On June 4, 2008, Ms. Stephanie Brixey of the Raleigh Regional Office conducted a stormwater evaluation
inspection of S.T. Wooten Corporation's Ready Mix Concrete Facilities on Fortune Way and Beryl Rd in Wake
County with the assistance of Mr. James Washburn, safety associate of the facilities. His help was appreciated
as it eased the inspection process.
The following observations were made:
An inspection of the Fortune Way facility's (NCG140235) stormwater permit was conducted. The site
currently has one outfall that has not discharged since 2004. The process water and stormwater flow to the
cement pits. Water enters into the first treatment pit and flows through the series to filter out solids. Once it
enters the next to the last pit it is then pumped through a swimming pool filter and released into the last pit. The
facility recycles this water back into the process. The backwash is pumped to the first treatment pit. Currently
there is a lot of work being done on this site. Some stormwater will flow to the back of the property and pond.
There is one outfall from this area but no sign that a discharge has occurred. Due to the fact that the facility has
not discharged any water from the site since 2004, there is no qualitative and/or analytical monitoring since that
time.
An inspection of the Beryl Rd facility's (NCG 140233) stormwater permit was conducted. The site has no
outfall because all of the process wastewater and stormwater is recycled to the plant. The process water and
stormwater flow to the cement treatment pits. Water enters into the first pit and flows through the series to filter
out solids. Once it enters the next to the last pit it is then pumped through a swimming pool filter and released
into the last pit. The facility recycles this water back into the process. The backwash is pumped to the first
treatment pit. A letter is mailed annually to Central Files stating that all stormwater has been contained.
Qualitative and/or analytical monitoring has not been conducted because there has not been a discharge.
All components of the Stormwater Pollution Prevention Plan were present including: detailed site maps with
labeled storm outfalls, a list of potential contaminants, a spill and response plan, a narrative describing BMPs,

and a contact list of whom to contact in an emergency. Employee training records were on -site. Both facilities
inspect containment areas, storage tanks, and valves and piping on a monthly basis. Both facilities maintain
good house keeping practices. The files are kept in a well organized fashioned. Such order eased the file
review process.
The overall conditions of S.T. Wooten's stormwater programs at the Fortune Way and Beryl Road facilities are

The Division of Water Quality (DWQ) received your request to construct stormwater and
wastewater controls at the subject facility on April 12, 2006, and again with revisions on June 6,
2006, and September 27, 2006. In accordance with your request, you are authorized to construct
the approved control facilities, effective today.
Authorization is hereby granted for the construction and installation of a batch plant wash water
swale, a small holding pond, a transfer pump and piping, a truck wash area, a conveyance system
for the truck wash water, a concrete recycle system, an earthen berm and large settling pond, a
portable pH treatment system, and a large settling pond discharge structure, all in accordance
with the approved site drawing, equipment specifications, and design calculations.
You must notify DWQ's Raleigh Regional Office supervisor, telephone number (919) 791-4200, at
least 48 hours in advance of operation of the installed facilities so that regional office staff can
conduct an in -place inspection prior to operation. Such notification to the regional supervisor shall
be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through
Friday, excluding state holidays.

Upon completion of construction and prior to operation of the authorized controls, you must
submit a certification from a professional engineer certifying that the controls have been
constructed and installed in accordance with the NPDES permit requirements in NCG140000, the

On February I, 2005 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality made
an inspection of the above facility for stormwater permit compliance. The help of Mr. Donovan Egerton
was greatly appreciated. Two days later, 2/3/2005, Myrl and I met with you at the site to evaluate
compliance problems identified by the inspection.
The inspection checklist used is attached. Observations were as follows:
In general, the stormwater documentation reflected a well planned program , but activities on -site
show little effort to actively protect the environment.
2. Drum washings have been allowed to freely flow downhill overfilling bermed containment structures.
The flows have spread through the chain link fence onto adjoining property. Water leaving the
containment was measured in several locations and ranged from 12.4 to 12.7 pH. The permit requires
any discharges released to meet the permit limit of 6 to 9 pH.
3. Data from annual sampling for 2004 showed pH=10.1 and TSS=106 mg/I, both exceeding the permit
limits.
4. We discussed the likelihood that employee training, though documented, has not accomplished the
desired understandings and commitment needed for environmental protection. In other words, drivers
willing to continue dumping drum washings into the uncontained "mess" that existed during this
inspection failed to take any ownership of Best Management Practices. There was no initiative taken
to question the wisdom of ongoing practices, and apparently no awareness of pH levels, permit limits
or other concepts within the program that call for changes in operating practices. What is needed is a
cultural change at each site that results in "buy -in" to environmental stewardship.
You stated plans for immediately cleaning up the area at the bottom of the hill in order to put the
containments back in shape. The runoff from any of the parts of the bermed and ponded areas needs to be
attenuated to pH of 6 to 9. Further, you mentioned plans at some unspecified date to build a multi -cell
concrete recycle structure to begin reusing water. DWQ recommends that you retain a professional
engineer for the amrooriate design. ��sn

In a meeting Myrl had with you and Mr. Phil Adams on May 6, 2003 at the Wilson facility, you had
recently become responsible for Wooten's environmental programs. Wooten had made a commitment to
review all Wooten facilities and undertake significant improvements. Inspections since then have shown
progress at many locations, but it is rather dismaying to realize almost two years later that conditions
could be so out of control as we all observed on 2/3. Promises have long been made throughout the ready
mixed industry that compliance will be achieved, yet there are still permit violations occurring with great
frequency.
The Division intends to enforce for the unsatisfactory conditions revealed by this inspection. You may
respond in writing within 10 days from receipt of this letter to provide information to be
considered in this enforcement proceeding.

have overfilled any intended containment structures, running through the fence onto neighboring

hopefully give an explanation as to why I do not have the others.
NCG 140248 This is a Builders Firstsource plant and is not a part of S.T. Wooten.
NCG 140120 This plant is in Henderson, we do not have any material at this location
(ie. Cement, Ash, Stone, Sand or Chemicals,) this plant was closed in
1994 or 1995, and has not had any activity to effect Storm Water. I wil:
send a letter by July 30, to DWQ, Central Files.
NCG 140233 This plant we feel is Sheet Flow, and all Storm Water that is on site is held
by our pit system. A letter will also be sent to DWQ on this as well.
NCG 140269, NCG 140294 Were Builders Firstsource plants and S.T. Wooten has
purchased them. The Sampling will be included in this letter.
NCG 140121 This plant and property did not have Storm Water run off in 2002, but a
letter was not sent to DWQ. 14� 3S

In accordance with your application for a stormwater discharge permit received on June 3, 1996, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
The stormwater permit you are receiving, NCG 140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless
such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of
Environmental Management. The Division of Environmental Management may require modification or revocation
and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
