On May 15, 2014, the Division of Energy, Mineral and Land Resources received your request to rescind your
coverage under Certificate of Coverage Number NCGNE0658. In accordance with your request, Certificate
of Coverage Number NCGNE0658 is rescinded effective immediately.
Discharges of stormwater associated with the industrial activities at this facility are currently authorized
under Certificate of Coverage (COC) No. NCG 170413. We also received your request to renew
NCG170413 on June 10, 2014 through our program's on-line questionnaire. You will receive instructions
for renewing and downloading your renewal COC on-line via e-mail in the next couple of months (General
Permit NCG170000 expires July 31, 2014). Please see our public notice announcement for more information
about that General Permit here: littp:Hportal.ncdenr.ore/web/Ir/stomiwater/event-calendar.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

Per your request to evaluate the rescission of NCGNE0658, received in the MRO on May 21, 2014, 1 inspected the facility
on June 4, 2014. The inspection report is attached. The company performed an internal audit and determined they

Hi Tamera,
Thanks for calling about this one. It sounds like you have a request to rescind NCGNE0658 that originally came from
Sheri, and you are looking for the next step. Here's the best course of action I think:
1) Rescission of NCGNE0658 is appropriate, according to your inspection. Please communicate to Bradley MRO's
approval of that action.
2) NCG170413 was never actually rescinded in BIMS — even though on paper it was (the May 23, 2011 No Exposure
issuance letter stated NCG170413 COC was thereby rescinded). The company has also continued to pay the
annual fee for their NCG17 coverage.
3) Administratively, we will simply renew NCG170413 this summer, along with the mass renewal.
4) However, the No Exposure Rescission Approval Letter should indicate that we are reinstating the facility's
coverage under NCG170413. Let them know that permit is up for renewal this year, and they'll get more
information about electronic COC renewal this summer. I cannot remember if Central Office or the RO sends
that letter. Bradley?
5) In preparation for renewal, we could use the help getting permit contacts up to date. Go to this
website: http://portal.ncdenr.org/web/Ir/sw-permit-contacts and review the report for NCG170413. If you
have all the information to get those up to date (including e-mail addresses, especially for permit contact),
Tamera, could you make those in BIMS? Let us know if there's on issue with Owner Affiliation — we will probably
need the Name/Ownership change form from the company for that change.
6) Once those changes in BIMS have been made, let me know. I will fill out the renewal questionnaire for this one
so it's included in the renewal batch. Again, it's very important that we have a current permit contact (with e-
mail address) and owner contact (with e-mail address) for the most efficient renewal communication.
I've copied Sheri, but she has moved on into a permanent position with Karen Higgins's group in DWR (but it's just down
the hall). We're hoping to get more admin help for our group soon.

The Division has reviewed your submittal of the No -Exposure Certification form for Exclusion from NPDES Stormwater
Permitting. Based on your submittal and signed certification of no exposure at the above referenced facility, the site
visit of May 17, 2011, and any other documentation (i.e. photos of covers on dumpsters or drum storage, etc.) the
Division is granting your conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is
incorporated by reference in North Carolina regulations. We are also hereby rescinding your current permit Certificate
of Coverage, NCG170413.
Please note that by our acceptance of your no -exposure certification, you are obligated to maintain no -exposure_
conditions at your facility. If conditions change such that your facility can no longer qualify for No -Exposure
exclusion, you are obligated to immediately obtain NPDES permit coverage for your stormwater discharge.
Otherwise, the discharge becomes subject to enforcement as an un-permitted discharge.
You must self re -certify your No -Exposure status annually using the included form or obtain NPDES permit
coverage for any stormwater discharges from your facility. The annual self re -certification does not need to be
submitted to DWO unless requested.
Your conditional exclusion from permitting does not affect your facility's legal requirements to obtain environmental
permits that may be required under other federal, state, or local regulations or ordinances.

Inspection Summary:
Schneider Mills has requested the permit (NCG170413) be rescinded and has applied for a Certificate of Nonexposure
(Certificate No. NCGNE0658). This inspection found the following:
Scrap metal stored on -site is being removed for recycle by an independent contractor.
Containment is being installed for the diesel fuel tank.
All stormwater drains discharge to the WWTP for treatment prior to discharge to Muddy Creek.
It is recommended that NCG170413 be rescinded and the Certificate or Nonexposure NCGE0658 be implemented.

Thank you for your call this morning.
Here's what I think we said to each other this morning, and how I think we should straighten out the confusion around
the two stormwater discharge authorizations from us. you initially called asking about getting your name added as our
contact person for your facility in Taylorsville, as you have taken over new responsibilities for the stormwater permitting
of the site.
As you reported in our conversation, and as my review of our database confirms, we have issued both a stormwater
Permit (NCG170413), and a No Exposure Exclusion from Permitting (NCGNE0658). Both are still shown as active in our
database. Although I'm not certain what happened in 2011, it appears that when we issued the No Exposure in May
2011 we neglected to correct our database to show that we rescinded the other permit NCG170413, as is our normal
procedure. Consequently your coworker has gone on line and taken the first steps in renewing your coverage under
NCG170413. Our database confirms that you have been paying the annual permit fee of $100 for NCG170413, and that
you are paid up to date.
Based on my telephone description of what the No Exposure Exclusion requires of Schneider Mills, you advised that the
site was not now meeting the No Exposure Exclusion requirements. Site conditions may have changed since our initial
inspection in 2011 that supported our issuing the No Exposure Exclusion out of the Mooresville Regional Office.
• This is an unusual set of circumstances, but I think our error in 2011 provides us a relatively easy path forward to get
your name in our database as the site contact for future communications, and to straighten out your permitting status:

• At the end of our conversation it sounded like you were leaning toward renewing NCG170413 and rescinding the No
Exposure. As I reported, if you choose this option your major obligations under NCG170413 are:
• Do a twice -per -year walk around and record your visual observations of the stormwater runoff flow. The characteristics
to be observed are listed in the permit (color, odor, floating solids, oil sheen, etc.).
o Have a written management plan to control stormwater pollution and review the plan annually for any changes to it.
This is called the Stormwater Pollution Prevention Plan. You should already have this plan based on your current
coverage under NCG170413, although we did not discuss whether it has been updated annually as required under the
permit.
• I advised that the vehicle maintenance activities do not trigger any runoff sampling based on your report that the
vehicle maintenance activities do not use 55 gallons of new motor oil per month on average.

• Do a twice -per -year walk around and record your visual observations of the stormwater runoff flow. The characteristics
to be observed are listed in the permit (color, odor, floating solids, oil sheen, etc.).
• Have a written management plan to control stormwater pollution and review the plan annually for any changes to it.
This is called the Stormwater Pollution Prevention Plan. You should already have this plan based on your current
coverage under NCG170413, although we did not discuss whether it has been updated annually as required under the
permit.
1 advised that the vehicle maintenance activities do not trigger any runoff sampling based on your report that the
vehicle maintenance activities do not use 55 gallons of new motor oil per month on average.
