I noted in your letter dated May 11, 2005 that there were several areas of concern. First of all
I want you to know that I am appreciative in the manner you went about the inspection. It was very
professional. The purpose of this letter is to assure you that we are concerned about operating our
facilities in accordance with all permits and regulations.
I have encl9sed copies of thefiocuments you expressed as information that was lacking.
These include an updated site plan,'spill information, semi-annual inspections, and calibration buffers
for pH meter.
As for the document indicating no significant spills for the past three years was in the
SWPPP. It is under Section I, paragraph F. A copy of this page and the Spill/Release Report form is
enclosed. The site plan has been revised and is also enclosed. A copy of th^arterly Housekeeping
Inspectiong �form which is completed during the semi-annual inspection is also enclosed. As for the
f3F'E buffers 9ibration for the pH meter is kept here in my office and given to the person doing the
sampling. As for item 3 in your letter concerning the cement dust buildup - this has been removed.
I hope that this clarifies all the issues of concern. Thank you again for giving me the

E. Description of Storage Practices:
a) Coarse and fine aggregate is received via dump truck and stored on concrete
slab contained by concrete wall on three sides.
b) Cement and fly ash are received via closed tanker trucks. This material is
pneumatically unloaded and stored in closed steel silos.
c) Liquid admixtures arrive at the plant in closed tanker trucks and pumped into
AST's located inside a containment area.
d) Diesel fuel is received from the fuel distributor and unloaded into a double -
walled AST.
e) All other oils and petroleum products are stored in AST's inside the shop
building.
f) Truck washing liquid (acid solution) is also stored in the shop building until
ready for use. An AST is located at the truck wash area for daily use.
F. List of Significant Spills: There have been no significant spills or leaks at this location
since the purchase by Chandler Concrete in January 1991. Should a leak or spill occur it
will' be duly noted on the proper form located behind tab labeled Spills. c
G. Storm Water Outfalls: There is only one point source storm water outfall at this site and
it is indicated on the site plan in the south east corner of the property. This water flows
into a ditch that feeds into Marlowe Creek that eventually ends up in the Flat River. Storm
water at this outfall will also be co -mingled with process water during storm events. All
other storm water leaves the property in a sheet discharge. The outfall is monitored
during non -storm events in order to make sure that there is no water being discharged.
II. STORMWATER MANAGEMENT PLAN
A. Feasibility Study: This site has been retrofitted in order to eliminate possible
contamination of storm water as much as possible within economic constraints.
Secondary containment to enclose the liquid admixtures and fuel tank has been
constructed. The aggregate storage area is contained on three sides to prevent spillage of
material. One side was left open in order to receive and to have excess to the material.
This aggregate is transferred to a series of in -plant storage bins via conveyors. A front-
end loader transfers the aggregate from the on the ground storage bins to the conveyors.
Cement and fly ash is being unloaded, stored, and discharged via a closed system. The
fueling operation is for the loader only. All of the other vehicles are fueled off -site, thus
greatly reducing the exposure of possible petroleum spills.
Care was taken to separate the process water from as much storm water as possible by the
addition of swales and berms. This process water goes through a series of settling
basins/ponds in order to filter out sediment. This water is reused at the plant for dust
control and washing.
B. Secondary Containment Schedule: The secondary containment vessel for the liquid
admixtures has been constructed. The pumps and dispensing bottles are located in a closed

This writer, of the NC Division of Water Quality, conducted a Compliance Evaluation Inspection of the Chandler
Concrete Plant in Roxboro, NC on April 27, 2005. Mr. Michael Owen represented the Plant during the Inspection. The
assistance Mr. Owen provided was greatly appreciated. Findings during the inspection are as follows:
1) Stormwater and process wastewater from the entire facility is directed to three ponds in series prior to discharge.
Discharge reportedly only occurs during heavy rainfall events.
2) The Plant's permit documentation and procedures were reviewed and found complete with the following exceptions
Need to update site map to include drum wash area and new settlement pond.
Need to include document indicating no significant spills during the past three years,
The semi-annual inspection report should include checks of BMP's and stormwater systems,
Need calibration buffers for pH meter. Meter must be calibrated prior to each use. Calibration records should be
kept on hand.
3) A small amount of cement dust buildup was noted just ahead of the sample collection point for outfall 001.
4) Please be mindful of the following when constructing additional treatment facilities to ensure that the Plant's
stormwater/process wastewater discharge meets the permit limitations: Under 15A 2H.0126 and 2H.0139, recycle
systems and other stormwater control structures allowing process wastewater to discharge to waters of the State at ready
mixed concrete facilities or structures capturing the water for nondischarge closed -loop reuse under 2H.0219(a) "shall be
designed following good engineering practice and comply with the minimum design requirements ...The plans and
specifications must be sealed by a Professional Engineer licensed in North Carolina ..."

Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general Stormwater permit NCG140000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions
* A Certificate of Coverage
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.

In accordance with your application for a stormwater discharge permit received on November 29, 1994, we
are forwarding herewith the subject state - NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG 140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terns of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt
of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of die North
Carolina General Statutes, and filed with the Office of Administrative Hearings Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.
Please take notice that this certificate of coverage is not transferable. Part 1I, B.2. addresses the
requirements to be followed in case of change in ownership or conu-ol of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

Practices (BMPs) to attenuate the strength of stonnwater/process wastewater discharges to meet permit
limits. These excursions of permit limits give reason for the Division to recommend an enforcement
action against Chandler Concrete Company, Inc. You may respond in writing within 10 days from
receipt of this letter to provide information to be considered in this enforcement proceeding.
