Operating a treatment facility, discharging wastewater, or discharging specific types of stormwater to
waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of
up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished
permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the
site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future
you wish to again discharge to the State's surface waters, you must first apply for and receive new
coverage under an NPDES permit.

I inspected this facility on July 15, 2015 and met with J. Richard (Dick) Walker, Managing Director for Carl Marks Advisors
[212-909-8400 office, 205-305-6026 cell, rwalker@carlmarks com]�ames Barnes, the Plant Manager who signed the
rescission request form, has left the company Mr. Walker is managing the conversion of this facility into warehouse
space, and stated all correspondence should be sent to the facility to the attention of Jim Sitterly, Vice President —
Operations.
Rescission of NCG170026 is not recommended at this time. During my inspection, I observed numerous totes and
barrels, some with fluids stored in them. Please see attached pictures. Mr. Walker indicated the conversion of the
facility to warehouse space should be completed within 2 months.

This facility is in the process of removing equipment from the site for the manufacturing and the retail part is still
open. In speaking with their onsite representative they are still about 2 months from being shut down, as they get
closer to getting things moved out and stored they will notify DENR.
They will not be selling the facility and have not requested a change in SW permitting at this time.

In accordance with your application for discharge permit received on September 30, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
