Subject: Rescission of NPDES General Permit No. NCG 190041
Deaton Yacht Service, Inc.
Pamlico County
Dear Mr. Deaton:
Reference is made to your request for rescission of the subject NPDES General
Permit. Staff of the Washington Regional Office have confirmed that this Permit is no
longer required, because there is no point source discharge associated with the marina.
Therefore, in accordance with your request, NPDES General Permit No. NCG 190041 is
rescinded, effective immediately.
If in the future you wish to discharge to the State's surface waters, you must first
apply for and receive a new NPDES General Permit. Discharging without a valid NPDES
Permit will subject the discharger to a civil penalty of up to $10,000 per day.

In accordance with your application for discharge permit received on April 18, 1995, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.

This Certificate of Coverage shall become effective July 21, 1995.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

implementing that Article, shall be guilty of a misdemeanor punishable by a fine not to exceed
$10,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C. Section 1001

(b) Drnlaage. Where protection of ad-
joining property or waterways is by
means of a natural or, manmade drain-
age system, such aystems shall comply
with the following:

nate in vacant land or other area or in
an impounding basin having a capaofty
not smaller than that of the largest
tank served. This termination area and
the route of the drainage system shall
be so located that, if the flammable or
combustible liquids in the drainsgs

riously expose tanks or adjoining prop

(c) Diked areas. Where protection of
adjoining property or waterways is a
compliahed by retaining the liquid
around the tank by means of a dike,
the volume of the diked area stall

(ii) Depth and rover. Underground
tanks shall be set on firm foundations
and surrounded with at least 6 inches
of noncorrosive, inert materials such
as Olean sand, earth. or gravel well
tamped is Place. The tank shall be
placed in the bole with uwe since drop-
ping or rolling the tank Into the hole
can break a weld. Puncture or damage
the. rank, or scrape off tho protective
coating of coated tanks. Tanks shall be
covered with a minimum of 2 feet of
earth, or shall be covered with not less
than 1 foot of earth, on top of which
shall be placed a slab of reinforced con-

Wben underground tanks are, or are
likely to be, sublsct to traffic, they
shall be protested against damage from
vehicles passing over them by at least
2 feet of earth cover, or 'itinches of
well -tamped earth, plus 6 anchor of re-
inforced concrete or 8 inches of asphal-
tic concrete. When asphaltic or rein-
forced concrete paving is used as pt
of the protection. It shall extend at
least 1 foot horizontally beyond the
outline of the tank in all directions.
(iii) Corrosion protection. Corrosion
protection for the tank and its piping
shalt be provided by one or more of the
following methods:
(a) Use Of protective coatings or
wrappinsn:
(b) Catliodlc protection; or,
(c) Corrosion resistant materlals of
construction
(iv) Vents. (a) Location and arrange-
