Dear Mr. Nisely:
In response to your letter dated October 15 2010, we offer the following:
A stormwater permit training session was held on October 26 2010. The workshop was attended
by all production personnel; the workshop agenda is attached.
Quantitative monitoring was conducted on February 9 2010. Both the laboratory analysis report
and the completed NCDFNR Discharge Outfall Monitoring Report form are tiled in Appendix F
of the SWPPP notebook. All required copies were submitted to Central Files in February;
additional copies are attached for your review.
General Permit NCG140000 does not require semi-annual quantitative monitoring. It does
require semi-annual qualitative monitoring which has been completed at the subject facility by
this consultant.
The next quantitative monitoring event will occur during the first quarter of 2011 as suggested
by the extended General Permit NCG140000.

In regards to your NOV letter dated December 29, 2004, I believe an error has been made by
NCDENR-DWQ. Your letter indicates that the limit violation was of a Process Wastewater
Discharge:
Powell Ready Mixed Concrete does not generate nor discharge Process Wastewater at this site.
The discharge monitoring report form submitted to NCDENR-DWQ (see attached copy) is for a
stormwater discharge sample.
According to NPDES General Permit NCG140000 Part 11 Section B.1. Table 2, the TSS cut-off
limit is 100 mg/L for stormwater discharges. The Permittee understands that the cut-off limit is
not a not -to -exceed -limit, and therefore cannot be violated. The cut-off value provides guidance
in accessing the effectiveness of implemented BMPs and the need to improve certain BMPs.
The Permittee will collect a stormwater discharge sample during Calendar Year 2005 as required
by the Permit, and will continue to implement appropriate TSS-reducing BMPs.
We request that NCDENR-DWQ withdraw this Notice of Violation as no violation has occurred.
