PART 1 INTRODUCTION
SECTION A: GENERAL PERMIT COVERAGE
All persons desiring to be covered by this General Permit must register with the Division of Energy,
Mineral, and Land Resources by the filing of a Notice of Intent (NOI) and applicable fees. The N01
shall be submitted and a certificate of coverage issued prior to any discharge of stormwater
associated with industrial activity that has a point source discharge to the surface waters of the
state.
Any owner or operator not wishing to be covered or limited by this General PermiL may make
application for an individual NPDES permit in accordance with NPDES procedures in 15A NCAC 211
.0100, stating the reasons supporting the request:. Any application for an individual permit should
be made at ]cast 180 days prior to commencement of discharge.
This General Permit does not cover activities or discharges covered by an individual NPDES permit.
until the individual permit. has expired or has been revoked. Any person conducting an activity
covered by an individual permit but which could be covered by this General Permit may request
that the individual permit: be revoked and coverage under this General Permit be provided.
If industrial materials and activities arc not exposed to precipitation or runoff as describer) in 40
CPR §122.26(g), the facility may qualify for a No Exposure Exclusion from NPDES stormwater
discharge permit requirements. Any owner or operator wishing to obtain a No Exposure Exclusion
from permitting must submit a No Exposure Certification N01 firm to the Division; must receive
approval by the Division; must maintain no exposure conditions unless authorized to discharge
under a valid NPDIiS stormwater permit.; and must recertify the No Exposure Exclusion annually.
Any facility may apply for new or continued coverage under this permit until a Total Maximum
Daily Load (I'MDI.) for pollutants for stormwater discharges is established. A TMDL sets a
pollutant -loading limit that affects a watershed, or portion of a watershed, draining to an impaired
water. For stormwater discharges to watersheds affected by a "TMDL, coverage under this
permit may depend on the facility demonstrating it does not have reasonable potential to
violate applicable water quality standards for those pollutants as a result of discharges. If
the Division determines that discharges have reasonable potential to cause water quality standard
violations, the facility shall apply for an individual permit 180 days prior to the expiration date of
this General Permit. Once that individual permit: is effective, the facility will no longer have
coverage under this General permit. Note that the permittee must identify impaired waters
(scheduled for TMDI, development) and waters already subject: to a TMDL in the Site Overview, as
outlined in the Stormwater Pollution Prevention Plan (SHP), Part II, Section A.I. A list of approved
TMDI.s for the state of North Carolina can be found at
http:/Ipm•tal.ncdenr.org/web/wg/ps/mtu/tmdl.

SECTION B: PERMITTED ACTIVITIES
Until this permit expires or is modified or revoked, the permitter is authorized to discharge
stormwater to the surface waters of North Carolina or separate storm sewer system which has
been treated and managed in accordance with the terms and conditions of this General Permit and
the requirements of the purnittee's Certificate of Coverage (CO(:).
The permit.ter's COC is hereby incorporated by reference into this General Permit. Any violation of
the COC is a violation of this Gencral Permit and subject to enforcement action as provided in the
General Permit.
Any other point source discharge to surface waters of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization, or approval.
The stormwater discharges allowed by this General Permit shall not cause or contribute to
violations of Water Quality Standards.
'['his General Permit does not authorize discharges determined by the Division to he wastewaters.
The discharge or disposal of vehicle wash water or vehicle rinse wateris not authorized by this
Gencral Permit. The discharge or disposal of any paints, solvents, petroleum, diesel oil, or oil and
water mixtures applied to any surface of vehicles or equipment is not authorized by this General
Permit.
']'his permit does not relieve the permittee from responsibility for compliance with any other -
applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

PART 11 MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED
DISCHARGES
SECTION A: STORMWATER POLLUTION PREVENTION PLAN
The permittee shall develop and implement a Stormwater Pollution prevention plan (SPPP). The
SPPP shall he maintained on site unless exempted from this requirement by the Division. The SPPP
is public information in accordance with Part 111, Section R, paragraph 3 of this permit. The SPPP
shall include, at minimum, the following items:
Site Overview. The Site Overview shall provide a description of the physical facility and the
potential pollutant: sources that may be expected to contribute to contamination of stormwater
discharges. The Site Overview shall contain the following:
(a) A general location map (USGS quadrangle map or appropriately drafted equivalent map),
showing the facility's location in relation to transportation rouges and surface waters; t:he
name of the receiving waters to which the stormwater outtalls discharge, or it the discharge
is to a municipal separate storm sewer system, the name of the municipality and the
ultimate receiving waters; and latitude and longitude of the points of stormwater discharge
associated with industrial activity. The general location map (or alternatively the site map)
shall identify whether any receiving waters are unpaired (on the st:ate's 303(d) list of
impaired waters) or if the site is located in a watershed for which a TMDL has been
established, and What -the parameters of concern are.
(b) A narrative description of storage practices, loading and unloading activities, outdoor
process areas, dust or particulate generating or control processes, and waste disposal
practices. A narrative description of the potential pollutants that could be expected to be
present in the stormwater discharge from each outfall.
(c) A site map drawn at a scale sufficient to clearly depict: the site property boundary; the
stormwater discharge outfalls; all on -site and adjacent surface waters and wetlands;
industrial activity areas (including storage of materials, disposal areas, process areas,
loading and unloading areas, and haul roads); site topography and finished grade; all
drainage features and structures; drainage area boundaries and total contributing area for
each outfall; direction of flow in each drainage area; industrial activities occurring in each
drainage area; buildings; stormwater Rest Management practices (RMPs); and impervious
surfaces. The site map must indicate the percentage of each drainage area that is
impervious, and the site map must include_a graphic scale indication and north arrow.
(d) A list of significant spills or leaks of pollutants during the previous three (3) years and
any corrective actions taken to mitigate spill impacts.
(e) Certification that the stormwater outfalls have been evaluated for the presence of non-
stormwater discharges. The permittee shall re -certify annually that the stormwater
outfalls have been evaluated for the presence of non-stormwater discharges. The
certification statement shall be retained with the SPPP, and shall be signed in accordance
with the requirements found in Part III, Section 13, paragraph S.
Part 11 Page I of 10 Pages
fermi( No. NCG160000
2. Stormwater Management Strategy. The Stormwater Management Strategy shall contain a
narrative description of the materials management practices employed which control or
minimize the stormwater exposure of significant materials, including structural and
nonstructural measures. 'fhe Stormwater Management Strategy, at a minimum, shall
incorporate the following:
(a) Feasibility Study. A review of the technical and economic feasibility of changing the
methods of operations and/or storage practices to eliminate or reduce exposure of
materials and processes to rainfall and run-on flows. Wherever practical, the permittee
shall prevent exposure of all storage areas, material handling operations, and
manufacturing or fueling operations. In areas where elimination of exposure is not
practical, this review shall document the feasibility of diverting the stormwater run-on
away from areas of potential contamination.
(b) Secondary Containment Requirements and Records. Secondary containment is
required for: bulk storage of liquid materials including petroleum products; storage in any
amount of Section 313 of,fitle III of the Superfund Amendments and Reauthorization Act
(SARA) water priority chemicals; and storage in any amount of hazardous substances in
order to prevent leaks and spills from contaminating stormwater runoff. A (able or
su rnmary of all such tanks and stored materials and their associated secondary
containment areas shall be maintained. If the secondary containment devices are
connected to stormwater conveyance systems, the connection shall be controlled by
manually activated valves or other similar devices, which shall be secured closed with a
locking mechanism. Any stormwater that accumulates in the containment area shall be at a
minimum visually observed for color, foam, OW -fall staining, visible sheens, and dry weather
flow, prior to release of the accumulated stormwater. Accumulated stormwater shall he
released if found to be uncontaminated by any material. Records documenting the
individual making the observation, the description of the accumulated stormwater, and the
date and time of the release shall be kept for a period of five (S) years. For facilities subject
to a federal oil Spill Prevention, Control, and Countermeasure plan (SPCC), any portion of
the SPCC plan fully compliant with the requirements of this permit may be used to
demonstrate compliance with this permit.
(c) BMP Summary. A listing of site structural and non-structural Best Management practices
(BMPs) shall be provided. The installation and implementation of BMPs shall be based on
the assessment of the potential for sources to contribute significant quantities of pollutants
to stormwater discharges and on data collected through monitoring of stormwater
discharges. The BNiP Summary shall include a written record of the specific rationale for
installation and implementation of the selected site BMI's. The BMP Summary shall he
reviewed and updated annually.
3. Spill Prevention and Response Procedures. The Spill Prevention and Response Procedures
(MITI') shall incorporate an assessment of potential pollutant sources based on a materials
inventory of the facility. Facility personnel responsible for implementing the SPRI' shall be
identified in a written list incorporated into the SPRI' and signed and dated by each individual
acknowledging their responsibilities for the procedures. A responsible person shall be on -site
at all times during facility operations that have increased potential to contaminate stormwater
runoff through spills or exposure of materials associated with the facility operations. The SIRP
must be site stormwater specific. Therefore, an oil Spill Prevention Control and
Countermeasure plan (SI C) may be a component of the SPRI', but may not be sufficient to
Part 11 Page 2 of 10 Pages
Permit No. NCG 160000
completely address the stormwater aspects of the SPRP. The common elements of the SPCC
with the SPRP may be incorporated by reference into the SPRP.
4. Preventative Maintenance and Good Housekeeping Program. A preventative maintenance
and good housekeeping program shall be developed and implemented. The program shall
address all stormwater control systems (if applicable), sLormwaLerdischarge outfalls, all on -
site and adjacent surface waters and wetlands, industrial activity areas (including material
storage areas, material handling areas, disposal areas, process areas, loading and unloading
areas, and haul roads), all drainage features and structures, and existing structural HMPs. The
program shall establish schedules of inspections, maintenance, and housekeeping activities of
stormwater control systems, as well as facility equipment, facility areas, and facility systems
that present a potential for stormwater exposure or stormwater pollution where not already
addressed under another element of the SPPP. Inspection of material handling areas and
regular cleaning schedules of Lhese areas shall be incorporated into the program. Timely
compliance with the established schedules for inspections, maintenance, and housekeeping
shall be recorded and maintained in the SPPP.
Facility Inspections. Inspections of the facility and all stornnvatersystems shall occur as part:
of the Preventative Maintenance and Good Housekeeping Program at a minimum on a semi-
annual schedule, once (luring the first half of the year (January to June), and once during the
second half (July to December), with at least 60 days separating inspection dates (unless
performed more frequently than semi-annually). These facility inspections are different from,
and in addition to, the stormwater discharge characteristic monitoring at the outfalls required
in Part II 13, C, and 1) of this permit.
6. Employee Training. 'Training programs shall be developed and training provided at a
minimum on an annual basis for facility personnel with responsibilities for: spill response and
cleanup, preventative maintenance activities, and for any of the facility's operations that have
the potential to contaminate stormwater runoff. The annual training shall be documented by
the signature and printed or typed name of each employee trained.
7. Responsible Party. The SPPP shall identify a specific position or positions responsible for the
overall coordination, development-, implementation, and revision of the SPPP. Responsibilities
for all components of the SPPP shall be documented and position assignments provided.
8. SPPP Amendment and Annual Update. All aspects of the SPPP shall be reviewed on an
annual basis. The permittee shall amend the SPPP whenever there is a change in design,
consLruction, operation, site drainage, maintenance, or configuration of the physical features
which may have a significant effect- on the potential for the discharge of pollutants to surface
waters. The annual update shall include at minimum:
(a) an updated list ofsignificantspills or lealfs of pollutants for the previous three (3]
years, or the notation that no spills have occurred (element- of the Site Overview);
(b) a written re -certification that the stormwater outfalls have been evaluated for the
presence of non-storrwater discharges (element of the Site Overview);
(c) a documented re-evaluation of the effectiveness of the on -site stormwater 13MPs
(13MP Summary clement of the Stormwater Management Strategy).
(d) a review and comparison ofsample analytical data to benchmark values (if applicable)
over the pastyear, including a discussion about Tiered Response sLaLus. The
permittee shall use the Division's Annual Summary Data Monitoring Report (DMR)
form, available from the Stormwater Permitting Program's website (See 'Monitoring
Forms' here: http://portal.nc(leni-.org/web/h-/nudes-stormwater).

1 Maintain semi-annual monitoring during permit renewal process. If atthe expiration of the general
permit, the permittee has submitted an application for renewal of coverage before the submittal
deadline, the permittee will be considered for renewed coverage. The applicant must continue semi-
annual monitoring until the renewed Certificate of Coverage is issued.
2 If no discharge occurs during the sampling period, the permittee mustsubmit a monitoring report
indicating "No Floe," within 30 days of the end of the six-month sampling period.
In all cases, the permittee shall report the analytical results from the first sample with valid results
within the monitoring period. The permittee shall compare those results to the benchmark values in
'rahle 3. 6xceedenccs of benchmark values require the permittce to increase monitoring, increase
management actions, increase record keeping, anti/or install stormwater Rest Management Practices
(I3MI's) in a tiered program.

The benchmark values in Table 3 are not enforceable permit limits. An exceedance of a stormwater
benchmark value is not permit violation; however, failure to respond to the exceedances as outlined
in this permit is a violation of permit. conditions. The benchmarks are intended to reduce polluted
discharges by triggering the permitter's required response actions under Piers One, Two, and "Three.
See below the descriptions of Piers One, Two, and Three response actions.

It: Fhe first valid sampling results are ahove a henchmark value for any parameter at any outfall;
Then: The permittee shall:
1. Conduct stornnvater management inspection within two weeks of receiving the sample results.
2. Identify and evaluate possible causes of the henchrark value exceedence.
3. Identify potential, and selectthe specific feasible: source controls, operational controls, or physical
improvements to reduce concentrations of the parameters of concern.
h. Implement the selected feasihle actions within two months of the inspection.
5. Record each instance of a Tier One response in the SPPP. Include the date and value of the
henchmark exceedence, the inspection date, the personnel conducting the inspection, the selected
feasihle actions, and the date the selected feasible actions were implemented.
6. Note: Exceedances for a different parameter separately trigger the tiered response requirements.
Two
If: The first valid sampling results from two consecutive monitoring periods are ahove the henchmark values
for anv specific parameter at a specific discharge outfall:
Then: The permittee shall:
1. Repeat all the required actions outlined ahove in Tier One.
2. Immediately institute monthly monitoring and reporting for all parameters at every outfall where a
sampling result. exceeded the benchmark value for two consecutive samples. Monthly (analytical and
qualitative) monitoring shall continue until three consecutive sample results are below the
henchmark values.
3. If no discharge occurs during the sampling period, the permittee is required to submit a monthly
monitoring report indicating "No Floe' to comply will) reporting requirements.
4. Alternotively, in lieu of steps 2 and 3, the permittee may exercise the option of contacting the DFNILR
Regional Office Engineer as provided below in Tier Three. The Regional Office Engineer may direct
the response actions on the part of the permittee as provided in Tier Three. The permittee will he
considered to he ohligated under the Tier Three provisions.
S. Maintain a record of the Tier Two response in the SPPP.
6. Continue Tier Two response obligations throughout the permit COC renewal process.
Tier Three
If the valid sampling results requires] for the permit monitoring periods exceed the benchmark value for
any specific parameter at any specific outfall on four occasions, the permittee shall notify the DI?MLR
Regional Office Engineer in writing within 30 days of receipt of the fourth analytical results. DEMLR
may but is not limited to:
• require the permittee to revise, increase, or decrease the monitoring and reporting frequency for
some or all parameters, including requiring sampling of additional or substitute parameters;
• rescind coverage under the General Permit, and require that, the permittee apply for an individual
stormwaterdischarge permit;
• require the permittee to install structural storrnwater controls;
• require the permittee to implement otherstormwater control measures;
• require the permittee to perform upstream and downstream monitoring to characterize impacts on
receiving waters;
• require the permittee implement: site modifications to qualify for a No Exposure Exclusion; or
require the permittee to continue Tier Three obligations through thepermit COC renewal process.
Part 11 Page 6 of 10 Pages
Permit No. NCG 160000
Failure to monitor and report per the permit terms may result in the Division requiring
monthly monitoring and reporting for all parameters for a specified time period Lack of a
discharge from an outfall for the monitoring period, or inability to collect a sample because of
adverse weather conditions during a monitoring period will not constitute failure to monitor, as
long as those conditions are reported on the monitoring period DMR and noted in the SPPP. (See
Adverse Weather in Definitions.) Similarly, sampling is not required outside of the facility's normal
operating hours.
However, if a facility is inactive for an extended period of time, the permittee must request, and
obtain, dormant site status from the 1)1-:MLR Regional Engineer in order to be excused from
sampling during the dormant period. The DBILklettergrantingdormantstatus must bekept with
the SPIT, and available for inspection.
In the event that. the Division releases the permittee from continued monthly monitoring and reporting
under Ticr Two o -Tier Three, DEMI.R's release letter may remain in effect through subsequent
reissuance of this permit, unless the release letter provides for other conditions or duration.
The permittee must:. report. all results from all valid discharge samples taken during each monitoring
period. However, for purposes of benchmark comparison and Ticred response actions, the permittee
shall use the analytical results from the first sample with valid results within the monitoring period.
SECTION C: QUALITATIVE MONITORING REQUIREMENTS
The purpose of qualitative monitoring is to implement a quick and inexpensive way to evaluate the
effectiveness of the permittee's SPPP and to identify the potential for new sources of stormwater
pollution. Qualitative monitoring of stormwater outfalls must be performed during a measurable
storm event.
Qualitative monitoring requires a visual inspection of each stormwater outfall regardless of
representative outfall status. Qualitative monitoring shall be performed as specified in Table 4 with
each required analytical monitoring event: whether semi-annual or more frequently as may be
subsequently required under Tier Two, Tier "Three, or per the Qualitative Monitoring Response
requirements below. Inability to monitor because of adverse weather or lack of discharge during
the monitoring period must be documented in the SPPP and recorded on the Qualitative Monitoring
Report (see Adverse Weather in Definitions). Only SDOs discharging stormwater associated with
industrial activity must be monitored (See Definitions).
In the event an atypical condition is noted at a stormwater discharge outfall, the permittee shall
document the suspected cause of the condition and any actions taken in response to the discovery.
This documentation will be maintained with the SPPP.

(SDO) associated with industrial activity, regardless of representative outfall status (ROS).
A minimum of 60 days must separate monitoring dates, unless uddit:ionul sumplinrl hus been
instituted us part of otherunulytical monitoring requirements in this permit.
If the permitter's qualitative monitoring indicates that existing stormwater BMI's are ineffective, or that.
significant stormwater contamination is present, the permittee shall investigate potential causes, evaluate
the feasibility of corrective actions, and implement those corrective actions within 60 days, per the
Qualitative Monitoring Response, below. A written record of the permittee's investigation, evaluation,
and response actions shall he kept in the SPIT.
Qualitative Monitoring Response
Qualitative monitoring is for the purposes of evaluating SPIT' effectiveness, identifying the potential
for new sources of stormwater pollution, and prompting the permittee's response to pollution. If
the permittee repeatedly fails to respond effectively to correct problems identified by qualitative
monitoring, or if the discharge causes or contributes to a water quality standard violation, DBMLR
maybut is not limited to:
• require that the permittee revise, increase, or decrease monitoring Irequency for some or
all parameters (analytical or qualitative);
• rcquirc the permittee to install structural stormwater controls;
• require the permittee to implement other stormwater control measures;
• require the permittee to perform upstream and downstream monitoring to characterize
impacts on receiving waters; or

Technical Bulletin for N.C. General Stormwater Permit NCG160000
Division of Energy, Mineral, and Land Resources
Technical Bulletin for NCG 160000, Volume II Last Revised 9/17/2014
What activities are covered by this general permit?
NCGIti0000 authorizes industrial stormwa ter discharges associated with activities classified as establishments
primarily engaged in manufacturing Asphalt. Paving :Mist.ures and Blocks standard industrial classifica.
Lion (SIC) 29511; and like activities demned by DE:AMI.R to be similar in the process or the in the exposuro of rasa
materials, final products, by-products, or waste materials.
What are the key permit requirements?
• Develop and implement a written St,ormwat.er pollution Prevention Plan (SPIT) (fart I], Section A).
• Provide secondary containment, for all bulk storage of liquid materials (Part. II, Section A, 2.(b)).
• Perform, document., and report analytical monitoring during a measureable storm event twice each year. At.
the same time perform and document visual monitoring twice each year. (Part 11, Sections B R,, C).
• Respond to benchmark exreedaneee of the monitoring parameters as described in the "Fier 1, Tior 2, and Tr r 3
response action provisions in the permit text..
What has changed since the last renewal?
Some of the changes since the last. renewal include:
• Twice. -per -year monitoring of pit and TPH are no longer required.
• Refinements and minor clarifications to the SPIT requirements; refer to fart 11, Section A.
• The permittoe should find it easier to sample during a measureable stoma event (new term this revision),
rather than a representative storm. event (old term, previous permit.)
• DG_UILR is referenced throughout as the permitting authority, rather than the now defunct. DWQ.
• The permit has new provisions for e-reporting, once our agency's capabilities for e-reporting are established.
• A lower TSS benchmark of 50 mg/L for stormwater discharges into especially protected waters.
What are BMPs, and why are they important?
Your SPIT should identify Best. Nianagement Practices (BJMPs) to reduce the discharge of pollutants from
your stormwater outfalls. BNIPs include practices and features that reduce the potential for pollutants to get,
into the stormwater draining from a facility. 13NM1's may be categorized as non-.slsuctteral or structural:
Non-structural (practices or actiuitie.$) BA11'.s include.:
+ Khminating exposure of materials and equipment wherever possible by moving them to indoor locations.
+ practicing good housekeeping on site.
* Ilandling and storing materials at the facility in an orderly fashion.
Replacing hazardous materials with non -hazardous ones wherever possible.
* Establishing routine leak & inaint.enance checks to minimize chance of spills. Clean up spills immediately.
Establishing bulk storage tank protocols that minimize the risk of spills during loading and unloading.
Structural (equipment or devices) BAIN include:
* Containment dikes around the loading areas of bulk liquid storage containers.
* hoofs and secondary containment around materials stored outside so that, storrnwaLer cannot contact. them.
* Well-vegetat.ccl borders or buffers around pavement, buildings, and operating areas.

Frequently Asked Questions
Could I be exempted from an
NPDES stormwater permit?
Possibly. A facility subject to the
NPDES storma-ater regulations
that eliminates all potential
stormwater exposure may be eligi-
ble for a No F. posure Exclusion
from a permit. The facility must
self -recertify annually that it still
fully meets the qualifications of no
exposure. Application forms for
this exclusion are available on our
website shown below.
What if I sell my business, or
the name changes?
You are required to notify DEMI I
of those changes, and our specific
continuation of permit coverage is
subject to the Director's approval.
Please submit the Name/
Ownership Change form located
on our Program website.
Do I have to monitor all the
outfalls?
Yes. However, you may request
Representative Outfall Status
(ROS). If approved, this status
allows analytical monitoring at
fewer outfalls. To request ROS,
submit our ROS Request Form to
the DE:\9LR Regional Office. The
form is available on our website
(see below).

Does a certified lab need to
analyze my samples?
Monitoring under NPDES permits
must be conducted in accordance
with test procedures approved in
federal regulations in 40 CFR §136.
All labs certified by North Carolina
perform analysis in accordance
with those procedures. \\'hile N.C.
certification requirements do not
apply to testing stormivaler-only
discharges, data gathered under an
NPDES permit must still conform
to federal requirements. Using a
North Carolina certified lab is one
way to ensure compliance. A list of
certified labs is available from:

ceriJ
Who inspects my site, and for
what?
DEMLR regional office staff may
visit, the site to see if you have the
permit, an acceptable SPPP, and
that you are following your SPPP.
'These inspections may be routine
or they may be the result of public
complaints. Please take compliance
seriously! Facilities that violate
stormwater permit conditions may
be subject to fines. Civil penalties
of up to $25,000 per day may be
assessed for each violation.
What happens if when I pull
samples for my semi-annual
analytical monitoring I'm
unable to get a sample for
one of the parameters?
If this happens please sample for
the missing parameter during the
next measureable storm event.
If I'm sampling my discharge,
do I do qualitative monitoring
at the same time?
Yes.
What Do I Do When My
Stormwater Permit Expires?
In the State of North Carolina, the
Stormwater General Permit is in
force and effect, and covered facili-
ties are allowed to continue dis-
charging under the permit, until
the general permit is reissued or a
new general permit is issued.

Subject: NOTICE OF VIOLATION
Permit No.NCG 160203
Malmo Asphalt Plant, LLC
Brunswick County
Dear Mr. Stark:
Natural Resources
John E. Skvarla, III
Secretary
On June 27, 2013, Joanne Steenhuis of the Division of Water Quality (Division) from the Wilmington
Regional Office conducted a compliance inspection of your facility located off Malmo Loop Road in
Leland, Brunswick County. The inspector met with Dan Mysuik, from your office, and Doug Schmidt, the
on -site representative of the facility. The Division appreciates the assistance they provided during the
inspection procedures.
This site was issued an NPDES Stormwater General Permit (No. 160203) on February 11, 2011. The
permit requires a written Stormwater Pollution Prevention Plan within 12 months of receiving coverage
under the General Permit. The permit also requires quantitative monitoring of stormwater discharges
from the site. Failure to follow your permit requirements is a violation of North Carolina General Statute
143-215.1(a). Accordingly, the following observations and permit condition violations were noted
during the Division of Water Quality inspection and subsequent file review:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has not been developed, recorded, and properly
implemented. The failure to develop this plan represents a violation of the requirements specified in
Part II. Section A. 1-9 of the NPDES General Stormwater Permit 160000.
2) Analytical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.
The failure to conduct analytical monitoring represents a violation of the requirements specified in
Part II. Section B of the NPDES General Stormwater Permit 160000.

31 Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit
requirements. The failure to conduct qualitative monitoring represents a violation of the
requirements specified in Part II. Section C of the NPDES General Stormwater Permit 160000.
Other Observations:
4) Asphalt piles
Excess asphalt was dumped outside the permitted site and additional accumulation of debris and
general trash has also been incorporated into some of the piles. These piles are fairly spread out and
the stormwater runoff that would be associated with the site is now fairly large. The failure to include
these areas in the site plan represents a violation of the requirement specified in Part. II Section A
1(c).
5) Hydrocarbons
The inspector also noted that inside the secondary containment barrier there were areas where the
gravel and soil were covered in liquid asphalt or some other type of hydrocarbons. The areas seemed
to be an accumulation of spills over time and had not been removed.
The following portion of this letter explains North Carolina General Statute 143-215.75 et seq., Oil

Inspection Summary:
The site needs to put together the required Stormwater Pollution Prevention Plan and implement it. There are additional
housekeeping issues that also need to be addressed concerning the secondary containment area. The oil stained gravel
needs to be removed and any contaminated soil associated with it. The gravel and soil needs to be disposed of properly.
In addition, there were a couple of other areas of stained soil that needs to be removed and addressed. Please contact
Wayne Randolph with in the Wilmington Regional Office concerning the removal of the stained gravel and soil for what
requirements you may have to meet for the "spill". His number is 910.796,7320.
Barrels on -site need to be labeled and placed in a secondary containment system and if possible placed undercover.
The stormwater pond does seem to collect for the industrial area that is covered in the plan, but the additional area where
excess asphalt has been dumped is not covered by the stormwater plan. This area needs to be added to the stormwater
plan and suitable sampling sites needs identified to collect for stormwater runoff. The runoff from this additional area can
be routed to go to the stormwater pond or the site cleaned up and the excess asphalt placed within the existing site area
or somehow address this issue.
Sampling could be done if there is any discharge before the August 31 st deadline to head towards compliance.
Monitoring needs to be done to meet the qualitative and analytical requirements
The Regional Office is working with the applicant's representative to address some of these issues to move the site
towards compliance.
