facility can certify a condition of "no exposure", i.e. the facility industrial materials and operations are not
exposed to stormwater, you can apply for the no exposure exclusion. For additional information contact the Central
Office Stormwater Staff member listed below or check the Stormwater Permitting Unit Web Site at
http://h2o.enr.state.nc.us/su/.
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions can be found on the bottom of the form. You will be notified when
the rescission process has been completed.

the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .I and the Memorandum of
Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you.
you have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
