requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as
subsequently amended.)

The General Permit authorizes discharges of stormwater only, and it specifies your obligations with
respect to stormwater discharge controls, management, monitoring, and record keeping. Please review
the new permit to familiarize yourself with all changes in the reissued permit. Significant changes to the
General Permit are outlined in the attached Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by
DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

permit expired on 7/31/2009. To assure consideration for continuing coverage under your permit, you
must apply to the Division of Water Quality (DWQ) for renewal of your permit. Enclosed you will find a
permit Renewal Application Form, Supplemental Information request, and a Stormwater Pollution
Prevention Plan Certification for your facility. Filing the application form along with the requested
supplemental information will constitute your application for renewal of this permit. .
The application and supplemental information must be completed and returned to DWQ by May
15, 2012. Failure to request renewal within this time period will result in the inactivation of your expired
permit in our system. Discharge of stormwater without coverage under a valid stormwater NPDES permit
constitutes a violation of N.C. General Statute 143-21.5.1 and may result in the assessment of civil
penalties of up to $25,000 per day.

The purpose of this correspondence is for Quible & Associates, PC (Quible) to respond to a request from
the NC Division of Water Quality (DWQ) regarding the status of a Stormwater Pollution Prevention Plan
(SPPP) for the RPC Contracting, Inc (RPC) site in Kitty Flawk, Dare County, NC. t further reference the
February 3, 1999 Stormwater Permit No. SW7991013 issued to R&M Asphalt and the associated
National Pollutant Discharge Elimination System (NPDES) permit issued to the facility based on a
February I Ith, 1999 application and submittal to DWQ prepared by Quible for the asphalt plant.
With that as a background, I am submitting for your review a Health and Safety Plan prepared for RPC
that outlines responsibilities for the corporation and their employees on a broad range of subjects.
Included within that report are sections that speak to spill prevention and actions to be taken in the event
of a release (See Chapters 3, 5,7, I7). In addition, RPC has developed a Hazardous Material Control and
Management Program (enclosed). It is our opinion, that the procedures and information contained
therein constitute a SPPP and will insure prompt and adequate actions should a pollution event associated
with the stonnwater retention system occur. In addition, Joe Staten of RPC advises me that the issues
You raised during your on -site inspection of the facility have been addressed.

1 am.pleased that the result.of your investigation, which was prompted by'complaints to your
deparPmenYand others,.has resulted in'no violations associated with permit or'compliancc
programs. Despite our continuous efforts to run a responsible business that benefits the
surrounding community, we understand that complaints -from a few individuals will result in Such,
investigations: Please know,that we will always.demonstrate the cooperation.you observed today,
as,in the past, regardless of our perception of the validity of such complaints.
While your department and'members;of CAMA and the Coast Guard had no issues with our site, "
our walkthrough and solicitation :for suggestions from everyone present, 'resulted in a suggestion,
for improvement., As a result, Robbie Parker, Carolina Asphali Member, offered to fortify the "
existing'buffer between the berm we installed'for.the storm water permitand existing impervious,'
material from the prior asphalt business. While this is not required; nor was there any -apparent•
issues from any department present related to the.current site configuration, it wasbrought to our
attention that doing so would be considered a Best Management Practice or "BMP."
It, is our hope that Mr: Parker's offer will further demonstrate our cooperation with regulatory
departments as well as the community. While_ we are currently working through a,backlog,of .,
business due to all,the rainfall in the area over the.last several months, it is our intention to work
on this bettermentover the next 30-45 days.

Senator John Edwards received your e-mail correspondence dated March 1, 2003,.and
forwarded it to Secretary Bill Ross for response since it is related to state environmental
programs. Secretary Ross asked me to check into your concerns and let you know what I
found out. I apologize for the delay in responding to you; it has taken me a little extra
time tracking down enough information to provide a full response.
I contacted the director of the Division of Water Quality (DWQ) about your latest
complaint. The DWQ records indicate that DWQ staff have made several site visits and
have investigated complaints from you as well as others. Additionally, staff from the
Division of Coastal Management (DCM) have made several site visits and investigated
complaints. The Division of Water Quality has not found any violations of its permit or
program requirements to date.
After the plant had been restarted in 1999 after several years of inactivity, the Division of
Coastal Management was contacted about the possibility that the plant had never received
a CAMA permit. The DCM assistant director and staff from our Elizabeth City office
investigated the circumstances and discovered the plant was originally built in 1994 prior
to the incorporation of the Town of Kitty Hawk. During this time the waters surrounding
the site were thought to be non -jurisdictional in that there appeared to be no hydrological
connection to Kitty Hawk Bay. Under this mistaken belief (much later it was
determined that there was a connection to the Bay), Dare County authorized construction
of the plant without notifying the property owners that a CAMA permit was required. In
spite of this early mistake, DCM has determined that the plant would have been eligible
for a CAMA permit had an application been submitted. We certainly would not have
then required the plant to be dismantled and reassembled following a permit issuance, nor
will we require such an action today. Additionally, the Town of Kitty Hawk has zoned
the property where the asphalt plant is located as an acceptable use so there is no current
zoning violation.

Regardless of the many site visits already made by staff from the Department of
Environment and Natural Resources (DENR) to Carolina Asphalt in Kitty Hawk, we are
sending some DENR staff to the site again in the near future to see if any current
problems exist. If we find violations, we will have the plant correct them immediately
and will let you know, also.

As you ]snow, today two members of the Coast Guard Marine Safety Team responded to
a complaint that oil was contaminating the water surrounding our site. Fortunately, the
inspectors determined that no oil had reached the water, but were concerned that the rain
expected this week could. cause a problem.
Upon our review of the site, it is clear that you are in violation of our lease agreement
which prohibits storage of hazardous materials. Your company placed several barrels of
oil on the side of the building. Several barrels were open including two open containers
and oil filters that leaked oil on the ground. With the recent rain, it was apparent that oil
and rain water overflowed from two containers and oil residue was heading toward the
water. They informed us that IF the water had been contaminated, substantial fines
would have been levied against us. Further, our immediate action was required to avoid
possible fines of S27,500 per day.
Needles to say, we are taking this incident very seriously and hope that you will by
working with us to resolve the matey. Our required clean-up efforts are only one aspect
to consider as we move forward from this incident. Of course we expect to be
reimbursed for the cost of our remediation efforts and your full cooperation by removing
the oil barrels by the end of the day. The removal of the barrels from their current
location was specifically required by the Coast Guard. While we do not foresee a
problem, part of the remediation efforts will include verification that the soil underlying
the asphalt is clean. Such verification will need to be provided by a firm capable of
making such a determination. We are requiring this based on the fact that we have
existing reports showing that the sites were clean prior to this incident. If you desire our
assistance in arranging this test, or are unable to comply with this request immediately,
we will have the study performed and include the cost of the study in our bill to clean up
the site. Removal of the oil contaminated ground/asphalt will include disposal to a
location approved to receive such material.

Also, we request that you document a plan for any future use and disposal of hazardous
materials. We will review the plan will cnvironmentat and legal experts to determine if
such activities will be properly performed and controlled. Subsequent to our
determination, we will let you know if such future activities will be acceptable at our
location.
Up to this incident we have appreciated you as a tenant and your agreement with the
content of this letter is critical to continue our landlord tenant relationship. Therefore, if
you agree to work with us in the required remediation efforts, please sign below. If not,
be advised that we will immediately corrur ence all actions necessary including the
termination of your lease.
As local residence we take environmental and clean water issues very seriously and
sincerely hope that you will work with us to correct your Company's transgression and

on May 14, 2002. The facility was found to be in Compliance with the permit at the time of the
inspection. Observations and comments from the site inspection include the following:
The bulk storage secondary containment structure valve was not locked. A best management
practice for the pollution source would be to lock the valves such that the stormwater team would
have control of this possible source of pollution.
The stormwater pollution prevention plan was not on site. After discussing the matter with you,
you stated that the plan was kept at the front office but was not at the Carolina Asphalt Office.
You stated that the plan would be relocated to the site.

forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable
to you, you have the right to request an individual permit by submitting an individual permit application. Unless
such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of
Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act
or any other Federal or Local governmental permit that may be required.

your notification that the Division of Water Quality (DWQ) has reissued the general permit and that your
facility's coverage will continue under the conditions of the reissued general permit. Please review the new
permit to familiarize yourself with the changes in the reissued permit. The permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state
of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

ASPHALT MANUFACTURING EQUIPMENT AND THE ASPHALT MANUFACTURING
PLANT SHALL BE CONSTRUCTED, MAINTAINED, AND OPERATED IN COMPLIANCE
WITH ALL APPLICABLE LOCAL, STATE, AND FEDERAL REGULATIONS AS WELL
AS ANY PERMIT CONDITIONS CONTAINED IN PERMITS ISSUED BY THOSE UNITS
OF GOVERNMENT AND THEIR AGENCIES WITH REGULATORY JURISDICTION

HOURS OF OPERATION SHALL NOT EXCEED 7:00 AM THROUGH 6:00 PM,
MONDAY THROUGH SATURDAY.

ASPHALT PRODUCTION OF OF ALL ASPHALT MANUFACTURING PLANTS AND
EQUIPMENT AT THE SITE SHALL NOT EXCEED 60,000 TONS PER CALENDAR YEAR.
4.
ALL TRUCKS HAULING ASPHALT OR OTHER MATERIALS TO OR FROM THE SITE
SHALL COVER THE MATERIALS WITHIN THE TRUCK AT ALL TIMES AND TAILGATES
SHALL BE SECURED IN A CLOSED POSITION.
5.
THE PRODUCTION OF ASPHALT SHALL NOT GENERATE A SOUND LEVEL
GREATER THAN 75 DECIBELS AS MEASURED AT ANY POSITION ON THE
PROPERTY BOUNDARY.
A.) IF NOISE LEVELS EXCEED THE LEVELS OUTLINED ABOVE, OWNER
AGREES TO INSTALL OR CONSTRUCT ADDITIONAL NATURAL OR MAN
