Carolina and the U. S. Environmental Protection Agency dated December 6, 1983.

between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

Operating a treatment facility, discharging wastewater, or discharging specific types of stormwater to waters of the State
without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per clay. Enforcement
action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office
immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply
for and receive a new NPDES permit.

Dear Mr. Morgan:
I conducted a stormwater compliance evaluation inspection (CEI) of the subject facility on 25 October 2007. This CEI
was conducted in order to assess Tietex's compliance with their general stormwater discharge permit, NCG170195. Mr.
David Jones, Dying and Finishing Technical Manager, and Ms. Annette Chappell, Maintenance Clerk, were both very
helpful during the CEI. Their assistance and cooperation was greatly appreciated. The results of the CEI are summarized
below and in the attached inspection report.
2. This facility is located at 500 Airport Road in Rocky Mount, Nash County, NC. The NCG170195 permit/Certificate of
Coverage (COC) allows the discharge of stormwater to Goose Branch, a class C, nutrient sensitive water in the Tar
Pamlico river basin, from stormwater point source discharges associated with activities classified as establishments
primarily engaged in the manufacture of textile mill products [standard industrial classification (SIC) Major Group 22].
3. Tietex's stormwater pollution prevention plan (SP3) includes all the required components. However, a few small
discrepancies were noted as listed below:
a. The SP3 does not list accurate latitudes and longitudes for each of the stormwater discharge outfalls (SDO) as
required in Part I1, Section A, paragraph (1)(a) of the NCG170000 permit.
b. The annual review of the SP3 has not been annotated on the annual review log since 14 June 2004. Reviews of the
entire SP3 should be conducted and recorded at least annually as required in Part 11, Section A, paragraph 7 of the
NCG170000 permit. All needed updates should also be annoted.
c. Qualitative monitoring was only conducted and recorded once in 2004 and 2006. Part II, Section B of the
NCG170000 permit requires it to be accomplished twice per year, once in the fall and once in the spring. It was
accomplished twice in all other years since the plant has been in operation. Please ensure this monitoring is
conducted twice per year.
4. The SP3 has been fully implemented. A tour of the grounds of the plant revealed that it is clean and well maintained.
Only a few small discrepancies were noted as listed below:
a. The secondary containment for the peroxide tank has a sump pump that drains the containment. The pump
discharges the contents of the containment onto the grassy area just outside the containment, which then drains to
stormwater conveyances that carry the discharged fluids to SDO #3. The pump's discharge pipe does have a ball
valve that was closed at the time of the CEI but was not locked. According to Part II, Section A, paragraph (2)(b) of
the NCG170000 permit, the drain for the containment should have a lockable valve or other device that should
remain locked at all times except when in use to drain the containment after inspection of its contents. Please ensure

Please install a lockable valve on the discharge pipe for this pump and ensure it remains closed and locked at all
times as specified above. Inspection and drainage records of the secondary containment were available and
complete.
NOTE: 't If th`e pumps for the peroxide and fuel oil containments are set to come on automatically, the automatic

c. There is a small amount of unused machinery stored outside on the north side of the facility that is exposed to
precipitation. Such machinery should be stored inside or covered with removable covers to prevent contamination of
stormwater runoff from the equipment. Alternatively, Tietex could properly dispose of all such equipment.
d. There were several 55-gallon drums stored outside on the north side of the facility. Some of these drums were empty
but others were full or partially full. The drums were not properly sealed and labeled and are exposed to
precipitation. These drums should be labeled, sealed and stored inside or under cover. Ideally, Tietex should
properly dispose of all such drums and/or waste materials.
e. The underground drainage pipe for SDO #7 has collapsed approximately 50 feet east of the SDO, on the west side of
the parking lot that is located on the west side of the building. This collapse has not yet affected either the SDO or
the receiving stream; however it could if the collapsed pipe is not soon repaired. It is suggested that you repair this
section of pipe and restore the area to its former state, prior to the collapse, as soon as possible.
5. Please note that violations of the NCG170000 permit and are subject to civil penalty assessments in an amount not to
exceed $25,000 per day, per violation. Please provide a written response to this office within 30 days of receiving this
letter. Your response should include a corrective action plan and implementation schedule that addresses all deficiencies
listed above. Your immediate attention to this matter is greatly appreciated.
