This permit will expire on July 31, 2004. North Carolina General Statute 143.215.1(c) requires that an application for permit coverage renewal be filed in a timely manner. A prior notice of renewal was sent for this site on December I, 2003. To date, no response has been received by the Division of Water Quality (DWQ). In order to assure your continued coverage under the general permit, you must apply to DWQ for renewal of your permit coverage. Enclosed you will find a general permit renewal application form. The application must be completed and returned by April 19, 2004 in order to assure continued coverage under the general permit. Failure to request renewal by April 9, 2004 can result in a civil assessment of at least $250.00. Larger penalties may he assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Reports of Changed conditions The permittee shall give notice to the Control Authority and/or Municipality of any planned significant changes to the permittee's operations or system which might alter the nature, quality, or volume of its wastewater at least 180 days before the change. 26. Construction No construction of pretreatment facilities or additions thereto shall be begun until Final Plans and Specifications have been submitted to the Control Authority and/or Municipality and written approval and an Authorization to Construct (A to C) have been issued. 27. Reopener The permittee shall be .modified or, alternatively, revoked and reissued to comply with any applicable effluent standard or limitation for the control of any pollutant shown to contribute to toxicity of the W WTP effluent or any pollutant that is otherwise limited by the POTW discharge permit. The permit as modified or reissued under this paragraph may also contain any other requirements of State or Federal pretreatment regulations then applicable. 28. Categorical Reopener This permit shall be modified, or alternatively, revoked and reissued, to comply with any applicable effluent standard or limitation issued or approved under Sections 302(b)(2)(C) and (D), 304(b)(2), and 307(a)(2) of the Clean Water Act, if the effluent standard or limitation so issued or approved: I.) contains different conditions or is otherwise more stringent than any effluent limitation in this permit; or 2.) controls any pollutant not limited in this permit. Notification shall include location of the discharge, type of waste, concentration and volume if known and corrective actions taken by the permittee. A written follow-up report thereof shall be filed by the permittee within five (5) days, unless waived by the Control Authority and/or Municipality. C&A Permit Renewal Synopsis Pcrmit #001 Textile Manufacturer. Dyer, Coater & Finisher SIC#s 2259, 2269 & 2299 C&A's discharge has continued to decrease in volume and in most pollutant levels. Copper, Chromium and Nickel limits are proposed at 2 '/2 to 3 times highest levels found in review of data collected over the last two years. That allows a considerate reduction, which is important to the POTW because reserves arc near non-existent on Chromium and Nickel. Existing Zinc limits were exceeded one time during the two- year period due to one bad discharge. Generally, existing Zinc limits seem appropriate. Antimony limits also seem o.k. Arsenic limits were exceeded frequently. There is not much allowance for Arsenic because of sludge criteria restrictions. Limits are 0.075 lbs/day maximum daily average. Latex discharge at this time is not causing any problems at the treatment plant and C&A has put their Latex Reduction plan aside. However, the POTW did request the right to introduce the Latex Reduction Plan if latex does start causing more problems. Existing BOD limits seem appropriate. TSS limits have been exceeded at times. TSS daily maximum limits are proposed at 400 mg/L. Flow limits are set to data review and the permit application. Limits are set as follows Proposed Parameters Limits Units max Flow 1 MGD Copper 1 lb/day Zinc 3.5 lb/day Chromium 0.2 lb/day Nickel 0.2 lb/day Antimony 75 lb/day Arsenic 0.075 Ib/day BOD 300 mg/L TSS 400 mg/L Mercury, Silver, Cyanide, Cadmium and Lead are being removed from the permits limits because there has been no significant show of any of these parameters within the last five years. Previously, these parameters were monitor only. Monthly averages are being removed from the permit because they are not necessary. The averages for BOD and TSS were increased because the monthly averages were not high enough. Justification for Modified Permit During the audit with Dana and Myrle on May 1, 2002, it was mentioned that it was unnecessary for the permits to have monthly averages. Therefore, I have done a three year study to see if it would hurt the industries to remove the monthly averages. In Collins and Aikman's case it would not hurt them. However, I increased the TSS daily limit to 400 mg/L which was changed on the allocation table. Also, the BOD daily limit is 300 mg/L and it was also changed on the allocation table Along with these changes, I added required laboratory detection limits to the permit. This is to insure that the certified laboratory that is being used by the industry is meeting the Long Term Monitoring Plan detection limits.
