On February 16, 2011, I, Cheng Zhang of the Raleigh Regional Office (RRO) conducted a
Stormwater Compliance Evaluation Inspection at your facility. Your assistance was greatly
appreciated. The inspection report is attached. Findings during the inspection were as follows:
Certificate of Coverage (COC) No. NCGI 140333 ofNPDES general permit
NCG140000 was issued to Johnson's Block & Concrete Co Inc to discharge
stormwater runoff and process water to an unnamed tributary of Nutbush Creek in the
Roanoke River Basin.
2. The facility has developed a Stormwater Pollution Prevention Plan (SPPP). A review
of the plan indicated that it covered all components required by the general permit
with the following exceptions:
• Employee training has not been conducted and documented since 2003. All
employees should receiving training at a minimum on an annual basis on
proper spill response and cleanup procedures and preventative
maintenance activities. Training events should be documented.
• The SPPP should be reviewed and updated annually and a log should be
maintained to document SPPP review and update.
Qualitative monitoring was conducted at all outfalls as required. Annual analytical
monitoring results were available for review. It was noted that pH was not measured
on site within fifteen minutes of sampling, the contract laboratory measured pH after
receiving the samples; however, these pH readings were invalid because samples were
out of the holding time. Settleable solids should be analyzed at Outfall 001 and
002, because effluents at both locations are associated with process water.

4. The facility did not receive the Certificate of Coverage which was issued by the
Division on August 1, 2009. A copy of the current General Permit was downloaded
and saved on the permittee's computer.
5. All three outfalls were observed during the inspection and were in good condition.

pH has not been analyzed on site within 15 minutes of sampling , the contract lab
measure pH after samples were sent to the lab by the permittee, these pH readings are
invalid. Settleable solids should be analyzed at outfall 001 and 002, because process
water and stormwater are combined and discharged at outfall 001. Process water (drum
cleaning) overflows at outfall 002 when influent produced by precipitation events
exceeds the capacity of the pond.

Dear Mr. Schuster:
I am writing on behalf of Greystone Concrete Products, Inc. ("Greystone") in response to
your December 29, 2004 Notice of Violation/Notice of Intent to Enforce letter sent to Mr.
Cannady. I spoke with Mr. Nisely on January 6, 2005, and he indicated that it was acceptable for
Greystone to respond to your letter on or before January 14, 2005.
Greystone is in the process of reviewing its available data, and intends to hire a
consultant to assist in determining what economically feasible options may exist for Greystone to
implement to help ensure that it maintains compliance with its General Permit to discharge
stormwater/process wastewater.
We understand that the Department of Environment and Natural Resources ("DENR")
has recently sent similar Notice of Violation letters to several permittees in the concrete industry,

of which Greystone is a member, hope to meet next month with Alan Klimek and/or other
DENR representatives to discuss this situation.

enforcement action against Greystone until Greystone has had additional time to review this
matter, and until after any scheduled meeting between DENR and Association representatives.
Greystone intends to provide you with an additional response by the end of February 2005.

That meeting is being scheduled for several weeks from now. Therefore, we request that you
proceed with the Greystone enforcement responses as would be done in the normal course of
events. No enforcement will be issued until after the discussions between Mr. Klimek and the
Association.

On April 21, 2003 Mr. Myrl Nisely of the Raleigh Regional office of Division of Water Quality
met with you to make a compliance inspection of the Greystone Concrete Plant in Henderson.
Your help was greatly appreciated. Attached is an inspection checklist. Findings were as
follows:
The Stormwater Pollution Prevention Plan (SP3) had been professionally revised in January
2003 and contained all the required topics. However, as you readily admitted at the beginning of
the inspection, no action has been taken so far to carry out the program. Stonmwater permits for
ready mix concrete plants have been in effect since 1994. The present version of the permit was
issued in 1999 and provided a two year grace period for programs details to be put into place.
Therefore, your manual should have already contained documentation for at least the years 2001
and 2002. The failure to cant' out the program details below is the reason for this letter being a
NOV. Enforcement fines may also be imposed.

This office is considering recommending to the Director of the Division of Water Quality that
civil penalties be assessed against your company for these violations. NCGS 143-215.6 provides
that violations of 143-215.1 may incur civil penalties up to $25,000 per violation per day. Any
response submitted to this office within 10 days of receipt of this letter will be considered when
making the recommendation.
A system of checkdams and a vegetated channel appear likely to help reduce the impact of water
released from the drum wash pit. However, no evaluation of the engineered features for
handling stonrnwater at the facility was carried out. Mr. Nisely was unable to measure pH that
day when the meter failed to calibrate properly. In addition to annual sampling, all discharge
points need to be checked occasionally to be certain they meet the parameter limits in the permit.
The settling pond at the South end of the property should be maintained to drain well. It may
now reach a level high enough to force water back into the plant during a heavy rain. Please
contact the Railroad in an effort to gain improvements.
As suggested in the checklist, specific action steps need to be taken to provide a plan of attack.
These should include use of a calendar to establish inspections, contact with a commercial
laboratory to contract for tests to be run. They will supply bottles and give guidance on how
samples are to be preserved and shipped. Tip: some concrete plants place a chart of what is to be
done monthly, quarterly, semi-annually and annually under the front cover of their manual, then
fill in dates when the actions are accomplished.
By May 30. 2003, submit to the Raleigh Regional Office a plan for accomplishing the tasks
required by the permit.

In accordance with your application for discharge permit received on November 14, 2002, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement
between North Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess concrete or
washes excess concrete into storm sewers or waters of the state will be operating in direct violation to both the terms of
this permit and the North Carolina General Statutes. Such a discharge shall be considered an illegal discharge and may
subject the owner to enforcement actions in accordance with North Carolina General Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastaf Area Management Act or any other
Federal or Local governmental permit that may be required.

On January 21, 2003 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality met with you to
become familiar with your readymix concrete facility and to offer assistance in establishing a stormwater program
that will conform to General Permit No. 140000. Your assistance was greatly appreciated. The permit being
established is Permit No. NCG140333. The following observations were made:
1. This plant site is a large complex with the main process area on the north side of Garland St, with an office
building, a truck loading station, a vehicle maintenance building, and sand and aggregate storage. Admixture
storage tanks stand behind the office building. Across Garland St. is a concrete pad with sand storage and a
parking area. Across Hwy 39 is a building for new hydraulic and motor oil storage, a fuel storage area with
secondary containment and a large area used to discard unused concrete and drum washings.
2. There is no secondary containment for the admixture tanks. Please construct containment as described in
40CFR 264.175 and/or any other applicable Federal, State or local requirements, with enough volume
available to hold the contents of the largest single tank plus water from a 25-year, 24-hour storm event
(about 7" of rain in this area). You indicated that construction could be done by March 31, weather allowing.
The stormwater program calls for a visual observation to be made and recorded on a checklist before each
release of water from the containment area.
3. The topography slopes mostly toward Garland St., except for truck washing which is done in front of the
Vehicle Maintenance building on Hwy 39. Vehicle wash water drains toward Hwy 39, entering a city
stormdrain on the west side of the highway. Vehicle wash water will be one of your sample points. Runoff to
Garland St. drops into a grated drain, then under Garland St. to another larger drain serving the large paved
parking and sand storage pile, then continues underground via two pipes to a discharge point at the edge of the
property. This swale or small tributary flows for about one half mile to Sandy Creek that empties into Roland's
Pond. Sampling will be required where the two pipes exit the property.
4. The disposal area west of Hwy 39 is quite large. Drainage on top of the site appears to be nearly flat (not
draining) and in other places the slope is toward the highway. Runoff depends upon where the truck is when
draining the drum. The solids disposal area extends South behind other properties not owned by Johnson Block
and Concrete. Unused concrete is dumped onto the ground, then later picked up and stacked. Piles of broken
concrete, asphalt and small quantities of miscellaneous trash line'the edges of the site. Historically there has
been runoff from the back side of the site into a broad ditch-6etween the site and a trailer park.
5. Even though drum washings are discharged at the top"of the historic disposal pile, any such disposal can
potentially reach groundwater. Please be aware that Groundwater Standards apply, and contamination d'h

needs to be avoided. Excavated pits are a similar concern.
6. Housekeeping in the process area was good. In the disposal area on Hwy 39, trash bags dumped by citizens
and other non -concrete related items should be removed to a proper landfill.
7. Vehicle maintenance is done in the building facing Hwy 39. All work is done inside. Waste oil is collected in
a drum behind the building for periodic disposal by Noble Oil. The only discharge from this shop is an
occasional washing of the floor with a steam jenny. This flow goes to the stormdrain on Hwy39 much like the
vehicle wash water described above. See the section on Vehicle Maintenance for sampling requirements.
You went through the permit section by section with Mr. Nisely to understand how to put together a SPPP manual
and how to implement the program. Enclosed is a guidance manual with more detail. You may find it helpful to

Please submit certification to the Division by March 31, 2003 that the admixture secondary containment has
been installed.
Once your manual is developed, send to the Raleigh Regional Office copies of the site map (Part II(A)(1)(a)),
the narrative description of storage practices et al (Part H(A)(l)(b)) and the BMP summary (Part
Il(A)(2)(b)).
After this program is established, any future additions or changes in the stormwater system must be done via an
Authorization to Construct permit from the State.

It has come to the attention of the North Carolina Division of Water Quality that Johnson's Block &
Concrete Co. has not obtained a Stormwater Permit for the site on Highway 39 in Henderson.
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act (1972) and then delegated to the Division of Water Quality for implementation
in North Carolina. The NPDES Phase I permitting program for stormwater discharges was established
in 1990. Phasel focused on site and operations planning to reduce pollutant sources. One of the
industries that Phase 1 regulates through NPDES permits is Ready Mix Concrete production, SIC Code

The discharge of stormwater from a Ready Mix site to waters of the State without a permit is a
violation of NCGS 143-215. 1 (a)(1). This office is considering recommending to the Director of the
Division of Water Quality that civil penalties be assessed against your company for these violations.
NCGS 143-215.6 provides that violations of 143-215.1 may incur civil penalties up to $25,000 per
violation per day. Any response submitted to this office within 10 days of receipt of this letter will be
considered when making the recommendation.

Stopped to do a CEI at this plant with Sam Cannady, but he had gone home ill in the AM.
I drove through the plant in a heavy downpour, entering a driveway distant from the
office. The plant has two section, a concrete production plant and a products plant
containing many ordinary building blocks. My drive wound through both. The large
yard area is entirely fine silt material, and the runoff into ditches within the plant was
heavily loaded with silt, extremely turbid.
When performing the CEI, special effort should be taken to trace all paths taken by
rainwater to see what settling or filtration via vegetation is provided. What is water
quality when it reaches waters of the State? And, of course, look into all the usual
concrete questions common to these plants.

permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless
such demand is made, this certificate of coverage shall be final and binding.

Johnson's Block and Concrete has not previously applied for a stormwater permit. A visit
was made to obtain site information and to offer technical assistance to Curtis Johnson,
Owner, regarding how to establish a stormwater management plan.
This sprawling, complex location is on both sides of two streets, Garland St. and Highway
39. The main process area is on the north side of Garland St, with an office building, a truck
loading station, a vehicle maintenance building, and sand and aggregate storage, Admixture
storage tanks stand behind the office building. Across Garland St. is a concrete pad with
sand storage and a parking area. Facing Hwy 39 is the Vehicle Maintenance building, and
across Hwy 39 is a building for new hydraulic and motor oil storage, a fuel storage area with
secondary containment and a large area used to discard unused concrete and drum washings.
The topography slopes mostly toward Garland St., except for truck washing which is done in
front of the Vehicle Maintenance building on Hwy 39. Vehicle wash water drains toward
Hwy 39, entering a city stormdrain after crossing to the west side of the highway. Runoff to
Garland St. from the main processing area drops into a grated drain, then under Garland St.
to another larger drain serving the large paved parking and sand storage pile, then continues
underground via two pipes to a discharge into a swale at the edge of the property. This
swale or small tributary flows for about one half mile to Sandy Creek that empties into
Roland's Pond and ultimately into the Tar River.
Vehicle maintenance is done in a building at the corner of Garland and Hwy 39. There are
no drains inside the building. The floor is occasionally cleaned using a steam jenny, with
any flow going to the highway gutter and the city stormdrain.
The disposal area west of Hwy 39 is huge. This disposal area extends behind other
properties not owned by Johnson Block and Concrete. Drum washouts are released here.
Drainage appears to be mostly flat (not draining) except where portions of the highway side
slope toward the highway. Unused concrete is dumped onto the ground, then later picked up
and stacked. Piles of broken concrete, asphalt and small quantities of miscellaneous trash
line the edges of the site. Historically there has been runoff from the back side of the site
into a broad ditch between the site and a trailer park.
There was no secondary containment for the admixture chemicals. Need for this ASAP was
emphasized. A date of March 31 was agreed upon, weather permitting.
Housekeeping in the process area on Garland St. was good. In the disposal area on Hwy 39,
trash bags dumped by citizens and other non -concrete related items need to be removed to a
proper landfill.
Mr. Johnson and I went through the permit section by section to discuss how to put together
a SPPP manual and how to implement the program. He seemed cooperative, but does not
use the internet and asked for help in locating a laboratory and a consultant. The latter will
be a big plus in helping establish this stormwater program. I hope the owner chooses to go
to that expense.

On January 21, 2003 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality met
with you to become familiar with your readymix concrete f V''}�ty and to offer assistance in establishing a
stormwater program that will conform to General Permit No. i40000. Your assistance was greatly
appreciated. The following observations were made:
This plant site is a large complex with the main process area on the north side of Garland St, with an
office building, a truck loading station, a vehicle maintenance building, and sand and aggregate
storage. Admixture storage tanks stand behind the office building. Across Garland St. is a concrete
pad with sand storage and a parking area. Across Hwy 39 is a building for new hydraulic and motor
oil storage, a fuel storage area with secondary containment and a large area used to discard unused
concrete and drum washing.
2. There is no secondary containment for the admixture tanks. Please construct containment walls
with enough volume available to hold the contents of the largest chemical vat. Install a drain
with a valve. The valve is to be kept locked or have the handle removed, so that only authorized
personnel can drain the containment basin. You indicated that construction could be done by
March 31, weather allowing. The stormwater program calls for a visual observation to be made and
recorded on a checklist before each release of water from the containment area.
3. The topography slopes mostly toward Garland St., except for truck washing which is done in front of
the Vehicle Maintenance building on Hwy 39. Vehicle wash water drains toward Hwy 39, entering a
city stormdrain on the west side of the highway. Vehicle wash water will be one of your sample
points. Runoff to Garland St. drops into a grated drain, then under Garland St. to another larger drain

those neighbors in this stormwater program. Otherwise, liability for stormwater discharges onto their
property may become an issue.
5. Housekeeping in the process area was good. In the disposal area on Hwy 39, trash bags dumped by
citizens and other non -concrete related items should be removed to a proper landfill.
6. Vehicle maintenance is done in the building facing Hwy 39. All work is done inside. Waste oil is
collected in a drum behind the building for periodic disposal by Noble Oil. The only discharge from
this shop is an occasional washing of the Floor with a steam jenny. This flow goes to the stormdrain
on Hwy39 much like the vehicle wash water described above.
You went through the permit section by section with Mr. Nisely to understand how to put together a SPPP
manual and how to implement the program. You may find it helpful to ask someone such as a public
librarian to go onto Internet site http://h2o.enr.state.ne.us/su/stormwater htniI where guidance manuals
may be found for developing your SPPP manual. Click on Manuals, Factsheets.
The Division is prohibited from providing a list of environmental consultants. Your Yellow Pages may
list several, but if not, see the Raleigh Yellow Pages under Engineers — Environmental for many in the

Whether or not you actually receive the stormwater permit by March 31, 2003, please submit
certification to the Division by that date that the admixture secondary containment has been
installed, with a drain and locked valve.
Once a site map has been created, please submit a copy to the Raleigh Regional Office.
