This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) Please review the new permit to familiarize yourself with all changes in the reissued permit. Significant changes to the General Permit are outlined in the attached Technical Bulletin. Your coverage under the General Permit is transferable only through the specific action of DEMLR. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. In summary, • Sheri to treat this email and my report as a random renewal for the expired NCG180110; renewed COC to go to Mr. Herman; • Fran to bill NCG180110 for $540 this week, $440 past due for the period 2004 — 2009, plus $100 for the coming year 2013 — 2014. We are amenable to re -instating permit coverage upon agreement to pay past amounts due. We have been able to back -track a little bit, but not completely. So, it's not fully clear what happened, but it is at least possible that we somehow failed to follow the internal permitting procedures necessary to trigger billing invoices. Here's what we think we know. 1. `You had permit coverage through 2003, and your annual fees were paid up through 2003. So, all is OK up through 2003. 2. Per your paper correspondence attached in your first email, you had renewed permit coverage beginning in 2004 and valid through 2009, but you did not receive or pay any bills in that period, 2004-2009. 1 propose that you pay us the combined annual fees for that period when you had permit coverage. Fees during that period were $80/yr for 2004 — 2006 (3 years), and $100/yr for 2007 — 2009 (2 years). That totals $440. A year -by -year tabulation looks like this: 1) $0 due for 9/1/03 — 8/31/04, $80 annual fee paid in 2003. 2) September 2004, renewal coverage issued by DWQ letter. 3) 80 due for 9/1/04— 8/31/05. No billing, no payment, but coverage provided. 4) 80 due for 9/05 — 8/06. No billing, no payment, but coverage provided. 5) 80 due for 9/06 — 8/07. No billing, no payment, but coverage provided. 6) 100 due for 9/07 —8/08. No billing, no payment, but coverage provided. 7) Siop due for 9/08 — 8/09. No billing, no payment, but coverage provided. End of coverage period. 8) DWQ letter requesting permit renewal response apparently sent in February 2009. (See attached copy of letter.) But, COC not re -issued in August 2009. No permit coverage from September 2009 forward. 3. Although it appears that we sent a renewal notice in February 2009, we did not renew your coverage with the other NCG18's in August 2009. Whether because you did not responded to that renewal notice or whether because of some glitch at our end, you do not now have permit coverage for the current period. I don't think we want to bill you for the portion of the present period when you didn't actually have permit coverage, unless you have some internal reason to pay for that period. I propose no billing for the years 2009, 2010, 2011, 2012. We are now approaching the one remaining year of the permit coverage, 2013-2014. We will renew all our NCG18's next year in August 2014. 4. One interpretation of the present period could be that you have been discharging without a permit from 2009 to the present; however, we're not interested in pursuing that aspect, since it is not fully clear whether you failed to respond to our prompt to renew the permit, or whether some glitch at our end contributed to this joint oversight. 5. Co -incidentally, our accounting folks report that our billing for this annual period will be going out this week. We will re -instate permit coverage under COC NCG180110 upon our verbal agreement on today's phone call. I propose that our accounting folks bill you this week for $540, representing the $440 past due for permit coverage, plus the $100 for the coming final year of the current General Permit. However, COC was re -issued in September, 2004, per attached pdf; SPU electronic record of Notification letter in February 2009, as no fees owed, but; No re -issuance letter in August 2009 (may not have returned February 2009 mailing?) I think we could conclude that he had COC coverage through 2009, based on re -issuance of COC in 2004; but he is in arrears since 2003, our last record of payment. So, one possible perspective would be: • that he owes us for coverage 2004 — 2009 - - it appears he had coverage, but did not pay us. (We may not have billed him, either.) • But, he has had no permit coverage since 2009 — 2013, and has been discharging without a permit. • He inquired as to whether he could pay past due amounts to re -instate coverage. No comment from me in response. • However, instead, I suggest we forgive all past amounts, and require new NOI under NCG18, with new resulting COC #. This seems to require the least amount of effort from us, which is very important given current workload and staff. I owe him a response. Does this approach make sense? I don't see anything in our paper files that tells me why he has fallen off our radar here in Stormwater Permitting. But, as I read BIMS: permit expired since 2003, last billing paid in 2003. However In our Stormwater Permitting electronic files, it looks like we re -issued his Certificate of Coverage in 2004, which meant he had coverage up through 2009. But, he apparently did not respond to our request to renew in 2009. Can we discuss, so that I can get back to him with instructions?
