An inspection of this facility was conducted October 3, 2014 by Mike Randall (RCO Stormwater) and Laura Herbert (ARO). Based on our inspection, we agree that the stormwater exposure of the process is minimal and that the permit can be rescinded. Natalie Berry of Henderson County was our on -site contact during the inspection. Note that since the issuance of the permit in 2011, capital improvements have been made including the installation of a new convenience center where recyclables are dropped off for separation and pickup by recylers and separation of the leachate collection system from the stormwater system. The following areas (with associated comments) were inspected. Convenience Center - This center is new and was noted as being clean with potential stormwater exposures minimized or not significant. Natalie indicated that they sweep this area, usually daily. Used oil collection, cooking oil collection, battery collection, used diesel/keroserwt ollection, and electronic collection areas are all under a shed with sedondary containment. However we did note some drums and car batteries outside on pallets. Natalie was instructed that these should be moved under cover, and during our inspection the batteries were moved under the shed roof. She indicated the they would move all drums under roof, even if they had to extend the shed roof. This is a BMP and Henderson County was reminded to maintain this BMP. The electronics wrapping area is not under cover, but this appears to be a low -risk activity with respect to stormwater exposure. Once wrapped, the electronics are stored in the backofa semi -trailer (for pick-up). The Whitegoods collection area (including the bin) is not undercover, but appears to be a low -risk activity with respect to stormwater. Freon is removed prior to binning these items. N Commerical Recylers area - This is the area where commercial recyclers deliver their materials. The collection bins have sloped drains underneath each that collect any leachate from the bins, and this is piped to the leachate collection system (which goes to a sanitary sewer/treated). Transfer Station - previously the recycle area was here, however this has been moved to the new convenience center (see above comment). This area is covered with three enclosed sides. In response to a DWvI inspection (May 10, 2013) which discovered that the leachate collection system from this area was tied into the stormwater system (violation), the county converted the stormwater system into the leachate system as part of the required corrective actions. This area is permitted by DWM and the leachate is pumped to a sanitary sewer for treatment. Wth the new leachate collection system, exposure of the leachate to stormwater has been addressed and exposure of the transfer operation to stormwater has been minimized. Vehicle Maintenance Area (adjacent to the Transfer Station) - We noted two drums outside that appeared to contain used oil filters and used oil or antifreeze. There was some spillage noted around the drums. We instructed Henderson County to move ALL drums in the building to prevent this type of potential exposure and to clean up the area where the spill was. Nape agreed that they would do this. An illicit discharge previously discovered has been addressed (drain in Floor has been eliminated). The crew was washing equipment at the time of the inspection. This practice should be reviewed by Henderson County and exposure to the stormwater drains limited, or potentially an NPDES wastewater permit review of this process may be necessary. Fuel Station - Two above ground off -road diesel tanks and one gas tank were observed. Henderson County was reminded that they must follow the Spill Prevention, Control and Countermeasure Plan (SPCC) Program for these tanks. We did talk to Natalie at the time of the inspection regarding the drums and batteries exposed, and instructed her to keep all of this type of material under cover. While we were at the convenience center, they moved the batteries under cover. Natalie indicated that they would also get the drums under cover, even if it meant extending the shed. You can read all the rest of my note here, if you want to. But the action point is: Yes, let's rescind as we agreed Friday. I got your telephone voice message, and I'm unsure whether you sent that message and these photos before or after we spoke on Friday. I do have some comments on the photos, but I'm swamped through Wednesday. If we need further discussion, will it suit your schedule for Thursday this coming week? Here are my comments on the photos, with photos of special interest in red text: 1. Transfer Station Overview: Note the concrete apron sloping away from the charging floor. (I assume that the floor under cover does not slope to the front (?)) Anticipate that in normal operation the concrete apron may see some spillage. If wet materials are accepted, and if truck beds are leaking, expect that the apron is a pollutant source for stormwoter flows. Uncertain how much/how bad. Perhaps daily maintenance more ►: .• ® sr substantial than just picking up the trash would be advised. I assume the covered floor has drains in it. Are we ok with the.eventual destination of flows from any interior floor drains? Note: unless we see the sort of problems that Mike reported from his earlier visit, and that presumably that Susan saw before, the endpoint here is that this transfer station is unregulated, unless ARO wants to pull them into the NPDES stormwater permitting program for bad behavior. At a similar scale and configured installation, RRO had a Waste Management transfer station that we did pull under a permit for bad behavior. Their apron had surface water drains that directed nasty spillage on the apron to the site storm drainage system. 2. Transfer Station Backside: I note the manhole cover in the foreground. Presumably it locates either o wastewater pipe, or a stormwater pipe. No further comment. 3. Vehicle Maintenance Area at Transfer Station: They're steam cleaning equipment? I note sufficient flow to generate a discharge away from the immediate area of the cleaning activity (photo foreground). ,If an off -site discharge is produced, do they have an NPDES wastewater permit for that discharge? 1 note that photo 1 makes it look like it was raining while you were there, but this photo does not: What don't I understand about that? 4. VMA Drums II: 1 note the dark appearance around the drums. Rain water or drum contents? You reported that you advised them to move these under cover. We talked about your instructions to them to remove this exposure, and whether to withhold the rescission until they actually do that as confirmed by another site visit. I think your report was that you trust them to make this change without the necessity of a follow up visit, right? And that we should not withhold rescission pending a return visit. 5. Commercial Recyclers Collection Area with leachate collection: Pretty clean appearance. You reported drains under the dumpsters, but they're not visible in this photo. The whole of the apron and the asphalt pavement appear to slope away from the dumpsters, but again, we can't see under the dumpsters in the photo. Presumably the concrete surface is sloped to actually capture leakage from under the dumpsters and direct any leakage into the leachate collection system, right? 1 mean, has the concrete surface under the dumpsters actually been installed with a depression to form an effective catchment for dumpster leakage? 6. Convenience Center: Poor practices here: batteries are not undercover. Drums are stored without containment and flow appears to be away from the pad while the ground around the drums appears to be wet. Lids are not fully secured on two of the metal drums. 7. CC Used Oil Collection (Large): No comment. 8. CC Cooking Oil Collection (Large): No comment. 9. CC Electronics Collection I (Large): No comment. 10. CC Battery Collection (Large): No comment. 11. CC Electronics Wrapping (Large): Obviously exposure of materials not intended for outdoor use. No containment. Is that a battery or a rat -trap next to the fence? Probably a low -risk activity wrt stormwater pollution generation. 12. CC Whitegoods Collection (Large): I note that the collection area does not have containment, as evidenced by the wet front of the dock. Probably a low -risk area wrt stormwater pollution. 13. CC Whitegoods Collection Bin (Large): Does not appear that this dumpster is either under cover or within containment. Probably a low -risk area for stormwater pollution. 14. CC Used Kerosene Collection (Large): No comment. 15. CC Recycle Bin Collection Area II: Pad for these two large roll -offs presumably slopes away from the placement location. Uncertain if your report of drains to the leachate system included these two roll -offs as well. Drains not visible in the photo. Not sure of the content of these two roll -offs. 16. VIVA Drums: Some two drums as in photo #4. Unclear to me now whether these two drums are in a local low spot, and so the wet area is other drainage into this area or whether these two drums are located on a local high spot, and the flow is away from the area, and presumably into the site drainage system. I'm also unsure if the darkened area is rainwater or drum contents. To recap our voice -to -voice review on Friday: • NCG12 for landfills would not be appropriate coverage here since the transfer station and CC are located at a closed landfill, i.e., no longer an active landfilling site. IMO we can't regulate this activity under NPDES on the basis of its past relationship with a regulated activity (landfilling.) • NCG13 for non-metal recycling, and NCG20 for scrap metal recycling might be considered as possible candidate permits at this location. In my view the choice between non-metal and metal recycling is not germane to whether they would need NPDES permit coverage. The site has both activities (Site has requested ARO and RCO to rescind their current coverage under NCG13.) Their current operating model is to receive waste materials from citizens and businesses, have the citizens self -segregate the materials, and have a third party contractor pick up the segregated materials. It seems to me that that is pretty close to a recycling activity that requires an NPDES permit. HOWEVER, their operation does not look like other commercial scrap metal recyclers. It also does not look like a PET bottle MRF type operation; nor does it look like a paper and cardboard and rags commercial recycling operation. It's my opinion that we should grant this request for a rescission. Consider the following in support of this opinion: o ARO does not see any surface water threat here based on site inspections; o The site conditions and threat that Susan apparently saw some years ago has apparently been addressed satisfactorily — Mike reports a great improvement in site conditions over time, o Our track records with two types of activities does not support permitting here: • We have generally said that small scale "convenience centers" are not regulated - - admittedly, this is not small scale as we have previously thought of it, but the idea that it is a regulated industrial recycling activity doesn't quite fit intuitively, either; • We have avoided regulating commercial transfer stations, except where bad behavior figured into our perspective, and a stormwater permit was seen as one mechanism for improved protection of surface waters. (RRO and Waste Management facility.) o The future of storm water permitting in the solid waste world waits for us to work on it. It is well established that from the start of the program we have regulated MSW landfills and industrial material landfills. But we have had to recently re -inform and re -clarify for the industry that C&D landfills are indeed regulated under NPDES just like other landfills, but that demolition debris landfills are not regulated. And, we had to recently persuade a doubting industry that the composting of solid waste was indeed regulated under NPDES. We have not vet developed crisp and rigid self -guidance on how to think of all the semi -recycling activities that can take place at an operating landfill: composting, white goods, electronics, C&0, waste oil, pesticides, etc. My point here being that several of the sub -sectors of the solid waste world may eventually be captured and crisply delineated in ourstormwater permitting program. But, the permitting of those sub -sectors will require a focused initiative that we don't have staff time to accomplish at the moment. In this case, absent a pressing threat to surface water, 1 would postpone the staff time expense necessary to carry out a thorough examination of the industry conditions and permitting needs for these developing co -activities at landfills. We can't do it right now, and this particular instance would not be a good test case in support of an expanded program. I guess what I'm saying in this bullet is because of all the relevant factors note above, 1 think we should have programmatic certainty if we were to continue to require NCG13 under the improved current conditions at this site, and we don't have that today. Even with the site deficiencies and uncertainties I note in the red -text photo notes above, I think our best path forward for this site is to rescind their coverage under NCG13. Prior to the SW transfer, Susan Wilson was working with Natalie. Natalie was instructed by both Susan and us to develop an SWPPP plan. I met with Natalie on March 7, 2014 to review her drafted SW PPP plan and discuss the site. During the meeting Natalie indicated that at this site, people bring in white goods/scrap metal and electronic goods for recycle. These goods are then sorted for pick up by recyclers. In addition she indicated that there is a grate/outlet (potential SW exposure) under the white goods/scrap metal collection container. This site is adjacent to a closed landfill, a school bus garage, and vehicle maintenance area (see attached site plan that Natalie provided in March). There's a lot going on out here, and I think a site visit is necessary to determine what operation, if any, is subject to SW permitting requirements. Natalie should clarify what activities are occurring at this site. On the form she indicates that no "processing of recyclable materials takes place." I recommend a site inspection prior to a decision on the rescission request. I will follow up with Ken regarding his discussion with Natalie. The illicit discharge has been identified and is in the process of being eliminated (this item is in reference to discharge fiom the transfer area as well as the floor drain in the vehicle maintenance area). The other outfalls have been identified as well. In the past, we did analytical monitoring in lieu of quantitative monitoring. In the future, per the schedule outlined in the permit, we will begin the quantitative monitoring of all outfalls identified in this response letter. For the elimination of the illicit discharge from the transfer station area that is not covered under this storm water permit see attachment "A", approval fi-om NCDENR Waste Management permitting Section, Larry Frost, on changes to storm water system at transfer station. Construction is to begin on May 20, 2013 and is expected to be complete within two weeks (weather permitting). The contractor has already been secured. The cost of the rerouting of the system is also being included in attachment "A". Basically, we are closing the storm water system off and routing it into the grit chamber which in turn goes into the pump station located on site and turning it into a closed leachate system for the transfer station area. We are placing accessible covers on the outside existing catch basins so that storm water will not enter and then constructing a berm at the base of the slope to direct storm water to a yard inlet behind the vehicle maintenance structure. which is for storm water only and is directed to the unnamed tributary. The drain itself has been sealed with cement so any fluid will not leave the drain in the garage area. The outfall associated with this garage Floor drain directed into the unnamed tributary will no longer be tested for analytical monitoring measures since it has been taken offline. In addition, the used oil containment (kept outside) by the vehicle maintenance area will be inspected weekly for leaks and also when the oil is removed by the contractor. The previous analytical monitoring is included as attachment "C" for your records. Trucks containing refuse are still parked in the same area but a leachate collection system was installed as part of the construction project. The leachate collection system is at the rear of the vehicles. A berm has been added to the stream side of the trucks to keep any leaks of leachate from migrating into the stream. Another precaution that has been implemented is buckets have been placed near the trucks so when a leak is noticed, the buckets can be placed under the leak until the vehicle can be moved. We constructed a shed to house all the equipment when not in use to keep out of the elements. See attachment "D" for photograph of shed. The follow up visit was for a visit from a visit on Monday of that same week with Manager Greg Wiggins. On the visit, Mr. Wiggins and Ms. Keller discussed the transfer station drain system being tied into what looked to be the stormwater system drains. Upon further review by Mr. Wiggins, it was found that Ms. Keller's assessment was correct. Mr. Wiggins drew up a sketch for Ms. Keller to review when she visited on Friday to review. I set in on the visit for Friday the 10th, and assisted in the discussions on the transfer station drains. Ms. Keller agreed the sketch looked as if it might be a good correction to the immediate issue of getting leachate into our stormwater system. She did suggest that the sketch be sent to the permitting branch to ensure that if a permit modification needed to be secured prior to work beginning we would be in compliance. As we discussed on the phone on Friday, I have drawn up a sketch that shows the new layout of the system as best as I can with old imagery. The surface water in question is at the bottom of photograph at the left corner and the stormwater system at this time is directly piped to outfall into the stream. This sketch has the system rerouted directly into the grit chamber the pipe that is directed into the stream will either be removed or will be capped off so as not to be used in the future. There is a yard inlet farther down on the right side of the blue berm that we are creating that has another direct pipe to the stream and it will be strictly stormwater. This should fix the imminent threat of leachate getting into our stowmater system which could get into the surface water on our site, which could leave out site. Please let me know if you need anything else to assess this sketch for compliance with permitting. We are ready to construct the minute your office gives us the clearance to go ahead. The areas will be maintained and cleaned out more frequently if needed. The grit chamber will be pumped out at a minimum once per month or more if needed. The erosion control bags placed down inside the curb inlets will be cleaned out and/or replaced as needed. c) Submit a Plan to the Section for review and approval that details contingency plans for leaking trailers; I, certify that the leaking trailers situation was immediately addressed. See Enclosure `B" for details of plan. The follow up visit was for a visit from a visit on Monday of that same week with Manager Greg Wiggins. On the visit, Mr. Wiggins and Ms. Keller discussed the transfer station drain system being tied into what looked to be the stormwater system drains. Upon further review by Mr. Wiggins, it was found that Ms. Keller's assessment was correct. Mr. Wiggins drew up a sketch for Ms. Keller to review when she visited on Friday to review. I set in on the visit for Friday the 10th, and assisted in the discussions on the transfer station drains. Ms. Keller agreed the sketch looked as if it might be a good correction to the immediate issue of getting Ieachate into our stormwater system. She did suggest that the sketch be sent to the permitting branch to ensure that if a permit modification needed to be secured prior to work beginning we would be in compliance. As we discussed on the phone on Friday, I have drawn up a sketch that shows the new layout of the system as best as I can with old imagery. The surface water in question is at the bottom of photograph at the left corner and the stormwater system at this time is directly piped to outfall into the stream. This sketch has the system rerouted directly into the grit chamber the pipe that is directed into the stream will either be removed or will be capped off so as not to be used in the future. There is a yard inlet farther down on the right side of the blue berm that we are creating that has another direct pipe to the stream and it will be strictly stormwater. This should fix the imminent threat of Ieachate getting into our stowmater system which could get into the surface water on our site, which could leave out site. Please let me know if you need anything else to assess this sketch for compliance with permitting. We are ready to construct the minute your office gives us the clearance to go ahead. During the inspections, it was discovered that trench drains, used to collect water that has contacted waste, were clogged and had overflowed, resulting in liquid flowing to unpaved areas and into surface water drains. NC DENR issued a Notice of Violation (NOV) on June 10, 2013, that requires steps be taken to come into compliance by July 1, 2013. Golder Associates NC, Inc. (Golder) has prepared this Soil and Surface Water Assessment Plan (Plan) to address item d) of the compliance schedule of the NOV, which states: d) Submit a Plan for review approval to the Section that details a proposed soil and surface water assessment for the regions potentially impacted by the clogged trench drains associated with the lower transfer bays and associated storm drains located outside the two lower loading bays Golder contacted Jaclynne Drummond of NC DENR on June 12, 2013, for clarification regarding the required components of the Plan requested in the NOV. The following Plan is based on criteria provided by Jaclynne Drummond and Andrea Keller of NC DENR. 2.0 SOIL AND SURFACE WATER MONITORING PROGRAM Soil samples and surface water samples will be collected from areas potentially impacted by liquid that escaped from the transfer station collection system due to the clogged trench drains. 2.1 Soil Sampling Locations Three soil samples will be collected from areas potentially impacted by liquid from the transfer station. The locations are shown on Figure 1. One soil sample location (Soil-2) is located adjacent to the stormwater drain identified as Area 3 in the Facility Compliance Inspection Report (FCIR). The second soil sample location (Soil-3) is adjacent to the stormwater drain identified as Area 4 in the FCIR. The third soil sample location (Soil-4) is in the grassy area downgradient of the stormwater drain in Area 4. Additionally, a background soil sample (Soil-1) will be collected in an area not anticipated to be impacted by the transfer station or landfill activities. The purpose of the background sample is to provide a measurement of the concentration of naturally occurring metals and/or background sources unrelated to the transfer station activities in the area of the investigation. 2.2 Surface Water Sampling Locations Figure 1 shows the location where the stormwater drains identified in Areas 2, 3, and 4 in the FCIR discharge into a surface water feature. Samples will be collected between 1 and 2 feet below ground surface (bgs) and placed into sample containers provided by the laboratory. The background sample (Soil-1) will be sampled first to minimize potential cross -contamination. After collection, the samples will be placed in a cooler on ice, under chain -of -custody control. Sampling logs will be recorded for each sampling location that includes a description of the sampling equipment, sampling location, soil characteristics, sampling method, and field observations. 3.2 Surface Water Sampling Methodology Surface water samples TSSW-1 and TSSW-2 will be collected by lowering the laboratory -supplied sample containers into the stream flow, taking care to prevent the overflow of the sample containers and to minimize sample -induced turbidity. Measurements of temperature, pH, specific conductivity, oxidation- reduction potential, dissolved oxygen, and turbidity will be recorded during the collection of the surface water samples. The downstream location (TSSW-2) will be sampled first, followed by the upstream location (TSSW-1) to minimize potential impacts to water quality at the sample locations. After collection, the samples will be placed in a cooler on ice, under chain -of -custody control. Sampling logs will be recorded for each sampling location that includes a description of the sampling equipment, sampling location, sampling method, field observations (e.g., estimated flow), and water quality measurements. 4.0 SOIL AND SURFACE WATER SAMPLE ANALYSIS PROCEDURE Soil and surface water samples will be shipped to a NC certified laboratory under chain -of -custody control, and samples will be analyzed for parameters required by the NC DENR, as described in detail in the following sections of the Plan. 4.1 Chain -of -Custody Program The chain -of -custody program includes sample labels, sample seal, field logbook, and chain -of -custody record. The seal is labeled with instructions to notify the shipper if the seal is broken prior to receipt at the laboratory. The field logbook (or individual sample logs) will contain documentation of the following: Sample identification; field meter calibration information, if applicable; date and time of collection; sampling sequence; types of sample containers used and sample identification numbers; preservative used; field analysis data and methods, if applicable; field observations; name of collector(s); and climatic conditions including air temperatures and precipitation. The chain -of -custody record is required for documenting sample possession, from the time of collection to the time of receipt at the laboratory. A chain -of -custody record will accompany each individual shipment. The record will contain the following information: Sample destination and transporter; sample identification numbers; signature of collector; date and time of collection; sample type; number of sample containers in shipping container; parameters requested for analysis; signature of person(s) involved in the chain of possession; inclusive dates of possession; internal temperature of shipping container upon opening in laboratory (noted by the laboratory). A copy of the completed chain -of -custody form will accompany the shipment and will be returned to the shipper after the shipping container reaches its destination. The chain -of -custody record will also be used as the analysis request sheet. 4.2 Soil Sample Analysis Procedure A laboratory certified by the NC DENR will be utilized for analysis of the soil samples. Analyses will be performed in accordance with USEPA SW-846 methods in accordance with the USEPA guidance document (USEPA, 1997). This is the reason for stating the 60 day from today needed to apply on the NCG130000 industrial stormwater permit. 3. On -Site vehicle maintenance is conducted in the garage by the transfer station. As we discussed, there is a floor drain that may or may not be discharging to the sanitary sewer (pump station) on -site. The Floor drain pathway should be identified/confirmed. As long as vehicle maintenance activities are conducted inside the garage and the floor drain is directed to the sanitary sewer, analytical monitoring associated with stormwater from this activity will not be required. Until that time, there is an area with roll-off/garbage collection (sitting below the convenience area) that should be identified. It would be beneficial to Flenderson County to prevent, as much as possible, direct conveyance of stormwater to the nearby tributary. Qualitative monitoring should be conducted at this area if there is no way to prevent the conveyance of stormwater to the tributary. Answer: Henderson County will modify this area to prevent the direct conveyance of stormwater to the nearby tributary. 5. It was noted during the inspection that the area of electronics collection, battery collection, etc. had some exposure (overflow from the covered area). This should be prevented as much as possible; otherwise this should be considered an outfall for qualitative monitoring. This Division understands that this area will also be moved after completion of construction. Answer: The electronics are has been relocated into the existing convenience center. This relocation is temporary. /t will be relocated into the new convenience center currently corder construction. All electronics will be kept wider the current blue building. Henderson County will consider purchasing a new Shed to locate electronics, batteries, etc under to keep them out of the weather. Henderson County request that DWQ allow us to postpone the purchase of such Shed until the move is complete. We do not know how large an area we will have dedicated to electronics until the area is complete. Also, it is virtually impossible to relocate a shed once it has been set in place without severe damage to the structure. As discussed during the inspection, sediment loss was noted from the new construction area. The original in -line basins (likely constructed with the original landfill site, that is now closed), appeared to be full of newer sediment; likely, there are also impacts to the surface waters upstream of these basins. After the site is stabilized, a follow-up inspection will be conducted to fully determine that potential impact and determine a course of action to restore the surface waters. This area should be monitored and sediment should be prevented from migrating beyond the in -line basins. Henderson County Engineering Answer: The basin bus been cleaned out and will be continually cleaned out as needed. Based on our inspection, we agree that the stormwater exposure of the process is minimal and that the permit can be rescinded. Natalie Berry of Henderson County was our on -site contact during the inspection. Note that since the issuance of the permit in 2011, capital improvements have been made including the installation of a new convenience center where recyclables are dropped off for separation and pickup by recylers and separation of the leachate collection system from the stormwater system. The following areas (with associated comments) were inspected. Convenience Center - This center is new and was noted as being clean with potential stormwater exposures minimized or not significant. Natalie indicated that they sweep this area, usually daily. Used oil collection, cooking oil collection, battery collection, used diesel/keroseefcollection, and electronic collection areas are all under a shed with sedondary containment. However we did note same drums and car batteries outslde on pallets. Natalie was instructed that these should be moved under cover, and during our inspection the batteries were moved under the shed roof. She indicated that they would move all drums under roof, even if they had to extend the shed roof. This is a BMP and Henderson County was reminded to maintain this BMP. The electronics wrapping area is not under cover, but this appears to be a low -risk activity with respect to stormwater exposure. Once wrapped, the electronics are stored in the back of a semi -trailer (for pick-up). The Whitegoods collection area (including the bin) is not undercover, but appears to be a low -risk activity with respect to stormwater. Freon is removed prior to binningtheseitems. Commerical Recylers area - This is the area where commercial recyclers deliver their materials. The collection bins have sloped drains underneath each that collect any leachate from the bins, and this is piped to the leachate collection system (which goes to a sanitary sewer/treated). Transfer Station - previously the recycle area was here, however this has been moved to the new convenience center (see above comment). This area is covered with three enclosed sides. In response to a DWM inspection (May 10, 2013) which discovered that the leachate collection system from this area was tied into the stormwater system (violation), the county . converted the stormwater system into the leachate system as part of the required corrective actions. This area is permitted by DWM and the leachate is pumped to a sanitary sewer for treatment. With the new leachate collection system, exposure of the leachate to stormwater has beery addressed and exposure of the transfer operation to stormwater has been - minimized. Vehicle Maintenance Area (adjacent to the Transfer Station) - We noted two drums outside that appeared to contain used oil filters and used oil or antifreeze. There was some spillage noted around the drums. We instructed Henderson County to move ALL drums In the building to prevent this type of potential exposure and to dean up the area where the spill was. Nagle agreed that they would do this. An Illicit discharge previously discovered has been addressed (drain in floor has been eliminated). The crew was washing equipment at the time of the inspection. This practice should be reviewed by Henderson County and exposure to the stormwater drains limited, or potentially an NPDES wastewater permit review of this process may be necessary. Fuel Station -Two above ground off -road diesel tanks and one gas tank were observed. Henderson County was reminded that they must follow the Spill Prevention, Control and Countermeasure Plan (SPCC) Program for these tanks.
