Operating a treatment facility, discharging wastewater, or discharging specific types Of stormwater to waters of the State
without a valid NPDES permit will subject the responsible party to" civil penalty of up to $25,000 per day. Enforcement
action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office
immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply
for and receive new coverage under an NPDES permit.

On 1/27/09 a site inspection was performed to determine if the general stormwater permit number
NCG140125 could be rescinded as requested by the owner on 10/23108. The request was received in
the regional office on 11/5/08.
The facility is fully operational. Roy Oldham said that a facility was closed at 564 Barris Construction
Rd. in Pitt County, but that there is no plan to close the 5039 Hwy 11 S site at this time.
I recommend that the permit not be rescinded.

Dear Mr. Mulligan:
We have received your Notice of Violation and the following is our plan to implement the Stormwater Pollution
Prevention Plan and ensure compliance with all regulatory guidance.
I. We will request assistance from Jarvis and Associates, Washington, NC to come in and reevaluate our current
BMP's making them more feasible and realistically achievable.
2. We have blocked our discharge port that was discharging process water directly into Mr McLawhorn's ditch.
Waste process water will be diverted back toward the center of our property and solids removed frequently.
3. A gravel swale will be constructed between discharge port and ditch on the east side of our property. A grassy
swale will be constructed along the south east ditchline to assist in filtering any runoff from our aggregate piles and
discharge.
4. We will relocate our aggregate piles away from any ditches to reduce sedimentation in ditches.
5. Excess waste process water will be used on plantsite for dust control and aggregate sprinkler system.
6. All discharge water will be placed in reclaimer pit for ease of cleaning and to allow extra time for solids to fall
out.
7. Land near wash down rack will be graded away from ditch on north side of property.
8. Ph levels will be monitored on a more timely maner. We feel that use of hydrochloric Acids in wash procedures
combined with proper sedimentation control will reduce Ph levels. (See enclosure 2)
9. We are currently undergoing discussions with the NC DOT Highway department on flow problems on Old NC
Hwy 11.
10. We will sample levels of sedimentation to determine if further maintenance to ditch is required.

On April 4, 2002, Mr. Robert Tankard, Division of Water Quality, inspected the
Greenville Ready Mixed Concrete site. Greenville Ready Mixed Concrete, Inc. holds
NPDES Permit No. NCG140125. The inspection found the following violations. The
permit requires the implementation of the Stormwater Pollution Prevention Plan (SPPP)
which has been established for your site. Conditions in the SPPP had not been
implemented. Also, the wastewater that was being discharged was over the permitted
limits. The wastewater had a pH of 10.4 standard units and the maximum permit limit is
9.0 standard units. In addition, there were visible signs that concrete solids have been
discharged in the unnamed tributary which receives the permitted effluent.
You are hereby notified that Greenville Ready Mixed Concrete, Inc. is in violation of
NPDES Permit No. NCG140125. You are advised that "a civil penalty,.in accordance
with the maximums established by N.C.G.S. 143-215.6(a)(2), may be assessed against a
person who is required but fails to apply for or to secure a permit required by G.S.
143-215.1, or who violates or fails to act in accordance with the terms, conditions, or
requirements of such permit." NCGS 143-215.6 further provides that "if any action or
failure to act is continuous, the Commission may assess a penalty for as long as the
violation continues."

We have received your Notice of Violation and the following is our plan to implement the Stormwater Pollution
Prevention Plan and ensure compliance with all regulatory guidance.
1. Cleanup has begun on the settling basin located at the truck wash area of our property. We intend to remove all
solids and to schedule this area for quarterly cleanup in the future.
2. Silt fences will be placed at the discharge end of the settling basin to catch any solids that might escape. This
area will be cleaned weekly or as needed.
3. We intend to grade and clean areas of the drainage ditch to ensure proper runoff. Areas will be matted or grass
will be sown as needed to prevent erosion of ditch banks.
4. We have communicated with the Carolinas Ready Mixed Concrete Association on ways to reduce pH levels in
the discharge. Engineer Bill Twitty is addressing our unique problems.
5. A pH meter and test kit will be acquired and discharge will be tested monthly to ensure we are at or below our
permit limit of 9.0 standard units.
6. Environment 1, Incorporated, has been retained to conduct testing to comply with analytical monitoring -
requirements.
7. A testing and training book has been established for required annual training. Classes have been designed and
initial classes have begun. All employees will be trained and documented.
S. A proper spill kit has been established, inventoried and marked. Kit is located in an easily accessible central
location. All employees will be trained in its proper use.
9. Prior to this inspection, the company had instituted a Delvo wash system that dramatically reduces final wash
out discharges. The slurry that remains overnight in drums is used with the next day's concrete, thus reducing
discharge.
10. We have sent samples of water to ACF Environmental in Raleigh, NC for assistance in finding solutions for
turbidity and pH problems. Methods currently being considered include neutralization by acid and/or flocculation
logs.
Barring any unforeseen weather related problems we fully intend to have all of these changes implemented by
February 9, 2001.

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG I40000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,

In accordance with your application for a stormwater discharge permit received on December 7, 1994, we
are forwarding herewith the subject state - NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.
Please take notice that this certificate of coverage is not transferable. Part II, B.2. addresses the
requirements to be followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
