This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage (COC) is not transferable except after notice to the Division of Energy, Mineral, and Land Resources. The Division may require modification or revocation and reissuance of the certificate of coverage. Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage to stream buffers, from portions of this site that have been constructed after July 22, 1997, must be discharged through a correctly designed level spreader or another device that meets diffuse flow requirements per 15A NCAC 2B .0233. Diffuse flow requirements are described in Chapter 8 of the North Carolina Stormwater BMP Manual, available at: http://portal.nedenr.ora/web/Ir/bmp-manual. Please note that NCG 140000 contains effluent limitations for process wastewater discharges (see Part IV, Section D). Wastewater discharges must meet the requirements of these effluent limitations. An exceedance of any of these limitations is a violation ofpermit conditions. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Energy, Mining, and Land Resources, or permits required by the Division of Water Resources, Coastal Area Management Act, or any other federal or local governmental permit that may be required. As a temporary feature, it should have a skimmer or alternate device to ensure a top discharge. As a permanent basin, it should be designed with a riser, etc. to ensure appropriate storage and stormwater processing. (2) The riparian buffer needs to be measured from the top of the streambank, and a properly designed level spreader or alternate device is needed to ensure diffuse flow into the buffer from the basin outlet. The facility consists of an infiltration basin, a five -chamber drum wash recycle system, drainage grass swales on both side of the property, a water hose area for washing off the outside of trucks, and a water detention pond designed to hold a 25-year, 24-hour rainfall event. He and his consulting engineer, Ron Sutton, had met with Ken Pickle in March, 2006 for a couple of hours with drawings, but had left without leaving any materials. So there was no NOI on file with the state. Nisely responded to the call with a visit to the site. Ken and Myrl both agree that it is a well designed plant, based upon and improving on the successful designs used in PLT plants in Wilson and Rocky Mount. Nonetheless, Mr. Proctor had run ahead of protocol by building without approval. Nisely has numerous pictures taken during this inspection.
