This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under the authority of North Carolina General Statutes 143-215.3(a)(1), (I a) and (1b). Because this fee was not fully paid within 30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k) (4), and G.S. 143-215.1 (b) (3). Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual Administering and Compliance Monitoring Fee is received within that time. Knitwear's Kinston facility officially ceased production on July 3, 1999, and is now for sale. I talked to you on August 27th regarding the SPCC Plan for the Kinston location, and you suggested I send this letter for your office's records. The SPCC Plan applied to this facility solely because of the #6 fuel oil storage on site. Just prior to the shutdown, the storage tank was pumped down to a level of approximately two feet six inches (the pump's operation limit). At that time, we ceased implementation of the Plan's requirements. All records pertaining to this Plan will be maintained on file for a minimum of three years, as required by the regulations. We understand that we would have to again abide by a Plan should we ever operate the facility again and store petroleum products at the qualifying threshold level. However, this is a most remote circumstance. Once the facility is sold, the appropriate new ownership information will be sent to your office.
