APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Cooke:
You have our approval, in accordance with the attached conditions and those listed
below, to place fill material in 0.099 acres of wetlands for the purpose of constructing a road
crossing at lot 10, Pelican Point s/d as described in your revised application dated March 29,
2001. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3289. This certification allows you to use Nationwide
Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Water shed regulations. This approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your
application except as modified below. If you change your project, you must notify us and you
may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and
(7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional
wetlands and streams to notify the state in order to assure compliance for future wetland
and/or water impact. These mechanisms shall be put in place within 30 days of the date of
this letter or the issuance of the 404 Permit (whichever is later).
2. Upon completion of the project, the applicant shall complete and return the enclosed
"Certification of Completion Form" to notify DWQ that all the work included in the 401
Certification has been completed. The responsible party shall complete the attached form
and return it to the 401/Wetlands Unit of the Division of Water Quality.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless
you ask for a hearing.

Per your 3/29/2001 email, I have revised the above referenced application. The proposed fill width, at
the soil and gravel base, has been reduced to a 26'-width. This minimizes fill to 4,290 ft2 or 0.099-acres.
I have also confirmed with Mr. Delaney Aycock (Brunswick County Chief Building Inspector) that there
are no state or local building code requirements for private, residential roads within the 100-year

Please find enclosed a joint Nationwide #14 and 401 Water Quality Certification request. Wetland fill
totaling 5,940 ftz or 0.14 acres is being requested for the purpose of a road crossing. The subject
property is a 3.3-acre lot situated between Seashore Road and the Atlantic Intracoastal Waterway in the
Holden Beach area of Brunswick County.
The upper reach of a freshwater riparian "drain" extends across the property. As you will see on the
wetland delineation and site plan enclosed, upland on the north of the tract is completely disconnected
from upland on the south of the tract. We are requesting the minimal amount of fill that will allow for a
private road and provide access to all upland areas. At the narrowest point of the wetland system, a 165'
long crossing will be needed. The crossing may be culverted with a 24" pipe, if determined necessary by
the engineer or contractor. With a 24" culvert, the soil base will not exceed 36' wide from toe of slope to
toe of slope.
Although no homesite is proposed by this applicant, a future homesite will likely be located on the
waterward portion of the lot. Sufficient upland is available for extension of the currently proposed
driveway and any future home. No additional wetland fill requests are expected with future development.
Included with this application package is a wetland survey and US ACOE required datasheets for a
jurisdictional concurrence by the Corps. If you have questions regarding this permit request, please do
