In accordance with your application for discharge permit received on January 20, 2004, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding_
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act, or any other Federal or Local governmental permit that may be required.

On January 20, 2004, the Division of Water Quality (DWQ) received Lane's application for a
NPDES permit to discharge stormwater and treated wastewater from your temporary concrete
batch plant at the subject site. We spoke by phone on February 10, 2004, and subsequently
received additional information describing the wastewater treatment system on February 18,
2004. The submittals were deficient in several particulars, and we are requesting additional
information in order to continue processing your application. The specific deficiencies and our
requests for additional information are enumerated on the attached page. In our earlier
conversations you noted that timing is a critical concern for Lane. I am responding by fax in an
attempt to hasten the issuing of a permit.
In order to build and operate a wastewater treatment system and discharge wastewater or
stormwater at this site you must submit a sufficient permit application for review and approval
by the DWQ.
Discharge of wastewater or stormwater from this facility without coverage under a valid NPDES
permit would constitute a violation of NCGS 143-215.1.

a) Item 11). Note that the attachments provided in your submittal do not constitute a
Stormwater Pollution Prevention Plan (SPPP), contrary to your response to this item of the
NOI. The elements of a SPPP are identified in Part II, Section A of the general permit,
NCG140000. In your case, several of the identified elements would not apply, but a
separate SPPP document addressing the applicable portions will still be required by your
permit. The SPPP document does not have to be submitted to the DWQ, except upon
specific request from us.
b) Item 13). I direct your attention to the NOI, which says, in part, in item 13), "Give design
specifics (i.e. design volume, retention time, surface area, etc.)." The submittals do not
provide sufficient information to establish that the treatment system has a design basis
calculated to satisfy the permit limits. Please comply with the DWQ requirements stated on
the NOI.
c) Item 13) Note. This note requires that you submit three sets of plans and specs for the
treatment system, which requirement appears in15A NCAC 2H .0138 as cited. Please comply
with the state rules on wastewater treatment system submittals.
d) EXPLANATORY NOTE TO b) and c) ABOVE: The issuance of a certificate of coverage under
general permit NCG140000 is the state's authorization both to discharge a wastewater and
to construct a wastewater treatment system (called an Authorization to Construct). Because
we are approving construction, an engineering review of the proposed construction is
required of us.
Lane Construction's February 17, 2004_Narrative describing the treatment system
e) We have a comment similar to our comment in b) above. We note your report that the
proposed treatment system has worked successfully on other sites. However, there are no
treatment system engineering calculations provided that establish that the proposed system
is appropriately sized for the flows and limited parameters applicable at this site. Please
show calculations that predict that the proposed system will meet permit limits.
Sampling results from similar wastewaters and similar treatment designs would also be
helpful to us if you have those results available and can provide them to us.
Other comment
f) Have you considered whether or not the impounded wastewater will have an effect on
groundwater? And, if so, what provisions are included in the design to mitigate any effect?
General, summary comment
g) Generally we evaluate treatment system general permit applications on three elements: 1) a
characterization of the wastewater, 2) a quantification of the predicted treatment system
performance, and 3) a result that predicts compliance with the permit limits. We are
constrained from issuing a permit without this evidence by 15A NCAC 2H .0112 (c) which
provides that "The permit applicant has the burden of providing sufficient evidence to
reasonably ensure that the proposed system will comply with all applicable water quality
standards and requirements. No permit may be issued when the imposition of conditions
cannot reasonably ensure compliance with applicable water quality standards and
regulations..."

1. Your response (dated 2/24/04) to my 2/20/04 request for additional
information reached my desk this morning. The new submittal included an
expanded narrative description of the treatment system, a response to my
earlier question about groundwater impacts, revised sedimentation basin sizing,
newly provided dimensional information on the washout pit, newly provided
ditch profiles, revised configurations and revised dimensions on the spillways,
and newly provided supporting calculations for the hydraulic design. All
reflecting the establishment of a hydraulic design basis specific for this site.
2. However, your submittal was non -responsive with respect to my specific
requests for additional information as recorded in items b), e), and g) of my
2/20/04 letter. I'll try to clarify what I'm looking for. We are about to issue you
a permit which says that you can discharge stormwater and the other three
wastewaters from your operation into the waters of North Carolina under
General Permit NCG140000. That permit requires you to control the discharges
such that you do not exceed 30 mg/L TSS, 5 ml/L settleable solids, and the
range 6.0<pH<9.0 (see the General Permit, Part II pages 7, 9, and 10). You
are promising to treat the discharge so that you do not exceed these limits. I
can't issue you a permit until you provide engineering calculations that
substantiate your promise not to exceed those values. You must show me
defensible engineering calculations that show your treatment system will reduce
TSS to below 30 mg/L, that it will reduce settleable solids to below 5 ml/L, and
that it will maintain the pH of the discharge within the range of 6.0 — 9.0.
3. In summary, you have provided an adequate response on the hydraulic
design of the facility, but you have not provided an adequate response on the
design of the wastewater treatment capabilities of the proposed facility.
4. I understand that time is crucial for this project. If you think it would help, I
can be available to meet with you face-to-face next week. Presently I have no
other appointments on Monday, March 1, 2004. I do have a conference call on
Tuesday, at 1:00. I'm out of the office until 3:00 on Wednesday, 3/3/04.
