This letter serves as a written response to the Notice of Violation (NOV) issued by your
office and dated September 27, 2007. Commercial Ready Mix Products, Inc. (CRMP)
has hired an environmental engineering firm to assist us with the proper implementation
of and compliance with NPDES Stormwater General Permit NCG140110. The firm has
been retained to address the permit violations observed during the September 20, 2007
inspection conducted by Mr. Ed Warren from the Division of Water Quality. Listed below
are the permit violations in italic followed by the corrective actions that will be conducted
by CRMP.
1. Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed and recorded but
not fully implemented. Specifically, all necessary secondary containment is not provided
and employee training has not been preformed.
CRMP Inc. has determined that some site improvements are detrimental to meeting the
necessary requirements for SWQ on the subject of containment and runoff. These
improvements would possibly require an update to our current SPPP. In order to
implement these improvements, we would like to request a completion date of May 1,
2008 to have this issue in compliance.

CRMP plant managers have attended SPPP training at the Ahoskie Plant during the
September 20, 2007 inspection and will provide employee training at each of its facilities
in the immediate future. Proper documentation of employee training will be kept at each
facility and employee files at the corporate office.
2. Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit
requirements.
The environmental engineering firm will assist plant managers in qualitative monitoring
and record keeping. This will be completed during a one day training session at each
facility. The annual non-stormwater discharge certification, semi-annual facility
inspection and semi-annual visual monitoring of outfalls will be conducted during this
training session. This training session is scheduled for early November 2007.
3. Analytical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit
requirements.
Sampling procedures and reporting requirements will be reviewed during the one day
training session conducted by the environmental engineering firm. CRMP will collect
water samples during the next representative storm event. The annual DMR will be
submitted to DWQ upon receipt of analytical results.

Ed Warren from the Washington Regional Office of the Division of Water Quality conducted a site inspection of your
facility, Commercial Ready Mix Products located at 302 Hicks St., Edenton, Chowan County, North Carolina on
September 20, 2007. The site drains to an Unnamed Tributary of Queen Anne Creek, Class C-NSW waters located in the
Chowan River Basin. The site visit and file review revealed that the subject project is covered by NPDES Stormwater
General Permit NCG140110. The facility was found to be in NONCOMPLIANCE with the NPDES Permit.
The following observations and/or permit conditions violations were noted during the Division of Water Quality inspection:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed and recorded but not fully implemented.
Specifically, all necessary secondary containment is not provided and employee training has not been performed.
2) Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit requirements.
3) Analytical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.

Other Observations:
1. The required SPPP was completed recently but not being fully implemented. The analytical and qualitative monitoring
has not been completed. Part Il, Section B and C of your permit outlines the requirements for analytical and qualitative
monitoring. Failure to comply with the conditions contained in your permit is considered to be a violation.
2. You should read your entire permit and be aware of what is required in it. It is your responsibility as the permit holder
to read and understand what your responsibilities are.
3. You are reminded that you must keep a copy of your permit and certificate of coverage on site. You had a copy on the
inspection date.
Please provide this Office with a written response within fifteen (15) days of your receipt of this letter. Please include

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water
Act and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES permitting
program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce
pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to
obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the
industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One
condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop
and implement site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to
include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant
discharge.

The following items are a subset of permit requirements and are listed to assist you and help bring your attention to
certain permitting issues, process and condition requirements of your permit. That said, please see the above mentioned
web site in order to obtain a copy of the permit such that you may fully comply with all the conditions therein. Failure to
properly comply with conditions of the permit, like those bulleted below, constitutes violations and are subject
civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a
general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality
(DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of
stormwater associated with the industrial activity, process wastewater, and/or mine dewatering.
• Once the Notice of Intent is received. DWQ will review and determine whether a Certificate of Coverage (COC)
may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the
permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the
type of General Permit until the permit expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an allowable non-
stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the permits
have following condition requirements (you must read your entire permit to ensure full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records - Visual monitoring shall be documented and records maintained at the facility along with the
Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall also be
maintained on -site. The Permittee shall retain records of all monitoring information, including all
calibration and maintenance records and all original strip chart recordings for continuous monitoring
instrumentation, and copies of all reports required by this general permit for a period of least 5 years for
the date of the sample measurement, report or application.
o Expiration - The permittee is not authorized to discharge after the expiration date of the general permit. In
order to receive automatic authorization to discharge beyond the expiration date, the permittee shall

submit forms and fees as are required by the agency authorized to issue permits no later than 180-days
prior to expiration date. Any permittee that has not requested renewal at least 180 days prior to
expiration, or any permittee that does not have a permit after the expiration and has not requested
renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your
permit is a violation.
Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to
any person expect after notice to and approval by the Director. The Director may require modification or
revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other
requirements as may be necessary under the Clean Water Act, The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the Division in
writing in the event the permitted facility is sold or closed. The Division of Water Quality views changes
of name or ownership as a modification that requires the Director's approval and reissuance of the permit.
Name and ownership changes required you to complete a Name/ownership Change Form from the
Division and mail it back to the Division of Water Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
The facility was determined to be in NONCOMPLIANCE with NPDES Permit No. NCG140110 for the following reasons:

-Analytical Monitoring has not been performed.
It was noted during the inspection that the facility has recently obtained a Stormwater Pollution Prevention Plan and is in
the process of implementing the Plan. Company representatives indicated that the discrepancies listed above would be
addressed and performed in the immediate future.
It was recommended that the facility schedule training, develop a schedule for providing the necessary secondary
containment, perform Qualitative Monitoring at the next rain event and contact a commercial laboratory to obtain items
necessary to conduct Analytical Monitoring during the next representative rainfall event. Facility was reminded of
requirement to perform analytical monitoring during the first and last year of the permit term regardless of cut-off
concentrations and to submit the results of the monitoring during the last year of the permit term with the permit renewal
application.

Comment: The recently completed Plan contains a form to evaluate non stormwater
discharges but facility has not completed task to date. Facility has eliminated Outfall #1
by building a catch basin to collect stormwater from the applicable drainage area for
recycling. The Plan will be amended to reflect this basin and practice. There appeared
to be a small amount of concrete waste in the receiving ditch for Outfall #1. It appeared
that it had gradually accumulated over the years and the present owners indicated that
it was there when they bought the site. The aforementioned catch basin should
eliminate the potential for concrete waste products to be discharged to this ditch.

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U. S. Environmental Protection Agency dated December 6,
1983.
This permit does not affect the legal requirement to obtain other permits which may be required by
the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act, or any other Federal or Local government permit that may be required.

Your facility is currently covered for stormwater discharge under General Permit NCG 140000. This permit will
expire on July 31, 1999. North Carolina General Statute 143.215.1(c) requires that an application for permit
coverage renewal be filed in a timely manner. A prior notice of renewal was sent for this site on January 12, 1999.
To date, no response has been received by the Division of Water Quality (DWQ). In order to assure your
continued coverage under the general permit, you must apply to DWQ for renewal of your permit coverage.
Enclosed you will find a general permit renewal application form. This form serves two purposes. First, it is an
application for renewal of your permit coverage. Second, it serves as an invoice for the $80.00 permit fee. The
application must be completed and returned with the required fee by April 5, 1999 in order to assure continued
coverage under the general permit.
Recent legislation modified the fee structure for DWQ permits. Your general permit fee has been changed to an
annual fee of $80.00. A copy of the new fee schedule is enclosed in this package.
Failure to request renewal by April 5, 1999 will result in a civil assessment of at least $250.00. Larger penalties
may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without
coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to $10,000 per day.

In accordance with your application for a stormwater discharge permit received on November 28, 1994, we
are forwarding herewith the subject state - NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving. NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.
Please take notice that this certificate of coverage is not transferable. Part II, B.2. addresses the
requirements to be followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
