Box 17177 Chapel Hill, NC 27516-7177 Subject: Orange County Landfill NPDES STORMWATER PERMIT NCG120065 NPDES CONSTRUCTION STORMWATER PERMITNCG010000 Orange County Dear Mr Dively: On December 6„ 2013, Dave Parnell from the Raleigh Regional Office of the North Carolina Division of Energy, Mineral and Land Resources (DEMLR) conducted a compliance evaluation inspection (CEI) at the Orange County Landfill, located at 1514 Eubanks Road in Chapel Hill, North Carolina. The facility lies in the watershed of an unnamed tributary (UT) to Old Field Creek, Class WS-V, NSW waters, in the Cape Fear River Basin. The following observations were noted during the NCG 120065 DEMLR inspection: This facility is a MSW and C&D Landfill, owned and operated by Orange County. Your assistance during the inspection was appreciated. The inspection began in the Solid Waste Management office, where a thorough review of qualitative and analytical monitoring results was conducted. There were no obvious omissions or errors noted during the review. A Stormwater Pollution Prevention Plan (SPPP) is not required by the NCG12 permit. Following the monitoring review, we visited the Stormwater Discharge Outfalls (SDO). The monitoring points were observed and found to be the proper locations for monitoring. The following observations were noted during the NCG 010000 DEMLR inspection: The rainfall recording device was discussed and the records were reviewed. All were compliant with the NCGO1 permit requirements. The erosion control devices were observed during the tour of the facility, as were the outfalls. The landfill was found to be in compliance. Mr. Mike Meagher was very helpful during the inspection and 1 greatly appreciated his assistance. Accordingly, the following observations were noted during the Division of Water Quality inspection 1) The site was in compliance with the permit the day of the inspection. 2) However, the facility must complete the requirements of Tier One in the NCG120000 permit in response to benchmark exceedances seen during December 2008 sampling event for Fecal and TSS at both the active MSW and active C&D outfalls. Please see the attached TIER ONE requirement and ensure TIER ONE response was completed and documented as required. 3) Photos were taken during the inspection, but no stormwater flow, overflows or discharges were observed the day of the inspection. Please review the attached Compliance Inspection Report and photos taken during the inspection. Thank you again for your assistance and cooperation during this inspection. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000.00 per day for each violation. However, the facility must complete the requirements of Tier One in the NCG120000 permit in response to the benchmark exceedances seen during the December 2008 sampling event for fecal and TSS at both the active MSW and active C&D outfalls. Outfalls Observed: -New C&D stormwater basin (designed for 25 year storm) was dry the day of the inspection- no discharge. This outfall eventually flows to Duke Forest. -The landfill accepts portland cement /construction debris that is sprayed nightly and covered weekly. -The active MSW stormwater basin was not discharging the day of the inspection, but full observation of the outfall was hindered by fencing. It is recommended that a gate be installed to allow complete access to the outfall. The old MSW landfill was closed in 1995. The old C&D landfill was closed in 2005. -A leachate collection system was installed where the "closed leachate pond" was located, and the leachate is sent to the OWASA Collection System. -A stormwater pond by a borrow area/wood waste collection area was observed, but the volume was not overflowing/discharging the day of the inspection. The borrow area/wood waste collection area did not have any wood waste or borrow material stored at the time. Some erosion and rilling of banks was present, but sediment movement to the pond was not apparent, and most of the area has a vegetative cover. UNC has an on -going project aimed at capturing the methane gas at the landfill for use as an energy source. Installation of the piping to capture the gas was not yet complete the day of the inspection. Vehicle maintenance is done near the site, but covered by Orange County Government as separate garage from the landfill. The garage has not been considered as part of the Landfill permit. Further research into the status of the garage and any permit requirements relating to it, needs to be done. It was noted that the facility is not using more than 55 gallons of new motor oil per month, but a large storage building of bulk petroleum products is located at the garage. The building has secondary containment and would fall under federal SPCC requirements. The compliance refers to requiring a Stormwater Pollution Prevention Plan which is not a requirement of this permit. The corrected compliance language that should go under Part III, Section A: 1. is shown below. We have also attached a new page reflecting this change for your permit file (Part III page 1 of 11). This new page should replace the current page in your permit. Mr. Mike Meagher was very helpful during the inspection and I greatly appreciated his assistance. A Construction Stormwater General Permit (NCGO10000) is issued upon the approval of an Erosion and Sedimentation Control Plan. This permit applies to projects that receive a Division of Land Resources (DLR) (or local delegated program) Erosion and Sedimentation Control Plan for land disturbance of 1 acre or greater. Specifically, the General Permit (NCG010000) authorizes the discharge of stormwater under the National Pollutant Discharge Elimination System (NPDES) in accordance with Title 15A North Carolina Administrative Code 2H.0100. Accordingly, the following observations were noted during the Division of Water Quality inspection 1) Approved Plan (Part I, Section A: No. 2.) A copy of the approved Erosion and Sediment Control Plan must be maintained on site and available for review. The facility was in compliance as required. The site has an E& SC for capping the old landfill site and an E& SC plan for construction activities on -going at the new landfill sites. Joel Idol with DLR indicated the site was compliant with the E&SC plans. 2) Rain Gauge (Part 1. Section B. No. 1.) A rain gauge was observed on -site the day of the inspection. 3) Rain Gauge Data (Part I. Section B. No. 1.) Rain gauge data, was measured and recorded and available for review. No. 3) Inspection records are required of erosion & sedimentation control measures and stormwater discharge outfalls, collected weekly and after every half' inch or greater rain event, and available for review. If no rain, this should be noted in the inspection records to verify the reason the facility was unable to sample. Copies of the NCGO10000 records were reviewed and January 2009 to August 2009 are attached. Other Observations: No water quality issues were observed the day of the inspection.
