Dlroctor CO a r_Division of water Quality �Jfse1y +ol,23107 Decemberl, 2005 Subject: Notice of Violation Rollingview Marina on Falls Lake: NOV-2005-PC-0267 Stormwater Evaluation htspection NPDES Permit Number NCG190046 Durham County Dear Ms. Gooch: On December 8, 2005 Mr. Chnlstopher Wu of the Raleigh Regional.OfSce conducted a stormwater evaluation inspection of the Rollingview Marina on Falls Lake with Mr. Andy Gooch and yourself, owners of the facility. All help was appreciated as it eased the inspection process. The purpose of the evaluation. was to sec if Rollingview Marina was abiding by the guidelines provided under general permits NCG190046. A maintained stormwater program is essential for protectizlg the integrity of surface waters. Rollingview Marina has a maintenance facility on -site that has the potential to contaminate Falls Lake, a state drinking water supply. The Rollingview Marina has 3 outfalls all of which discharge directly to the lake. The stormwater primarily consists of parking lot runoff, but has the potential to receive water from the maintenance shop that lies uphill of the marina. When reviewing the paperwork for the facility, it was discovered that there was no available copy of the permit on -site. While the inspector left a general permit, the original copy details the number of outfalls and the specifics required of them. U the original is not found another copy should be obtained through the Division. During a later file review for the facility it was discovered that the Rollin. gview Marina stormwater permit expired in 2004. While permit fees were paid for 2005, the permit, itself•, was not renewed and this should be completed immediately. In addition, no analytical or qualitative monitoring was conducted as required by the permit. It is important to monitor the conditions of your stormwater to ensure that FaUs Lake is adequately protected from contamination. You should contact a contract .laboratory to conduct the analytical analyses according to the permit. Your current spray operator, Mr. Richard Johnson, is capable of conducting the sampling. Also, qualitative monitoring is required to be conducted twice per year (once in the spring and fall). All data are to be documented on Division forms (available on-line) and submitted to Central Files. Because the facility has abulk storage'containcr for gasoline the plan also included a Spill Prevention Counter Control (SPCC) plan. You are being issued a Notice of Violation for the following reasons: 1. Not renewing stortnwater permit NCO190046 as required, and 2. Not conducting any qualitative or quantitative monitoring. Please respond in writing as to why the permit was left un-renewed and how you plan to begin the montoring of the 3 outfalls. In addition, please provide documentation verifying that the bulk storage tank for gasoline is double -lined, therefore, meeting the requirements for secondary containment.
