On 2/16/2009, the Division of Water Quality received your request to rescind you coverage under Certificate of Coverage
Number NCG 160101. In accordance with your request, Certificate of Coverage Number NCG 160101 is rescinded
effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State
without valid coverage under -an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per
day. it is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished
permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires
r pemit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to
the State's surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform the new or
prospective owners of their potential need for NPDES permit coverage.

Jerry Rimmer performed a recon visit to Rose Brothers Paving on SR 1200 in Gaston,
NC. A stormwater CEI was planned, but none was present on the site. Myrl Nisely had YO) 1 o 1(0
visited the site twice before and found no one present. The loaders on the site are
apparently being used as the material stockpiles had been worked and the loaders
relocated each time a visit occurred. An attempt to contact by phone has been
unsuccessful. The site has not been abandoned and the telephone is still in service, but
apparently the site is not being used. The tanks on site are contained. Piles of asphalt
shingles area among the raw material piles and recycle asphalt piles, but nothing is being
processed at this time. Stormwater drains to several locations in all directions. The
discharges near the road have been covered with gravel to control potential silt in
discharge. This site is not abandoned, but not being used.

Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG 160000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions
* A Certificate of Coverage
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, slate, or local law, rule, standard, ordinance, order, judgment, or
decree.

Dear Mr. Perry:
On August 6, 2008 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality
made an inspection of the Gaston asphalt facility for stormwater permit compliance. It was a
pleasure meeting you, and the help you provided was greatly appreciated. The plant was in
compliance. Please see the attached inspection checklist. These observations are offered:
This plant typically runs only about 66 days per year, spread over about a four -month period,
2. A well -written Stormwater Pollution Prevention Plan had been updated in July. All of the
required components were there, although written documentation of employee training was
absent. Discussion of training with you convinced me that training had been provided, but
attendance records has not been generated at the time. As we discussed, one attendance sheet
that will show the dates and personnel present at the various Rose Bros. sites when training is
given can be inserted into each of the SP3 manuals at those sites. A majority of the
employees work from site to site, so only a few new names will be added at each facility
once the major crew has received training,.
3. There was confusion for a while about historical analytical sampling being done only at one
of nine outfalls. Eventually a 1995 letter granting representative outfall status was located.
A tour of the site confirmed that this status is appropriate. Data on TSS from the last eight
years had a range of 6 mg/1 to 35, compared to the cutoff concentration of 100 mg/I.
4. Qualitative monitoring, recorded on a company checklist, is done weekly, more than meeting
the semi-annual reviews specified by the permit.

Hertford, NC, Lewiston, NC, and Gaston, NC.
Dear Mr. Clarke:
Enclosed are four revisions for Rose Brothers Paving Company sites at the locations mentioned
above. These revisions were prepared in accordance with Monitoring Requirements of NCG160000, 1
apologize for the inconvenience.
At the Murfreesboro site, Outfall #2 is the sample point. If during a rain event (0.1 inches or more)
water does not flow through the outfali, no sample has to be collected. Simply document the visual
observation and keep it in your records.
At the Hertford site, all water eventually flows to the highway ditch. We recommend sampling just
downstream of Outfall #8. Sampling here will include ail water from this site and some runoff from the
highway. if a significant quantity of pollutants are present, Outfalls I, 7, 8 and 9 must be sampled before
entering the highway ditch to better determine where the pollutant source originates.
At the Lewiston site, Outfalls 2, 4 and 5 will need to be sampled. Outfall #4 appears to be a point -
source; however, If during a rain event, no water other than sheetflow is present, it can be considered a
Non -Point source and does not require sampling. For this site, the majority of pollutants can be expected
from Outfall #5 because it drains the production area. A petition can be sent to the Director of the Division
of Environmental Management requesting permission to only sample Outfall #5. If the director finds that to
be a reasonable request, he or she can grant permission to only sample this one out fall.
At the Gaston site, all water leaving the site eventually flows to Outfall #9. This sampling point
includes runoff from other areas as well as the site runoff. If pollutants appear in the sample, Outfalls I, 9
and 10 will need to be sampled before entering the highway ditch to locate pollutants.
Also included In this package is a sample calculation for determining stormwater flow. Once again, I
apologize for this inconvenience. If you have any questions about your stormwater management, or I can be
