Attached is the report resulting from my November 9, 2005 inspection of the
stormwater managemenat system serving Southern Concrete Materials' (SCM) Murphy
Plant. At the time of my midmorning arrival I found the settling basins starting to overflow.
The water leaving the basin had a pH of 11.93. It goes without saying that water of this
high pH cannot be discharged to the State's surface waters. Rob Lindsay plans to make
plumbing modifications which will allow the use of recycled water to wash drums after
filling with batch. Employee training would also be in order. I saw an unattended truck
tank overflowing as I walked around the yard. At any rate SCM needs to figure out how to
operate without discharging washwater to the nearby stream.
After having time to think about the Murphy Plant over the weekend I now am of the
opinion that SCM should dig a settling basin at the lower end of the yard where you now
capture some stormwater transported sediment behind a rubble berm.
Should SCM ever decide to relocate from Murphy to Ranger I hope that you would
approach the Ranger site as if no plant were there; meaning grade the site so that you
can maintain control of all wash and storm water. I like the construction and operation of
your Mills River and Andrews plants the best of those I have thus far seen.
Please refer to the enclosed inspection report for additional observations and
comments. If you have need to discuss my observations in greater detail please do not
hesitate to call me at 828-296-4659. Would you or Rob keep me posted of progress at the
Murphy Plant?

For what ever reason by late morning on the morning of my inspection the three cell washwater treatment/
recysle system was overflowing with that overflow eventually reaching a nearby stream. The pH of the
overflow as it left the settling basin was measured to be 11.93. 1 hardly need to mention that water having a
pH of 11.93 cannot be discharged to the State's surface waters. Rob Lindsay plans to install
pumping/piping to allow the cleaning of drums with recycled water after filling with mix thereby reducing the
volume of overflow. It is my hope that SCM can find a way to operate so as not to discharge washwater. I
would guess that additional staff training would be inorder for purposes of encouraging water conservation. I
observed the overflow of an unattended truck mounted tank being filled.
I am now inclined that SCM needs to construct a settling basin at the lower end of the lot to provide
treatment for stormwater runoff.

In accordance with your application for a stormwater discharge permit received on December 2, 1994`we
are forwarding herewith the subject state - NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
•concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.
Please take notice that this certificate of coverage is not transferable. Part II, B.2. addresses the
requirements to be followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area

Dear Linda,
I recently went to our Murphy plant as a follow up to your recent stormwaler inspection and wanted
to update you on our plans to better bring this site into compliance. We are in the process of
r-— ,
�co�nstructing a containment structurJ for the admixture chemicals, fuel and other applicable liquids
and should have it otnpl`eted witliin the next few days. Also we_are_in talks with the adjacent_ _
landowner on utilizing an area of his land for construction of ajbasin to divert all -water -from -the yard
prior to its release into the adjacent waterway.
As per your letter we will perform analytical monitoring within the 60 day period that you outlined. I
have also done extensive training with onsite and managerial personnel to ensure that recordkeeping
is adequately kept and is up to date.

This letter is in follow-up to the General Permit (NCG140148) Compliance Inspection conducted
on September 9, 2009. The facility was found to be in violation with General Permit NCG 140148.
The following items were found to be non -compliant and need to be addressed within 60 days of
this letter in order to be compliant with your permit.
Analytical Monitoring
Part III Section B 1. Stormwater Discharge Monitoring is required by permit: No stormwater
discharge analytical data was obtained during the inspection. Data received upon request also did
not have any stormwater discharge monitoring analysis data. Within the next 60 days, the facility
needs to obtain stormwater samples from two different storm events. Sample collection must be
within the first 30 minutes of the stormwater discharge from the facility and the rainfall event
totals must be documented in inches. Total Suspended Solid (TSS) samples need to be gathered
where the stormwater is leaving the site before it mixes with the stream and pH needs to be
analyzed from the same location within 10 ininutes of collection with a calibrated pH meter. TSS
and pH results for both sampling events need to be sent to Asheville Regional Office to my
attention at the address listed below in the footer.
Part III Section C 1. & 4. Process Wastewater Discharge Monitoring is required by permit:
Wastewater discharge analytical monitoring data obtained onsite during the inspection was from
2004. Process wastewater discharge analytical monitoring data received upon requested was
missing information and no analysis was received for Year 4. Within the next 60 days, the facility
needs to obtain process wastewater samples from two different pumping events from the
wastewater pits. Samples shall be obtained at the end of the discharge hose prior to mixing with
the stream. Total Suspended Solid (TSS) samples need to be gathered and pH needs to be analyzed
within 10 minutes of collection with a calibrated pH meter. TSS and pH results for both sampling

Secondary Containment
Part II Section A. 2. (b) Secondary Containment Schedule is required by permit: Bulk
storage of liquid chemicals is contained onsite without secondary containment. Within 60 days of
this letter please provide a description of what type of secondary containment will be used for
these containers and a timeline of when you expect to complete the containment installation.
Housekeeping
Part II Section A. 4. Preventative Maintenance and Good Housekeeping Program: Based on
observation during inspection, it is unlikely the facilities discharge analytical results would meet
the Cut-off Concentration or Daily Maximum Limit. Please review your Preventative
Maintenance and Good Housekeeping Program to evaluate if the schedules are adequate and being
properly followed to provide the optimum effectiveness for keeping the facility compliant with the
General Permit.

Inspection Summary:
Housekeeping at this facility will be a constant demand for site manager.
There are many types of chemical storage units onsite with no secondary containment.
Waste blocks should not be filled if a rain event is expected. Blocks leak at bottom. If the residual concrete has not had
time to harden in the blocks it could contribute to stormwater pollution.
Truck washing water was flowing across the lot and had access to the creek. If the area where truck washing is occurring
is pitched incorrectly then it needs to be fixed, otherwise personnel needs to be trained on how to wash trucks so water is
directed to pits.
Current permit requires annual monitoring of wastewater. The only analytical monitoring report onsite was from 2004
(March and December), both samples were noncomplaint with process water permit limits. No stormwater analytical
monitoring results were onsite.
Evidence of wastewater and stormwater reaching the stream was apparent where the berm was lacking

accordance with the permit. The facility has a wastewater discharge (pumped from the
pits) and a stormwater discharge outfall, both are suppose to be monitored. There was
one set of analytical results for the permit cycle onsite (3/16/04&12/6/04), these were
wastewater samples and both were above cut off concentrations.

Comment: There was not a sufficient berm at the perimeter of the work area to protect
the stream from runoff. Solids were visible on the bank of the stream. Water draining
from pit residual settling area was reaching the stream. Truck washwater was reaching
the stream. Stored waste pile runoff could potentially reach the stream as well.

In response to your renewal application for continued coverage under general permit NCG140000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued Stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency. dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG140000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions
* A Certificate of Coverage
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.

This certificate of coverage shall become effective August 1, 1999.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
