On October 23, 2013, staff from the Wilmington Regional Office of the Division of Energy,
Mineral and Land Resources (DEMLR), conducted a site inspection for the tract/project known
as Coral Bay Marina located in Carteret County, North Carolina.
A review of the file by DEMLR staff revealed that the subject project is covered by NPDES
Stormwater General Permit — NCG 190034.
Thank you for your assistance and cooperation during this inspection. As noted in the attached
inspection report, your site needs to renew your permit using the attached form. Additionally,
submit monitoring reports to Raleigh Central Office.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under
the federal Clean Water Act and then delegated the program to the NC Department of
Environment and Natural Resources (NCDENR). As of August 1, 2013, the Division of Energy,
Mineral and Land Resources (DEMLR) manages the implementation of this program for
NCDENR. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program, industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There
are currently 19 active general stormwater permits in North Carolina. One condition that is
applicable to both the general permits and individual stormwater permits is the requirement to
develop and implement site -specific comprehensive stormwater pollution prevention plans
(SPPP). These plans are required to include a comprehensive evaluation of the site and
operations to reduce pollutant sources and prevent pollutant discharge.

under a NPDES General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help
bring your attention to certain permitting issues, process and condition requirements of your
permit. Please see the above mentioned web site in order to obtain a copy of the permit such that
you may fully comply with all the conditions therein. Failure to properly comply with
conditions of the permit, like those bulleted below, constitutes violations and are subject
civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain
permit coverage under a general NPDES stormwater permit or an individual NPDES
stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Energy, Mineral and Land Resources (DEMLR) by the filing of a Notice of
Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior
to any discharge of stormwater associated with the industrial activity, process
wastewater, and/or mine dewatering.
• Once the Notice of Intent is received, DEMLR will review and determine whether a
Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the
facility is covered by the General Permit. That is, the permittee is authorized to discharge
stormwater, process wastewater, and/or mine dewatering pursuant to the type of General
Permit until the permit expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or
approval.

There are currently 19 active general permits. Permit conditions vary accordingly;
however, most of the permits have following condition requirements (you must read your
entire permit to ensure full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the
facility along with the Stormwater Pollution Prevention Plan. Copies of the
analytical monitoring results shall also be maintained on -site. The Permittee
shall retain records of all monitoring information, including all calibration and
maintenance records and all original strip chart recordings for continuous
monitoring instrumentation, and copies of all reports required by this general
permit for a period of least 5 years for the date of the sample measurement, report
or application.
o Expiration — The permittee is not authorized to discharge after the expiration date
of the general permit. In order to receive automatic authorization to discharge
beyond the expiration date, the permittee shall submit forms and fees as are
required by the agency authorized to issue permits no later than 180-days prior to
expiration date. Any permittee that has not requested renewal at least 180 days
prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will
be subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general
permit is not transferable to any person expect after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of
the Certificate of Coverage to change the name and incorporate such other
requirements as may be necessary under the Clean Water Act. The Permit is
NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to
notify the Division in writing in the event the permitted facility is sold or closed.
The Division of Energy, Mineral and Land Resources views changes of name or
ownership as a modification that requires the Director's approval and reissuance
of the permit. Name and ownership changes required you to complete a
Name/ownership Change Form from the Division and mail it back to the along
with all appropriate information to the Division of Energy, Mineral and Land
Resources.
o Proper Operation and Maintenance is a requirement of the permit.

What activities are covered by this general permit?
NCG190000 allows stormwater discharges associated with activities classified as establishments primarily
engaged in: Operating Marinas [standard industrial classification (SIC) 4493] that provide vehicle
maintenance activities, and Ship and Boat Building and Repairing [SIC 3731; and like activities deemed by
the Division of Water Quality (DWQ) to be similar in the process and/or the exposure of raw materials, products, by
-products, or waste materials.
• Thisgeneral permit does not authorize discharges at the facility containing waste streams including, but not
limited to, bilge and ballast water, cooling water, sanitary wastes, power and hand washing, blasting, sanding,
and fish cleaning stations. A separate wastewater permit may be required for these and other similar wastewater
discharges.
What are the key permit requirements?
• Implement a Stormwater Pollution Prevention Plan (SPPP) (refer to Part II, Section A).
• Provide secondary containment for all bulk storage of liquid materials (refer to Part II, Section A, 2.(b)).
• Perform, document, and report analytical and qualitative monitoring during a representative storm event (refer
to Part II, Section B & C).
What has changed since the last renewal?
• Twice per year analytical monitoring of pH, Oil & Grease, Total Suspended Solids (TSS), Copper, Aluminum,
Lead, and Zinc.
• Refinements and clarifications to the SPPP requirements (refer to Part II, Section A).
• Tiered response requirements for benchmark exceedences based on analytical results beginning with the
monitoring in Year 3 — Period 1 (Sample 5), and a requirement that facilities notify the DWQ Regional Office in
the event of four benchmark exceedances. Benchmarks are not limits.
• Twice per year qualitative monitoring during a representative storm event.
• Requirement to use forms provided by DWQ to record qualitative monitoring results.
• Requirement to submit an annual monitoring summary to the DWQ Regional Office nearest your facility.
• Develop a Solvent Management Plan (refer to Part II, Section A).
What are BMPs and why are they important?
A facility's Stormwater Pollution Prevention Plan should include Best Management Practices (BMPs) to control the
discharge of pollutants from all stormwater outfalls. BMPs include a variety of measures that help minimize the
potential for pollutants to enter stormwater that drains from a facility. There are different types of BMPs:
Non-structural (practices or activities) BMPs include:
• Eliminating exposure of materials and equipment whenever possible by moving them to indoor locations.
• Practicing good housekeeping on -site. Handle and store materials at the facility in an orderly fashion.
• Exchanging hazardous materials for non -hazardous ones wherever possible.
• Establishing routine leak and maintenance checks to minimize any chance of spills occurring. Clean up all spills
immediately.
• Establishing bulk storage tank protocols that minimize the risk of spills during loading and unloading.
• Maintaining wash pads and keeping them clear of paint chips, debris, and particles.
Structural (equipment or devices) BMPs include.
• Containment dikes around the loading areas of bulk liquid storage containers.
• Roofs and secondary containment around materials so that they are not exposed to stormwater.
• Collection systems around boat wash areas to direct wash water to a holding tank or sanitary sewer.
• Converting from a liquid operation to a dry operation for hull maintenance and cleaning.
• Collection of debris from paint chips in boat maintenance areas to minimize contamination of stormwater.
• Hull maintenance practices that are performed on dry land as far away from the water as possible.

What if I sell my business, or
the name changes?
This is a minor modification that
requires approval of DWQ's
director before a permittee is
absolved of responsibility for the
permit. To request this change,
complete and submit a Name/
Ownership Change Form SWU-
239 (see link below).
Do I have to monitor all the
outfalls?
Yes. However, you may request
Representative Outfall Status
(ROS). If approved, this status
allows analytical monitoring at
fewer outfalls. To make this
request, submit a ROS Request
Form (see link below).
Does a certified lab need to
analyze my samples?
State certification requirements
apply only to wastewater
discharges. However, data
gathering and monitoring under all
NPDES permits must be conducted
in accordance with test procedures
approved under federal regulations
as written in 40 CFR §136. All labs
certified by North Carolina perform
analysis in accordance with those
procedures. Using a certified lab is
one way to ensure compliance with
your permit. A list of certified labs
is available at the DWQ Web site
(see link below). Alternatively, you
may obtain training for your on -
site staff to *measure pH using
approved methods that adhere to
federal guidelines.
*Note that pH is a field parameter
and must be measured within 15
minutes of the time that a sample
is collected.
Can my boat wash water be
discharged to or with my
stormwater?
No. Boat wash water, whether from
hand washing or power washing, is
considered wastewater. This
stormwater permit does not
authorize wastewater discharges.

Wastewater is not allowed to mix,
or be "diluted", with stormwater
for discharge at a stormwater
outlet unless permitted by a
separate wastewater permit. Once
stormwater commingles with
wastewater, it is all considered
wastewater and must be handled
as such.
A separate wastewater permit
is required in order to
discharge wastewater. Some
possible alternatives (which may
require an additional separate
permit) for minimizing wastewater
discharge to surface waters
include: discharge to a municipal
wastewater treatment plant, water
recycling, conversion of activities
to dry processes which allow for
easy clean-up and maintenance
and proper disposal of waste
generated from industrial
activities.
The NCG190000 permit is
applicable to a marina that offers
vehicle maintenance service,
which includes boat cleaning. It is
not applicable for an individual
washing their own boat at a
marina. However, it is highly
encouraged that facilities educate
and monitor the use of appropriate
BMPs by boat owners when
washing their boats to minimize
potential impacts to surface water.

Annual Permit Fee
This annual fee is required by the North Carolina Administrative Code. It covers the administrative costs associated
with your permit. It is required of any person holding a permit for any time during the annual fee period, regardless of
the facility's operating status. Failure to pay the fee by the due date will subject the permit to revocation. Operating
without a valid permit is a violation and is subject to a $10,000 per day fine. If the permit is revoked and you later
decide a permit is needed, you must reapply, with the understanding the permit request may be denied due to changes
in environmental, regulatory, or modeling conditions.

confused as to how and when it expired. I have records showing that I was billed by NCDENR

In regards to your NOV letter dated December 2, 2004, this letter is to let you know that Coral
Bay Marina has addressed the issues specified in the NOV letter.
Specific Issues
I. SWPPP: Plan has been updated with BMPs to specifically control discharges of boat
wash waters in all forms. Another BMP has been included to improve the handling of
used oil. Refer to the enclosed Table 4 BMP Status (Year 1) for target dates. The entire
updated SWPPP is available for review at the Permittee's office.
2. Boat Maintenance: Boat maintenance will be performed indoors or under cover where
practical. Exposed maintenance during storm events will be avoided to extent practical.
Pavement oil stains will be cleaned off to the extent practical. Tarps or other devices will
be used to capture fugitive residuals during boat sanding and painting.
Pressure Wash Water: Permittee and consultant are gathering information on various
systems and studying feasibility of options. In the meantime, Permittee will perform boat
washing over unpaved areas so that wash waters will infiltrate into ground and not
discharge through an outfall or over the bulkheads. The infiltration option is allowed
under General Permit NCG080000.
The Permittee has set a target date of February 28, 2006 for implementing a practical
solution regarding the discharge of power wash flows by connecting to the municipal
sanitary sewer system or installing an on -site closed -loop re -circulating/ filtering system
or another option.

4. Storage of Waste Materials: The used oil containment structure has been repaired,
sealed, and fitted with a shed roof as of December 16, 2004.
5. Spill Response: Permittee will acquire and pre -position a spill kit at the fuel dock, and
will acquire and store on -site a floatable oil -containment boom. Target date is 11/15/05.
6. Outfall Monitoring: Stormwater samples were collected on December 23, 2004. The
Discharge Monitoring Report has been submitted to NCDENR-DWQ and the
Wilmington RO. The outfalls were also visually observed (qualitative monitoring) on
December 23. These reports were submitted along with the DMR. Either marina staff
will be trained to conduct required future monitoring as required by the Permit, or a
consultant will be hired to perform this task.
Coral Bay Marina is actively striving to comply with the stormwater permit regulations.
Appropriate BMPs will be implemented as soon as practical. 1n the meantime, if you have any

Schedule of Compliance
1. SWPPP: Plan will be revised and updated by this consultant no later t}ian January 31,
2005. The updated Plan will provide a BMP Implementation target date for the following
items 2 — 6. We conducted a semi-annual site inspection in accordance with the Permit;
our report will be included with the updated SWPPP.
2. Boat Maintenance: Permittee will implement appropriate BMPs to control oil drips,
describe clean-up procedures, and provide employee training. Boat maintenance will be
performed indoors or under cover where practical. Exposed maintenance during storm
events will be avoided to extent practical.

The North Carolina Division of Water Quality conducted a recent inspection of Coral Bay Marina on
November 18, 2004. This inspection was conducted to determine if the facility is operating in compliance with
the conditions and requirements specified in NPDES General Permit Number NCG190000.
Please find attached a copy of the Industrial Stormwater Inspection Report, which indicates the findings
of the inspection and a summary of compliance issues. The facility was found to be noncompliant with the
requirement in the permit to perform analytical and qualitative monitoring at the identified stormwater outfalls.
There are several other issues identified in the inspection report that require attention. Within ten days of
receipt of this notice, please submit a letter that addresses the issues and offers a schedule for accomplishing
needed activities. Monitoring must be initiated as soon as possible.

The SWPPP identifies the stormwater outfalls, onsite activities, and contact information.
Procedures need to be included in the plan for sufficient controls associated with washing of
boats, pressure washing of boats, sanding and painting of boats, and handling of waste oil.

indicate that parts washing or staging is being done on the pavement. An open container of oily
material was observed adjacent to the building exposed to rainfall. It is understood that sanding
and painting is not done routinely but it is done occasionally on the site. It is understood that
some boat maintenance and repair is done on the lot adjacent to the garage with no cover or
control measures.
VEHICLE/EQUIPMENT WASH AREA:
It is understood that boats are rinsed when removed from the water for dry storage. This is
acceptable. Additional washing should involve the use of BMPs to reduce the potential impacts
from wash water. It is understood that some pressure washing is done in the vicinity of the dry
stack storage area and near the shop area. Pressure washing removes both marine growth and
paint solids and also results in constituents of toxic antifouling paint being dissolved and
suspended in the wash water. This is much more difficult to control and typically requires the
use of a recycle wastewater treatment system.
TEMPORARY STORAGE OF WASTE MATERIALS:
Waste oil is enclosed in a secondary containment stricture that is constructed of cinder blocks.
There are gaps in the block joints and there is an outlet pipe with no valve for closure. Oily
residue was evident on the ground near the pipe outlet. A bucket of oil filters was placed on the
top of the block wall. Rainfall could displace the oil and result in a discharge. I
OUTDOOR STORAGE OF MATERIALS:
This does not appear to be an issue of concern.
SPILL RESPONSE AND CLEANUP PROGRAM:
The marina is probably aware of the need to respond quickly and effectively to a spill of
petroleum products.

ERROSION CONTROL ON SITE:
The site appears to be quite stable.
ILLICIT DISCHARGE ELIMINATION:
Sanitary wastewater is sent to the Town of Morehead City so there is little opportunity of
discharging it to the stormwater outfalls. More control is needed for wash water.
WASTEWATER TREATMENT FACILITIES:
There are no treatment facilities.
STREAM IMPACTSIRESULTS OF SAMPLING:
There are no indications of stream impacts. Sampling has not been done.
SUMMARY:
Analytical and qualitative sampling must be initiated as soon as possible. Repairs need to be
made to the containment structure for the waste oil tank and a valve must be installed on the
outlet pipe. BMPs need to be implemented to control impacts from boat maintenance and
washing activities. An effective treatment or recycle system is needed to control wash water
from pressure washing boats with toxic antifouling paint on the bottom.

between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on the Stormwater program which outlines program components and
addresses frequently asked questions

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
