needed by December 31. The same appears to be true for Quantitative sampling. No
2010 sampling data was located, although Qualitative observations had been made on
8/19/2010.

Comment: Employee training has been planned with the consulting firm for at least the
last two years, but has not been accomplished. Mr. Powell commented that his 4
employees and he discuss spill response and stormwater concerns. If so, one of these
sessions is to be documented and placed in the stormwater manual. The training does
not necessarily have to involve the consultant, but if that is desired, there is time yet in
2010 to give the training to satisfy the requirement for this year.

I conducted the Stormwater compliance evaluation inspection on July 08, 2008. Your cooperation and assistance
with this inspection was appreciated. Please find attached with this letter the Basin Wide Information Management
System (BIMS) checklist. Below is a list of findings and recommendations developed from the inspection.
1. The current permit was reissued 08/01/2004 and expires 07/31/2009. Please request permit renewal no later than
180 days prior to permit expiration to avoid enforcement action.
2. Fuel and admixture tanks have secondary containment. The facility does not have a wash out basin for concrete
truck washings. Left over concrete is formed into blocks or septic tank molds. Wash water left over in the mixer
is added as make up water to the next batch of concrete. In the event that wash water is not used for make up
water, the water is discharged on the gravel parking lot. The drainage area for the facility is 84,000 square feet
with 30% impervious. It appears that the discharged water would soak into the ground before reaching any
drainage ditch.
3. Stormwater Discharge Outfall (SDO) 001 is located near the intersection of NC Highway 48 and Rhea -Smith
Road (NC State Road 1433). Samples are taken in the drainage ditch next to the conduit that is under Rhea -
Smith Road. There was no discharge at the time of inspection.
4. The Stormwater Pollution Prevention Plan (SPPP) was reviewed. The SPPP is well written and meet all
requirements and contained all necessary components. The plan is review annually. Recommendations for site
improvements are made but do not get implemented immediately. Annual training of employees on emergency
clean up is not documented. Above Ground Storage Tanks in the secondary containment area need to be
labeled. James D. Frei performs qualitative and analytical monitoring. All Chain of Custodies sheets were
property filled out. A review of the analytical monitoring indicated Total Suspended Solids (TSS) above the
cut-off concentration for TSS. Please review your Best Management Practices (BMPs) to lower TSS values
during sampling. Silt fencing may help in preventing excess runoff of sediment.

On January 21, 2003 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality met with you to
become familiar with your readymix concrete facility and to offer assistance in establishing a stormwater program
that will conform to General Permit No. 140000. Your assistance was greatly appreciated. The permit being
established is Permit No. 140332. The following observations were made:
1. This plant site is a compact fenced area with an office building, a truck loading station, a vehicle maintenance
building, sand and aggregate storage, a large fuel oil tank farm with containment, a parking area for trucks
behind the office and several forms around the perimeter for casting septic tanks and other concrete structures.
Admixture storage tanks stand behind the office building.
2. The topography slopes mostly toward the corner at SR1433 and Hwy 48, except for the truck parking which
drains toward SR1433. Runoff travels through a vegetated Swale to Hwy 48, through a culvert under SR1433,
then another culvert under Hwy 48 and through a swale to join with a church parking lot drain, ultimately to
Little Quankey Creek.
3. There is no secondary containment for the admixture tanks. Please construct secondary containment as
described in 40CFR 264.175 and/or any other applicable Federal, State or local requirements, with
enough volume available to hold the contents of the largest single tank plus water from a 25-year, 24-
hour storm event (7" of rain). You indicated that construction could be done by March 31, weather allowing.
The stormwater program calls for a visual observation to be made and recorded on a checklist before each
release of water from the containment area.
4. Unused concrete is not dumped onto the ground, nor are the drums washed except for exceptionally long
periods of inactivity. Chemicals are added to the drums overnight so the unused material can be incorporated
into new concrete the next day. You stated that this can be done even over a three day weekend. The
occasional (rare) washes are discharged wherever the truck is in the yard. For the most part, this site can be
expected to avoid high pH discharges usually associated with readymix plants. However, thought should be
given to specifying a definite location for drum washouts, probably one where the flow (potentially carried by
rainwater) can travel out the secondary gate to the swale where it will have a maximum distance to travel
before entering the conduit under SR1433.

5. Housekeeping in the process area was acceptable, although the fenceline contained metal items, tires and
miscellaneous debris. Housekeeping inspections will be part of the stormwater program, as well.
6. Vehicle maintenance is done in part of the building facing Hwy 48. All work is done inside. An old oil pit
exists in the building but is covered and not used. Spills are cleaned up with Dri-Rite and the floor is not
washed down. Waste oil is burned in a space heater. It appears that no discharge occurs from this shop.
7. The site map submitted with your permit application is inadequate. Be sure the one prepared for the SPPP is a
layout of the plant site, showing buildings, storage areas and other details requested in the permit.
You went through the permit section by section with Mr. Nisely to understand how to put together a SPPP manual
and how to implement the program. You may find it helpful to go onto Internet site
http://h2o.enr.state.nc.us/su/stormwater.html where guidance manuals may be found for developing your SPPP
manual. Click on Manuals, Factsheets. Once the manual is developed, send to the Raleigh Regional Office
copies of the site map (Part II(A)(1)(c)), the narrative description of storage practices et al (Part H(A)(1)(b))
and the BMP summary (Part II(A)(2)(b)).
Please submit certification to the Division by March 31, 2003 that the admixture secondary containment has
been installed.
Once this program is established, any future additions or changes in the stormwater system must be done via an
Authorization to Construct permit from the State.

In accordance with your application for discharge permit received on October 21, 2002, we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement
between North Carolina and the US Environmental Protection agency dated December 6; 19831
The stormwater permit you are receiving, NCG140060, does riot permit wasting concrete, dumping excess
concrete, directly into storm se'Ner outfalls or into waters of the state. Any facility which either dumps excess concrete or
washes excess concrete into storm sewers or waters of the state will be operating in direct violation to both the terms of
this permit and the North Carolina General Statutes. Such a discharge shall be considered an illegal discharge and may
subject the owner to enforcement actions in accordance with North Carolina General Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this certificate of coverage shall be final and bindinif.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

It has come to the attention of the North Carolina Division of Water Quality that Powell's Ready -Mix
has not obtained a Stormwater Permit for the site at on Highway 48S in Roanoke Rapids.
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act (1972) and then delegated to the Division of Water Quality for implementation
in North Carolina. The NPDES Phase I permitting program for stormwater discharges was established
in 1990. Phase] focused on site and operations planning to reduce pollutant sources. One of the
industries that Phasel regulates through NPDES permits is Ready Mix Concrete production, SIC Code
3273. A General Permit (No. NCG14000) became effective August 1, 1994. This permit was renewed
and somewhat revised in 1999. In that version, a two year grace period was established to allow sites
time to comply with the permit requirements.
The discharge of stormwater from a Ready Mix site to waters of the State without a permit is a
violation of NCGS 143-215.1(a)(1). This office is considering recommending to the Director of the
Division of Water Quality that civil penalties be assessed against your company for these violations.
NCGS 143-215.6 provides that violations of 143-215.1 may incur civil penalties up to $25,000 per
violation per day. Any response submitted to this office within 10 days of receipt of this letter will be
considered when making the recommendation.

Powell's Ready Mix has not previously applied for a stormwater permit. A visit was made
to obtain site information and to offer technical assistance to Allie Powell III, Owner,
regarding how to establish a stormwater management plan.
This compact location slopes mostly toward the comer at SR1433 and Hwy 48, except for
truck parking which drains toward SR1433. Runoff travels through a vegetated swale to
Hwy 48, through a culvert under SR 1433, then another culvert under Hwy 48 and through a
swale to join with a church parking lot drain, ultimately to Little Quankey Creek. See
diagram below. More than likely only one sample point will be selected, at the comer of 48
and SR 1433.
Vehicle maintenance is done onsite in a building for that purpose. There are no drains inside
the building. The floor is swept, and Dri-Rite absorbent is placed on oil spills. No
monitoring related to these activities will be needed.

Unused concrete is not dumped onto the ground, nor are the drums washed except for
exceptionally long periods of inactivity. Chemicals are added to the drums overnight so the
unused material can be incorporated into new concrete the next day. This can be done even
over a three-day weekend. The occasional (rare) washes are discharged wherever the truck
is in the yard. For the most part, this site can be expected to avoid high pH discharges
usually associated with readymix plants. However, thought should be given to specifying a
definite location for drum washouts, probably one where the flow (potentially carried by
rainwater) can travel out the secondary gate to the Swale where it will have a maximum
distance to travel before enterine the conduit under SR1433.
The only major problem observed was a lack of secondary containment for the admixture
chemicals. Need for this ASAP was emphasized. A date of March 31 was agreed upon,
weather permitting.
Housekeeping in the process area was acceptable, although the fenceline contained metal
items, tires and miscellaneous debris. The site appeared less junky from the inside than from
a first impression taken from driving around the outside.
Mr. Powell and I went through the permit rather quickly section by section to discuss how to
put together a SPPP manual and how to implement the program. He seemed cooperative,
but may need help actually setting up his program.

On January 21, 20031Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality met with
you to become familiar with your readymix concrete facility to offer assistance in establishing a
stormwater program that will conform to General Permit No0000. Your assistance was greatly
appreciated. The following observations were made:
1. This plant site is a compact fenced area with an office building, a truck loading station, a vehicle
maintenance building, sand and aggregate storage, a large fuel oil tank farm with containment, a
parking area for trucks behind the office and several forms around the perimeter for casting septic
tanks and other concrete structures. Admixture storage tanks stand behind the office building.
2. The topography slopes mostly toward the corner at SR1433 and Hwy 48, except for the truck parking
which drains toward SR1433. Runoff travels through a vegetated Swale to Hwy 48, through a culvert
under SR1433, then another culvert under Hwy 48 and through a Swale to join with a church parking
lot drain, ultimately to Little Quankey Creek.
3. There is no secondary containment for the admixture tanks. Please construct containment walls
with enough volume available to hold the contents of the largest chemical vat. Install a drain
with a valve. The valve is to be kept locked or have the handle removed, so that only
authorized personnel can drain the containment basin. You indicated that construction could be
done by March 31, weather allowing. The stormwater program calls for a visual observation to be
made and recorded on a checklist before each release of water from the containment area.
4. Unused concrete is not dumped onto the ground, nor are the drums washed except for exceptionally

well.
6. Vehicle maintenance is done in part of the building facing Hwy 48. All work is done inside. An old oil
pit exists in the building but is covered and not used. Spills are cleaned up with Dri-Rite and the floor
is not washed down. Waste oil is burned in a space heater. It appears that no discharge occurs from
this shop.
7. The site map submitted with your permit application is inadequate. Be sure the one prepared for the
SPPP is a layout of the plant site, showing buildings, storage areas and other details requested in the
permit.
You went through the permit section by section with Mr. Nisely to understand how to put together a
SPPP manual and how to implement the program. You may find it helpful to go onto Internet site
http://h2o.enr.state.nc.us/su/stormwater.html where guidance manuals may be found for developing your
SPPP manual. Click on Manuals, Factsheets.
Whether or not you actually receive the stormwater permit by March 31, 2003, please submit
certification to the Division by that date that the admixture secondary containment has been
installed, with a drain and locked valve.
