Dear Mr. Miller:
Reference is made to your recent request for rescission of the subject NPDES General Permit. In your
letter received 12/6/2005, you stated that stopped operation at your facility in April of 2005. 11t accordance
with your request, NPDES General Permit NCG 180032 is rescinded, effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to
$25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit
coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still
requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish
to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

This letter is provided in follow up to our telephone
conversation of this date. Use of propylene glycol, in the
manner described, for deicing the balloon storage unit in Spruce
Pine, North Carolina is not believed to constitute construction
of wastwater treatment works. Therefore, the deicing would not
require a permit from the Division of water Quality.
Since you have checked with the Ground:;alter Section and the
Hazardous waste Section, I am unaware of any other requirements
governing the proposed deicing operation. Please contact me at
telephone number 704-251-6208 if additional information is
required.

This is to provide further response to your letter of March 13,
1996. As you are well aware, this Agency has been involved with
the Henerdon Furniture Industries and Lexington Furniture Industries
industrial site for many years. We have diligently worked to carry
out our regulatory responsibilities and have responded to inquiries
about this facility on several occasions. During this time we have
worked with facility representatives to address the plants'
wastewater discharges of process and domestic wastewaters, boiler
blowdown and cooling waters. Through those efforts and the
cooperation of the companies, these wastewaters are now being
discharged to the Town of Spruce Pine's wastewater treatment
facility. Based on the best information available to us, we have
determined that with the exception of stormwater runoff from the site
there are no direct discharges of wastewater from this industrial
complex to State surface waters around the plant site.
Based on the tone of your recent letter, you are obviously
frustrated with this facility and with this Agency. I am sorry that
you feel this way and sincerely hope that you can understand that as
the State's Water Quality Agency, we have done everything possible to
respond to your concerns. Because of recent events at the plant
site, you have contacted this Agency. We have taken action on each
of your inquires. Please understand that we take any complaint, from
you or any other person, very seriously, and take appropriate action
in each case. Staff of the Asheville Regional office's Water Quality
Section, have responded to each complaint we have received from you.

1. June 12, 1995 - Following your telephone call,
Mr. Mike Parker of the DEM Water Quality
Section, contacted Mr. Donald Shuford, Henredon
Furniture, by telephone and asked if he knew
what resulted in a discharge to the stream on
June 10, 1995. Mr. Shuford indicated that he
was unaware of any discharge but would
investigate. He was unable to find a cause for
the stream condition which you observed.
2. August 12, 1995-The Division received your
August 14, 1995, letter on August 17, 1995. On
August 18, 1995, the Division received a letter
from Mr. Greg King of Lexington Furniture
Industries (see attached letter) advising of the
spill of glue and subsequent discharge to the
stream. On August 24, 1995, Mr. Mike Parker met
with Mr. Greg King at Lexington Furniture
Industries and discussed the matter with him.
Further investigation included a visual
'inspection of the ponds and stream near your
house. Nothing unusual was observed at that
time.
3. December 31, 1995-The Division received your
letter on January 5, 1996, describing the
discharge of a purplish black substance. Mr.
Greg King of Lexington Furniture Industries and
Mr. Donald Shuford of Henredon Furniture were
contacted by telephone. Neither were not aware
that any discharge had occurred but would
investigate. Both companies were unable to
explain the discharge.
4. March 12, 1996-The Division received your letter
on March 14, 1996, advising of the discolored
water being discharged on March 12, 1996. Mr.
Joe Harrill of Henredon Furniture Industries and
Mr. Bob Wood of Lexington Furniture Industries
were contacted by telephone on March 15, 1996,
and asked about the incident. Both men
indicated that they were not aware of any
discharge but would investigate. Mr. Harrill

called back that afternoon and indicated that
Henredon had a fire in a woodwaste silo and the
discharge occurred when water was placed on
this material to extinguish the fire. Refer to
the attached March 18, 1996, letter from
Mr. Harrill.
Mr. Biddix, we have done everything possible to minimize any
impacts to the stream behind your house. Based on our experience,
the companies respond to our contacts and take appropriate actions.
They seem genuinely forthright and appear to be very responsive to
our requests. Both companies have taken actions that show them to be
trying to minimize any type of water quality impacts to state surface
waters. We sympathize with your concerns, but for large industrial
complexes such as these, there will always be the potential for
unintentional and unavoidable events that can result in releases to
surface waters. When these occur, we will diligently apply
regulatory authority. We hope you will continue to let us know about
any situations that could involve this Agency.
We will continue to work with both companies to correct any
regulatory problems identified. I would encourage you to call me or
Mr. Mike Parker when you observe discharges that may affect Water
Quality. In sending a copy of this letter to the companies, I am
encouraging both organizations to designate a person with whom you
can talk to about your concerns and could contact to report any
events that you observe.
If you have questions or would like to discuss this matter
further, please call me or Mr. Parker at 704-251-6208. I hope to
contact you in the near future to schedule a time when we could meet
at your home and discuss your concerns.

Dear Mr. Parker:
This is to notify you of the incident that occurred at Lexington
Furniture Industries Plant 17 in Spruce Pine on Saturday, August 12
1995. At 11:45am, our forklift driver overturned a tank containing
a glue and water mixture. Approximately twenty to thirty gallons
of this residue was spilled. The spill was contained with
absorbent material, but approximately five gallons did escape into
the storm drain. The glue in the mixture is a polyvinyl acetate
emulsion adhesive containing no hazardous ingredients. The
percentage of glue in the mixture is no greater than twenty
percent.

Per your request I am sending you this letter explaining the incident which
occurred on March 12, 1996 at our Spruce Pine location. We had a fire on top of
our silo beside the boiler roorn. Our response team put out the fire with water,
which created an overflow of water and wood dust. We use wood dust as a fuel
for the boilers. This dust traveled through the screening ponds and into the
creek. That is where the off -colors came from. There were no hazardous
substances involved. We will work on our drainage system and the pond to help
prevent an overflow into the storm water.
Also, per your request, if this happens again and we are aware of a
release into the storm water, we will notify you in order to head off unwarranted
complaints. Thank you for your assistance.

Furniture looked into the matter and found that there had been a fire in a woodwaste silo.
Henredon Furniture personnel extinguished the fire using water which evidently resulted in
a discharge of discolored water and sawdust.
I telephoned you today to provide you with information regarding the situation you
saw on March 12, but received no answer. As far as I can determine, we have never
failed to investigate or respond to information provided by you in relation to stream
problems. Both companies are looking into ways to minimize impacts to the stream near
your home. I will be back in touch with you to provide a fuller response and the
information you requested.
I must now say that your criticizing the staff of this Division serves no useful
purpose.

Another illegal discharge from the Henredon Facility in Spruce Pine
occurred on Mar 12. This was noted and reported at 6100 pm.
I have been reporting incidents such as this on a fairly regular basis
to DEM for over fifteen .years and yet it continues unabated. Perhaps I
am mistaken because I was under the impression that DEM was the regulatory
and enforcement agency for situations such as this. m not correct,
please inform me of the name and address of the a is.
During those fifteen years, I have amassed a large box full of correspon-
dence, reports, photos etc. documenting my attempts to get the responsible
agency to justify their existence. All to no avail. My vocabulary is
inadequate to express my rage, disgust and frustration at watching this
toxic wasteland flow through my back yard, eroding soil, devaluing
property and severely diminishing quality of life while an agency tasked
with the responsibility of preventing situations like this sit idly by
sucking up on the tax budget like bloated ticks.
I am considering assembling packets of the material collected over the years
and sending one to each state and federal senator, representative, governor,
and the main office of the EPA. I will name the individual that I have
reported the majority of these incidents to and that name is Mr. Mike Parker.
I also request to be fully informed as to what if anything was done
regarding the incidents that occurred at this facility on 10 June, 1995
and on 12 Aug. 1995• 1 believe I am entitled to this information based
upon the provisions of the Freedom of Information Act.

Subject: Your letter of March 13, 1996
Dear Mr. Biddix:
As a result of receiving your letter, staff of the Water Quality Section contacted
Henredon Furniture Industries and Lexington Furniture Industries and inquired as to what
you may have seen in the stream adjacent to your house. Mr. Joe Harrill of Henredon
Furniture looked into the matter and found that there had been a fire in a woodwaste silo.
Henredon Furniture personnel extinguished the fire using water which evidently resulted in
a discharge of discolored water and sawdust.
I telephoned you today to provide you with information regarding the situation you
saw on March 12, but received no answer. As far as I can determine, we have never
failed to investigate or respond to information provided by you in relation to stream
problems. Both companies are looking into ways to minimize impacts to the stream near
your home. I will be back in touch with you to provide a fuller response and the
information you requested.
I must now say that your criticizing the staff of this Division serves no useful
purpose.

Dear Mr. Parker:
This is to notify you of the incident that occurred at Lexington
Furniture Industries Plant 17 in Spruce Pine on Saturday, August 12
1995. At 11:45am, our forklift driver overturned a tank containing
a glue and water mixture. Approximately twenty to thirty gallons
of this residue was spilled. The spill was contained with
absorbent material, but approximately five gallons did escape into
the storm drain. The glue in the mixture is a polyvinyl acetate
emulsion adhesive containing no hazardous ingredients. The
percentage of glue in the mixture is no greater than twenty
percent.

Dear Mr. Parkers
I wish to report yet another illegal discharge from the Henredon
Furniture facility in Spruce Pine. This incident occurred Aug. 12.
I was finally contacted by the plant manager, Dale Smith, and was
told what is now becoming a sickeningly familiar story. "An employee,
while transporting a container of glue waste, accidentally poured -it
down the storm drain."
Another incident occurred approximately three or four weeks ago but
I did not report it because Mr. Smith informed me about it before.I
discovered it.
I also wish to restate that the drainage basin for the run-off. from
their new construction is woefully inadequate. I also question their
compliance with sedimentation and erosion regulations since torrents
of muddy water rush out of the facility and into the streams every
time it rains.

On Sam day-,=1-0-June, a large quantity of some type of chemical
substance-was-released—f.rom the wastewater discharge point of the
facility -in Spruce_P ne-. first noticed it at approximately 5100 PM.
The sub`§•tance did n�appear-lto contain oil. The sample I took in a
as_a pint jar"wdark_purplish color that produced foam when agitated.
I'm just guessing but my guess would be that it was some type of solvent.
I don't know how long this situation existed before I spotted it but
the water was still very discolored at 8soo PM. The next morning, the
water was reasonably clear.
I'm not suggesting that management conspired to poison and pollute
our waterways. I believe some employee either made a major mistake or
took advantage of a shortcut. In any case, management is still respon-
sible for that employee.
Please take appropriate corrective action.

forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG180000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on the Stormwater program which outlines program components and
addresses frequently asked questions
* A corrected Certificate of Coverage if you indicated a name change on the Renewal Application
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
