Dear Mr. Bracy:
On May 6, 2003 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality made a
compliance inspection at the Sims facility. The help of Mr. Tim Jacobs was appreciated. The following
observations were made (also see the attached checklist):
1. The Stormwater Pollution Prevention Plan manual (SP3) contained all of the required data and was
well organized.
2. Analytical data showed TSS above the permit limit of 30 mg/1 for both 2001 and 2003, causing this
letter to be a Notice of Violation.
3. Work was underway to construct a berm through which discharging stormwater will pass to remove
solids better. Vehicle washings travel across the crushed rock back portion of the site to a shallow
puddle. If enough volume, the flow will go through the new berm to a channel running across the
back edge of the facility to the sampling/discharge point.
4. Secondary containment structures for fuels and for admixture chemicals were clean. A project was
underway for chipping concrete away from the drains in order to put on valves.
5. The drum washout pit had no signs of recent discharge, and had about 18 inches of freeboard. Please
be aware that Groundwater Standards apply, and contamination needs to be avoided. The
Groundwater Section is studying the question of what impact earthen pits may have on groundwater
quality. We will contact you again once a course of action has been determined.
6. Housekeeping was good. No trash observed. The concrete disposal pile was neatly stacked.

concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
