Dear Mr. Proctor:
I conducted the stormwater compliance evaluation inspection on August 21, 2008 with the assistance of Bill
Anderson. Please find attached with this letter the Basin Wide Information Management System (BIMS) checklist.
Below is a list of findings and recommendations developed from the inspection.
1. The current permit was issued and became effective January 16, 2008. The General Permit NCG140000 will
expire 07/31/2009. There is no requirement to submit a new Notice of Intent or renewal request unless directed
by the Division of Water Quality.
2. The facility consists of an infiltration basin, a five -chamber drum wash recycle system, drainage ditches, and a
water detention pond designed to hold a 25-year, 24-hour rainfall event. The facility is designed to not
discharge any process wastewater water. There has been no discharge from the facility.
3. Fuel and admixture tanks have secondary containment with locked gate valves. Water is visually inspected
before discharge. All excess water on the property is routed to the grass swells located on each side of the
property. Water in the swells is discharged to the water detention pond. The pond was approximately one -
quarter full. Excess concrete is poured into blocks or poured onto the ground. A large area between the pond
and the wash out bays is covered with stacks of broken concrete slabs. This combined with the poured concrete
on the ground has increased the amount of impervious surface area, which may increase stormwater flow and
cause the detention pond to overflow.
4. The water detention pond is constructed with an overflow pipe and emergency spill way. Analytical monitoring
is not required if the water detention pond discharges as a result of a 10-year— 24 hour precipitation event.
5. The Stormwater Pollution Prevention Plan (SPPP) was reviewed. The SPPP is well written and meet all
requirements with the exception of implementing and documenting annual employee training on proper spill
response and cleanup procedures and preventative measures. Site inspection was conducted 04/30/2007 and
11/13/2007. Inspection of all containment areas was last completed on 04/30/2008. Non-stormwater discharge
inspection was completed 05/31/2008. There was one significant spill noted on 04/16/2007.

Inspection Summary:
Facility consists of an infiltration basin, a five -chamber drum wash recycle system, drainage ditches, and a water
detention pond designed to hold a 25 year, 24-hour rainfall event. The facility is designed to not discharge any process
wastewater water. There has been no discharge from the facility. There are no analytical or qualitative reports to review.
A copy of the permit was available during the inspection. The Stormwater Pollution Prevention Plan has been
implemented and contains all permit requirements with the exception of implementing and documenting annual employee
training on proper spill response and cleanup procedures and preventative measures.
Site inspection was completed 04/30/2007 and 11/13/2007. Inspection of all containment areas was last completed
04/30/2008. Non-stormwater discharge inspection was completed 5/31/2008. There was one significant spill noted on
04/16/2007.

In accordance with your application'for a discharge permit received on July 16, 2006,
we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state - NPDES general permit. I apologize for the lengthy delay on my desk. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that the attached certificate of coverage is not transferable except
by action of the Division of Water Quality. The Division of Water Quality may require
modification or revocation and reissuance of the certificate of coverage. Coverage under
this permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit
that may be required.
This letter is also an Authorization to Construct recycle and infiltration treatment
facilities. We are aware that the infiltration basin has already been constructed per earlier
agreement. Please contact the Raleigh Regional Office, telephone number (919) 791-4200,
at least forty-eight (48) hours in advance of operation of the recycle system. If the recycle
system has also already been installed, please contact them this month so that an in -place
inspection can be made. Such notification to the regional supervisor shall be made during
the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday,
excluding State Holidays.
Please submit a certification from the designing professional engineer
certifying that the permitted facility has been installed in accordance with the
NPDES Permit, this Authorization to Construct, and the approved plans and
specifications. Please mail the certification (attached) to the Stormwater Permitting Unit,
1617 Mail Service Center, Raleigh, NC 27699-1617.
Please note that any future construction, installation, or modification of wastewater
treatment facilities (including process wastewater recycle systems) will require an
Authorization to Construct (ATC) prior to construction per 15A NCAC 2H .0138 & .0139. You
must submit, in triplicate, plans/specifications and design calculations, stamped and sealed
by a professional engineer, with a letter requesting an ATC to the Stormwater Permittingv°�nCarolina

Please note that a condition of issuance of coverage under this permit was your
agreement to sample all discharges quarterly for fecal coliform. Given the design basis and
configuration of your control facilities, it is likely that you will not have a discharge every
quarter. In the event that a calendar quarter passes without a discharge, please submit a
monitoring report with the notation, "No discharge this quarter", or words to that effect.
We still want to receive the monitoring report, even if you have not been able to take a
sample.,
One (1) set of approved plans and specifications is being forwarded to you. You are
required to maintain a copy of the approved plans and specifications on file for the life of

On July 13, 2006, Myrl Nisely from the Raleigh Regional Office (RRO) of the Division of
Water Quality (DWQ) conducted a site visit as part of a permitting and process review .
effort prior to the issuance of your industrial siormwater permit NCG 140000. During this
visit he observed an ongoing effort to construct process wastewater treatment units prior to
issuance by DWQ of the Certificate of Coverage and an Authorization to Construct for this
facility. This constitutes a violation of North Carolina General Statute 143-215.1 (a) (2)
which states the following:
143-215.1 (a) Activities for Which Permits Are Required - No person shall do any
of the following activities unless that person has received a permit from the
Commission and has complied with all conditions set forth in permit:
(2) Constructed or operate any sewer system, treatment works, or disposal system
within the State.
This Office requests that you respond to this letter in writing within 30 days of receipt of
this Notice. Your response should be sent to both this office at the letterhead address
and to the attention of Mr. Danny Smith at the Wetlands and Stormwater Branch,
Compliance and Assistance Unit, 1617 Mail Service Center, Raleigh NC, 27699-1617.
Your response should address the following:
• Please explain what mechanisms you will use in the future to ensure that all

In response to Four letter concerning case No. Nov-2006-CV-00I 1. 1 again must
apologize for failing to leave our "Notice of Intent" form with Mr. Ken Pickle during our
plan review meeting on March 27.2006.
During our long meeting. we discussed several areas of concern I'or both parties
and came to agreement on how our plans could be changed to satisfy everyone involved.
It still continues to be an embarrassment that after all the effort and time put I'Orth
Oil our Sclma. N.C. plant during this meeting. Both myself and our engineer felt the
meeting without giving Mr. Pickle our N.O.1 to construct the new plant.
I have included in this mailing, a copy ol'all communications concerning this
error on my part and assm'e yIou that this "will not" happen again. In fact, we've already
submitted an N.O.1 and the required plans and calculations for another new plant located
near %cbulon. N.C., which we hope to get started on its construction within the next 30
days.

This letter is to "sincerely apologize" for my forgetfidness and
stupidity in regards to the "notice of intent" paperwork that was not given to
you during our meeting at your office on March 30, 2006.
As you can see, I had sent a fax to ow- engineer, Ron Sutton on March
27, 2006 to review and address any concerns that he might have prior to our
meeting with you.
I am really embarrassed about the fact that I walked our without
leaving the N.O.I. with you and can'tjustify to you or myself why I did so.
After meeting with Mr. Niesley on Thursday and realizing what I had done, I
can't begin to tell you how sorry I am about this.
I can only ask that you please forgive my ignorance and hopefully,
after reviewing our package and the photos of our site design, you will allow
us to open our Selma Plant as planned, on June 24, 2007.
