facility is not in operation at this time. I did observe many areas of concern (stormwater systems discharge to a stream that
runs directly through the facility) that will hopefully be addressed when the new Owner produces a SWPPP.

Hi, Laura! I'm going to knock this one out before the weekend ;). Ken is also out until after Thanksgiving
You are absolutely right. The best approach is for the new company to submit a new NOI for NCG21. Hopefully we have
already gotten a rescission request from the old NCG18 permittee (but if not, that would be ideal -- we need a request
from the permittee whenever possible). It would be more complicated to try and transfer NCG18 (and really just extra
paper work to no avail).
The strictest interpretation is that they have NCG21 coverage upon start-up and when they discharge (i.e., in place at the
first rain event that prompts a discharge during industrial activities, which may or may not be day 1 of operation...
depending on their luck). If they apply ahead of time and are compliant with NCG21 upon start-up, and we are still
processing that request when it opens, then obviously we are not likely pursue compliance and enforcement for
discharging without a permit until the COC were issued.
Does that make sense?

Ken and Bethany,
A couple of questions for you concerning this site and our upcoming meeting on Dec 3 or 4`h. Stanley Furniture
(previous occupant) had a NC180000 general permit that expired 8/31/2014. The new company wants to come into the
building with a lumber business which will probably fall under a NCG210000 general permit. I would think that the most
straight forward approach here would be for the new company to submit an NOI for the NCG210000 general permit and
to do this before they start operation. Is this a correct approach? I wouldn't think that the existing NCG180000 CDC
(expired) would be transferrable as a NCG210000? Also, what are the requirements for operating without a
COC? Again, I would think that as long as they are complying with the NCG210000 upon start-up that an issued CDC
would not be required before commencement of operations?

Susan Wilson and Jeff Menzel, Surface Water Section - Asheville Regional Office, met Mr. Dicky Webster at Stanley
Furniture Co. on November 21, 2011 to conduct a stormwater inspection at the site in Graham County. Stanley Furniture
manufactures, finishes, and packages furniture to ship worldwide.
The site is fairly flat (orignally built by another industry several decades ago) - likely wetlands/streams that were previously
present have been previously filled/re-routed (and serve as stormwater conveyances).
Stormwater records were well kept. Monitoring was being performed as required. Stormwater discharge outfall (SDO) 01
runs across the front (east side) of the property and receives runoff from activities at the front of the plant and flows north.
SDO 02 captures Stormwater from the left side of the plant (south) and back of the plant (west) and flows through
captured drop inlets to a stormwater detention basin and ultimately to Long Creek. Stanley Furniture should continue to
perform qualitative monitoring and inspection on these outfalls.
SDO 03 only results from a continual minor discharge from the recirculating pumps associated with fire storage water.
There is no stormwater associated with this outfall (that is associated with the industrial process). This small discharge
flows out the back (east) side of the property and never reaches Long creek (Long Creek is at least 200 ft from the
origination of this outfall near the water storage tanks). Stanley Furniture may discontinue stormwater monitoring of this
discharge if they wish.
No adverse water quality impacted was noted from the outfalls (SDO 02 has some flow; SDO 01 had no flow).
Approximately 1/4-1/2 inch of rain had fallen the night prior to the inspection.

On January 5, 2015, the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG 180053. In accordance with your request,
Certificate of Coverage Number NCG 180053 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stormwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

Laura, I made the inspection of the former Stanley Furniture Company facility in Robbinsville, NC on March 5, 2015. The
facility is not in operation at this time. I did observe many areas of concern (stormwater systems discharge to a stream
that runs directly through the facility) that will hopefully be addressed when the new Owner produces a SWPPP.
