In your absence, Mr. Danny Dean provided helpful assistance. The Stormwater Pollution Prevention Plan (SP3) was not located that day. On July 2 Mr. Nisely and I returned to review the SP3 and to further investigate concerns. We also carried out a mine stormwater inspection for permit NCG020072 that day, addressed in a separate letter. Please see the attached inspection checklist. Background In September 2003, and revisited in May 2005, Sunrock proposed combining flows of stormwater/wastewater from the concrete plant and the next -door asphalt plant, to be contained in a ravine located behind the asphalt plant. The ravine was to be a non -discharge situation, or if any overflow occurred, it would enter a fines pond that is part of the overall mine water control scheme. There were two outlets on the east side of a berm (since turned into a road) that were to be sealed. DWQ requested engineering calculations on both dates to show the holding capacity of the ravine for a 25-year/ 24-hour storm. These calculations were never provided. Official approval of this approach was never granted by the State, although during the May 2005 review of the site, the concept was tentatively thought to be feasible, if supported by the calculations. Present Conditions During the June 26 inspection, it was observed that an overflow standpipe exists at the north end of the ravine, and at least one of the discharge points on the east side of the road was actively draining. During our follow-up visit on July 2 you explained that the non -discharge idea did not work. A return to releasing the commingled concrete and asphalt flows had been made, although no specific date was given for this change. The fines pond now drains into the ravine, too, when its standpipe becomes clogged. This seemed to be the case during the revisit on July 2. Because the last half of 2006 and nearly all of 2007 were periods of drought, DWQ assumes that this decision was made in early 2006. Regardless, permit conditions were in force throughout the permit cycle in the absence of rescission of the permit. Documents within the SP3 had not been updated annually, but revisions were emailed to this office by the end of the day July 2, 2008. There was no evidence of Qualitative Monitoring events, and no Quantitative Monitoring was done in 2006-2007 because of the drought. The 2008 round is still to be done. Samples were gathered in January 2008, but sample pickup failed Documentation of monthly inspections of tanks and containment areas was not provided. The admixture secondary containment was found to have about a 4" diameter hole through the base of the wall. Steps were taken to fill it with concrete the day of the inspection. This inspection re-establishes the expectations for compliance as a discharge permit. Specifically, the parameter testing for wastewater discharges released from the ravine are expected to meet permit limits. Recently renewed permits have increased Quantitative Monitoring to twice a year, with Tier 1 and Tier 2 activities required when limits are exceeded (NCG140000 will be changed in 2009). A check with Aisha Lau showed that she hagjio documentation of this plan, either. DWQ has been ignored. Tony Sample had proposMover the telephone to stop the discharge that was handling commingled Concrete and Asphalt plant runoff, and then went ahead and did so. In a telephone conversation today, Tony stated that they long ago stopped that discharge, and that "the water backs up on them and percolates into the ground". He stated that he had requested his engineers to prepare information, but that it was very low on their priority list and had been forgotten. I asked when they could still document the situation to us, and he replied that the engineers had three expansion projects in the works, implying that it was not going to receive attention anytime soon. So i told him that we would make a visit before long to better understand how the stormwater was being handled. The permits are both still active. He replied that a visit would be fine, and that all that was required by the permits was to have a SP3 on site. I added that a report covering annual sampling was also required, on which he would certify no discharge. The large holding ditch was roughly measured using a laser viewfinder. The holding area is about 300' long with an average width of 35' and an average depth of about 7'. Tony claims a watershed of 2.5 acres. Overflow would go to the Fines pond, which needs to be cleaned out because the solids are almost up to the standpipe at this time. The standpipe goes to a retention pond outside the berm. This overflows to a ditch that goes to one of two quarry ponds/outfalls. His engineers are still busy and may not prepare this engineering analysis anytime soon. He agreed to submit at least preliminary calculations on how much water would stand in the ditch after a 25 yr/ 24 hr storm. I chastised him mildly for offering no response to our request for engineering details in September. He commented that the company was soon to open a new Concrete/Asphalt/Quarry much like this one in Person County. Sample: On April 21, 2003 Myrl Nisely of the Raleigh Regional Office of Division of Water Quality made a compliance inspection at the Butner facility. On May 20, 2003 he and I returned for a more in-depth tour of the Sumock facility for information and to discuss what stormwater permits are needed for this Sunrock complex. The company holds three stormwater permits. NCG 020072 (quarry), NCG 160044 (asphalt) and NCG 140225 (readymix concrete). You had raised the question of whether all were needed and whether any could be combined. Your help was appreciated. The results were as follows (also see attached checklist): 1. Inspection of the Readymix concrete site for NCG140225 showed that runoff interconnects with a ditch on the side of the Asphalt plant. Therefore stormwater/process waters from the two sites commingle and are discharged from the back of the asphalt location. The Asphalt plant property is owned by Sumock but is leased to REA Construction for their operation. The Asphalt stormwater permit is held by Sumock. making execution of the permit the responsibility of Sumock. This includes employee training, all inspections, draining of containment structures, sampling of discharging stormwater and preparing and maintaining a SP3 manual. This office feels that enough documentation and compliance activity are required for the asphalt plant to warrant continuing the NCG160044 permit. The Quarry permit is enough different from the other two permits to justify maintaining all three. While there may at first appear to be some elements in common to all three, in reality each manual needs to be tailored to specifically address the BMPs, SPRP and other parts of the permit unique to each. Admixture chemicals and fuel at the concrete facility were inside containment structures. 5. Drum washouts take place away from the loading station and run across a crushed stone driveway into the water recycle pond. 6. The primary "Quarry" stormwater discharge is from a holding pond far removed from the concrete production site. 7. None of the above permits had the required Stormwater Pollution Prevention Plan on 4/21. 8. Documentation of containment draining and the SPCC plan for the entire site were available, but otherwise the requirements of the permits had not been addressed. The inspection on 5/20 brought to your attention the revelation that the asphalt plant and concrete plant runoffs were at a common point. The permit requires annual sampling and employee training as major responsibilities. These have not been carried out. Based on the above violations, this is a Notice of ViolationiNotice of Recommendation for Enforcement. This office will be recommending to the Director of the Division of Water Qualitv that civil penalties be assessed against your company for these violations. (NCGS 143-215.6 provides that violations of 143-215.1 may incur civil penalties up to S25.000 per violation per day.) Your comments on 5/20 outlining the stormwater applications and redesigning activities you have been doing at other company sites will be taken into account in this determination. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .l and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983. The stormwater permit you are receiving, NCG 140000, does not permit wasting concrete, dumping excess concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General Statutes 143-215.6A If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to request an individual permit by submitting an individual permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
