Wooten Corporation The SP3 manual is being updated at Wilson and reviewed in all our plants and if revisions are needed they are being done. 2. Our manual has Storm Water SP3 as well as the SPCC plan this is why we do valve and pipe inspections, and risk assessment. 3. 2002 Storm Water samples did not get taken for Wilson concrete. 4. The 2003 training that I had with the plant manager and all the drivers covered the draining of the containment wall, documenting observations, and locking of the valve. 5. The pit has been cleaned to allow for better freeboard and in cleaned once a week. The Flyash puddle was cleaned the next day after your visit. Two of the big piles of debris were sold and the dirt has been moved to the back of the lot. The old scrap metal is leaving but it is not all gone at this time. We are working to correct any problems that we may have as soon as possible. Wooten Corporation In response to your letter of July 8, 03, I will provide the Sampling Data that I have and hopefully give an explanation as to why I do not have the others. NCG 140248 This is a Builders Firstsource plant and is not a part of S.T. Wooten. NCG 140120 This plant is in Henderson, we do not have any material at this location (ie. Cement, Ash, Stone, Sand or Chemicals,) this plant was closed in 1994 or 1995, and has not had any activity to effect Storm Water. I wil send a letter by July 30, to DWQ, Central Files. NCG 140233 This plant we feel is Sheet Flow, and all Storm Water that is on site is held by our pit system. A letter will also be sent to DWQ on this as well. NCG 140269, NCG 140294 Were Builders Firstsource plants and S.T. Wooten has purchased them. The Sampling will be included in this letter. NCG 140121 This plant and property did not have Storm Water run off in 2002, but a letter was not sent to DWQ. NCG 140010,NCG140122,NCG140234, NCG14 35, NCG140236, NCG140289, NCG I40317; the drought of 2002 made it impossible to take the samples by July 30, 02, we just did not have enough rain. Wooten Wilson Readymix Concrete Plant Permit No. NCG140122 Wilson County Dear Mr. Washburn: On May 6, 2003 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality met with you and Mr. Phil Adams to inspect the above readymix concrete facility for stormwater permit compliance. Your combined assistance, openness and candor were greatly appreciated. Responsibility for all of Wooten's stormwater compliance is being shifted from Mr. Adams to you in the wake of recent acquisitions. You stated that a review of each Wooten site is being undertaken to establish what physical changes may be needed, including stormwater controls. The violations stated here are serious enough for this office to recommend enforcement. Please provide a written response within 10 days stating any reasons as to why enforcement should not be taken against S.T. Wooten. The inspection checklist used is attached. Observations were as follows, with the elements causing this letter to be a Notice of Violation noted: 1. In general, the stonrwater documentation reflected a good but aged program designed around the first version of General Permit NCG140000 back in 1994, with appropriate activities through the vear 2000. However, since then the program has been allowed to lapse. Part lI(A)(9) 2. The SP3 manual needs an overhaul to bring it into conformity with the permit revisions of 1999. For example, activities such as doing a risk assessment or inspecting valves and piping are not in the current permit. Nearly every section of the manual needs a thorough review and update, a job that is a requirement at least annually. Part ll(A)(7) 3. There was no evidence of annual sampling for 2001 or 2002. You have plans in place for the 2003 sampling as soon as weather permits. Part II(C). 4. Resume documenting observations made before emptying secondary containment structures Part II(A)(2)(b) and Housekeeping inspections Part II(A)(4). Vehicle Washing travels to the Drum Washout Pit. This pit was chock full of solids. The walls around it were broken in places with water discharging, meaning there was no freeboard at all. This critically important stormwater protection device must have closer maintenance and operation. Regular inspections have obviously not been carried out per Part II(A)(8). Please be aware that Groundwater Standards apply, and contamination needs to be avoided. Disposal piles of broken concrete, asphalt and soil covered a large area of the site, and some held trash and debris normally placed in municipal landfills. It is stronger recommended that the trash be removed to a landfill, and that disposal/storage of waste solids be consolidated onto a smaller portion of the site. A "puddle" of soft gray material was located between the end of the on -site railroad spur and the regular railroad bed. This should be removed to preclude any further movement by erosion. The permit provides a 30 day period after an inspection to upgrade the documentation. In light of the importance of your effort to evaluate each Wooten facility at this time, an extra 30 days will be allowed. Therefore, please provide a report to Myrl Nisely by July 25 verifying that the deficiencies in the manual have been corrected and giving an update on any other improvements made at this site.
