Based on our review of your request and the recommendation of our Washington Regional Office, your request for rescission has been denied. Your request was denied because there are industrial materials remaining onsite, including piles of gravel and broken concrete. These materials must be removed before a rescission can be granted. You may resubmit a rescission request once the site has been cleared of the remaining materials. New Bern - 02202014 (1).pdf Julie, I visited the Barnhill Contraction asphalt facility in New Bern (NCG160002). There was no obvious activity on site. It looks vacant but material that was left on site is still there. After my first visit back in April of 2013 1 spoke to David Glover of Barnhill Contracting Co. and told him about piles of sand, gravel and broken concrete on site and that this material needs to be removed prior to us rescinding the permit. He said he will do it and inform me when the cleanup is complete. I did not hear from him again. My recommendation at this time is to deny the rescission. I have some pictures that I can e-mail to you if you need them, but they are about same as pictures taken in April of 2013. Attached is the inspection report for this site visit. The condition of the site is almost unchanged from the time of the original inspection which was performed on March 7, 2013. Some activities have been done but nothing that affects the rescission request. There are still some exposed containers (closed 5 gallons containers with paint and what appears to be the hydraulic oil as well as couple of closed barrels with unknown substances in them) Some of these containers are leaking the fluids. Some Paint containers are stored in small shed next to the main building but shad is in such bad shape that it does not provide any protection from the elements. At this time, my recommendation would be to deny the rescission request based on these findings. I'm attaching some pictures that I took yesterday. Please feel free to contact me if you have any questions. I will try to go to Barnhill's New Bern asphalt plant (NCG160002) sometimes next week and I will let you know about results. We had talked about the Republic Services site, and the last time you were there, the site was deserted but electricity was still on. You also mentioned there were some barrels there with unknown substance in them. Have these remaining items been cleared and would you recommend rescission? I just left you a message about one, then I came across a second one. Do you know the status of industrial activities at these facilities and if they can be recommended for rescission now? NCG160002 — Barnhill Contracting Company— New Bern Plant. They first requested rescission in December 2013. As of April 2013, you had said the site still had sand and gravel products that needed to be removed. NCG080784 — Republic Services of NC. They requested rescission in January 2013. According to their request, the facility closed in February 2011. Thank you for any information you have on these two facilities.
