Dear Mr. Holley,
On behalf of the Upper Piedmont Regional MSW Landfill, Republic Services is transmitting a
Discharge Monitoring Report in response to the Tier II activities required for fecal coliform at
Outfall 003 at the referenced site. This is the second consecutive monthly sample for fecal
coliform at Outfall 003 that is below the benchmark value.
Based on the analytical results from the past two months and the information previously
provided by letter dated December 27, 2013 (copy attached), Republic Services requests the
cessation of monthly sampling for fecal coliform from Outfall 003 on a monthly basis. -

I received your voice mail message with information about our Representative Outfall request and our
Fecal Coliform sample results. I have attached the December 2013 and January 2014 DMR per your
request. You will see on the January report that there is an updated summary of the analytical results
from our outfalls. Outfall 003 has had 2 consecutive months with fecal coliform below the threshold
value (224 in December and 99 in January). I will forward results from February sampling when they
are available.
We have not performed any remedial measures at Outfall 003. However, we have changed our
sampling technique so that we collect a water sample from a higher elevation within the water
column. Under the old technique, we collected a sample at the bottom of the water column (i.e., near
the floor of the stream). Now, we are collecting the sample higher in the water column.
From your message, I understand that you will not render an answer to our requests until you review
the February results. We look forward to receiving your answers.

Dear Mr. Holley,
On behalf of the Upper Piedmont Regional MS W Landfill, Republic Services is requesting to
cease sampling for fecal coliform from Outfall 003 on a monthly basis in accordance with the
Tier II requirements under General Permit NCG120000. This request is made following an
inspection of the site by Mr. David Parnell with the Land Quality Section on December 17, 2013.
During the site inspection, Mr. Parnell observed the stormwater basin upstream of Outfall 003
and confirmed that there was no industrial activity occurring in the drainage area leading to
Outfall 003. A summary of the analytical results from the site's outfalls from 2010 is attached
for reference. In addition, a site map depicting the outfalls is attached.
While unconfirmed, the source of the elevated fecal coliform results is likely caused by wildlife
activity (both birds and animals) in the area surrounding Outfall 003. It is our opinion that the
activities associated with the landfill are not causing the elevated results, and request that the site
be allowed to cease the Tier II requirements.

As shown on the attached site map, Sediment Basin No. 2 receives stormwater runoff from the
active portions of the municipal solid waste (MSW) landfill and Sediment Basin No. 1 receives
stormwater runoff from the inactive (but not permanently closed) portions of the MSW landfill.
As such, the stormwater discharges from these two control measures are substantially identical.
Likewise, Sediment Basin No. 4 receives stormwater runoff from the active borrow area that is
excavated for soil cover material and Sediment Basin No. 3 receives stormwater runoff from the
inactive borrow area. As such, the stormwater discharges from these two control measures are
substantially identical.
If granted representative status, the facility will perform the analytical monitoring requirements
in accordance with Section B of General Permit NCG 120000 at Outfall 2 and Outfall 4. which
receive stormwater runoff from active portions of the site.
In addition to this request for representative outfall status, we would like to discuss the analytical
results for fecal coliform. As shown on the attached summary of analytical data, fecal coliform
concentrations exceed the Threshold Value at differing outfalls at differing sample times. In
fact, the analytical data do not show any correlation between fecal coliform and any other
analytical results (e.g., fecal coliform results at Outfall 3 are 30 and 2.500 when TSS results at

If a facility is required to sample multiple discharge locations with very similar stormwater discharges, the
permittee may petition the Director for Representative Outfall Status (ROS). DWQ may grant Representative
Outfall Status if stormwater discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply.

being made after consultation with Mr. Bradley Bennett and Mr. Ken Pickle with the NC DENR

We received your letter on August 10, 2007, regarding your Compliance Evaluation Inspection of our
Upper Piedmont Landfill. Your letter requests a response within 15 days to identify the non-stormwater
discharge flowing continuously at Stormwater Discharge Outfall # I. Your letter also requests that we
review Part VI, (3.) - Allowable non-stormwater discharges. Please consider this letter as our response to
your requests.
Upon receipt of your letter, our site manager performed an inspection around and upgradient of Sediment
Basin # 1 to determine if there were any non-stormwater flows entering the basin. No flows into the basin
were identified.
Our basins are designed with a riser pipe, which has perforated holes within 3-inches of the base as shown
on Drawings I and 2 (attached). These holes, by design, will allow discharges during dry periods. Most
of the water contained within our sediment basins is expected to be a result of stormwater-related events,
although some groundwater recharge to the pond may also occur. The overflows, as mentioned in your
inspection summary, are designed only for use during heavy storm events when capacity within the
sediment basin is near peak. The overflow is generally set 2 feet below the perimeter berm to prevent
overtopping of the berm. To be clear, it is the holes within the riser pipe that perform most of the basin
dewatering. This allows stormwater to be released slowly over time, preventing quick flushes during
storm events.
After reviewing, Part VI, (3.), we are confident that our discharge is directly related to stormwater and/or
groundwater recharge to the basin and is not a non-stormwater discharge.
It was unclear from your letter what the purpose of your field and analytical sampling was and to what
conclusion you were leading based on the results. Your results indicated that the level of manganese
(Mn) at our site was present but below stream standards, yet downstream the level of Mn exceeded the
stream standard. You also mention that iron (Fe) was present and a layer of sheen was present at the
downstream location. Your report also mentions that dissolved oxygen was low at 2.8 (at Sediment Basin
# 1) and 0.96 (downstream location). Your statement that, "The origin of the metals, and the cause(s) of
the harm to the stream would require further sampling and data analysis," concerns us and we would like
further clarification on the potential impacts of these results.

In response to these statements and to protect our interests, we contracted with a third party consulting
firm, Golder Associates NC, Inc. (Golder), to perform sampling from the outfall of Sediment Basin #1
and attempt to collect a sample from the bridge crossing at Range Road and Clayton Road. In addition,
Golder was contracted to collect a water sample from inside sediment basin # I as well as a soil sample
from an upgradient location to Sediment Basin # 1. Each of the water samples were to be analyzed for the
metals that were detected during your sampling, as well as similar field parameters. Results were
examined to help determine potential downstream constituent concentrations that may be attributable to
the site and/or naturally occurring conditions.
Golder's report is attached to this letter for your reference. In this report you will note that due to dry
conditions, no flowing water was observed in Cub Creek at the time of their sampling and therefore no
sample could be obtained. However, some of the results for the surface water samples that Golder
obtained from the site were different than those collected during your site visit. In particular, the
dissolved oxygen readings were significantly different and more typical of surface water values. Only
one constituent of concern (Mn) was detected above the applicable surface water standard in the Sediment
Basin # I outfall sample during the Golder sampling event. Based on the evaluations in the Golder report,
the Mn concentration in the outfall sample may be biased high given the (naturally occurring)
concentrations of Mn detected in the soil sample collected on site and the turbidity noted for the outfall
sample. Moreover, the concentrations noted for surface water samples collected from the site are much
lower than those noted in the Cub Creek sample collected in June and it is possible that another off site
source may be contributing to the elevated Mn and Fe concentrations noted in Cub Creek.

As requested, Golder Associates NC, Inc. (Golder) is submitting the analytical results for surface
water and soil samples collected at Upper Piedmont Regional Landfill on August 20, 2007.
Surface water samples were taken from Sediment Basin # 1 and its outfall. An attempt to collect
a sample from Cub Creek was made; however, the stream had no flowing water at the time of
sampling. A soil sample was also collected on site upgradient of Sediment Basin #1 from
approximately 6 inches below ground surface. Samples were collected in pre -preserved bottles
and stored immediately in a pre -chilled cooler. Field parameters including pH, specific
conductance, turbidity, temperature, dissolved oxygen and oxidation reduction potential were
collected for both water samples using a field -calibrated Horiba water quality meter. The
samples were shipped to Environmental Conservation Laboratories (ENCO) of Cary, North
Carolina under chain -of -custody control to be analyzed for aluminum, barium, calcium, iron,
magnesium, manganese and sodium. These parameters were selected based on the fact that they
were detected previously in the pond discharge and Cub Creek samples collected on June 16,
2007, by personnel from the North Carolina Division of Water Quality (DWQ).
As presented, all of the analyzed parameters except barium were detected in the two surface
water samples. In general, the concentrations of detected constituents were similar to previous
results with the following exceptions. Barium was not detected during the August event for
either the pond or discharge sample. Reported aluminum and iron concentrations were lower for
the discharge sample during this event than those reported for the June event. Manganese
concentrations were slightly higher for the discharge sample and are above the applicable surface
water standard. However, the results may be biased high due to potential leaching of manganese
from sediments as high turbidity was noted for the August sample. Dissolved oxygen

concentrations were also significantly different during this sampling event. The concentrations
detected in the pond and its discharge were 8.9 and 10.1 milligrams per liter (mg/L),
respectively, as compared to 2.8 mg/L reported for the discharge during the June sampling event.
The results of soil sampling indicate that all selected analytes are present in the soils at the site
and are assumed to be naturally occurring. Concentrations in the soils are generally similar to or
greater than those detected in the surface water samples. The exceptions to this are calcium,
magnesium and sodium, which were detected at lower concentrations in the soil sample or not at
all in the case of sodium.
Although no sample could be obtained from Cub Creek during the August sampling event, the
following observations can be made. The concentrations of iron and manganese detected during
the June sampling event in Cub Creek were considerably higher than those detected on site.
Therefore, it is possible that there may be another off site source contributing to the increased
concentrations of iron and manganese noted downstream of the site. There were no metals of
concern detected at concentrations above their respective surface water standards, with the
exception of manganese in the discharge sample, during the August 2007 sampling event. The
concentration of manganese is still considerably lower than that detected downstream during the
June event. It should be noted that due to the significant difference in dissolved oxygen
concentrations detected between the June and August sampling events, the dissolved oxygen
readings from June should be considered suspect and documentation of field meter calibration
should be requested from the DWQ. The dissolved oxygen concentrations detected during the
August sampling event are more typical of surface water values. Soil sampling results indicate
that in general the parameters detected in surface water could be attributable in part to naturally
occurring concentrations in the soil. Specifically, the two metals that were detected above their
respective standards in surface water samples were detected at similar or higher concentrations in
the soil sample.

On June 16, 2007, Vicki Webb and Autumn Hoban, of the Division of Water Quality, Raleigh Regional Office, performed
an inspection of the subject facility. The following items should be addressed:
1.) Identify the non-stormwater discharge that is flowing continuously at Stormwater Discharge Outfall #1 and report
the findings to the Division of Water Quality within 15 days of receipt of this inspection letter. Please review Part VI,
(3.) Allowable non-stormwater discharges.
As part of the inspection, sampling was conducted in the unnamed tributary to Cub Creek at the entry location of the water
flow from Stormwater Outfall #1. Samples were also collected in Cub Creek at the Range Rd/Clayton Rd Bridge. All lab
results are attached and the observations are noted in the Summary Comments of this inspection report. It is our goal to
insure the quality of the surface waters of this State.

Inspection Summary:
This facility accepts industrial wastes: oil and petroleum contaminated soils (less than or equal to 3000 PPM), as well as,
water and wastewater sludges.
There is currently no requirement for the SWP3 at landfill sites.
The NCG 120000 and the NCG010000 permits were on -site as required.
Some vehicle maintenance is performed on -site. A Contractor performs maintenance as needed, but none was being the
conducted the day of the inspection, and no signs of spent or spilled fluids were observed.
The qualitative and analytical monitoring records were reviewed and the facility is in compliance with the monitoring
requirements of the permit.
There were three stormwater outfalls observed the day of the inspection. The #2 and #3 Stormwater Outfalls were dry
and the stormwater pond levels for #2 and #3 were below the overflow. The #1 Stormwater Outfall (By cell #3) has a
continous flow of water discharging into the un-named tributary on -site that connects to Cub Creek. The stormwater pond
connected to this outfall was not overflowing the day of the inspection and has been below the overflow level due the lack
of rainfall received this year. The discharge appears to be a non-stormwater discharge.
Grab samples were taken where the #1 Stormwater Discharge flows into the un-named tributary of Cub Creek. The
sample results are attached. The facility should idenflfy the origin of the continous discharge, as it did not appear to be
stormwater from the stormwater pond, and promptly report the findings to the Division of Water Quality. Sample results
indicated Mn, Fe, and At were present, but not at levels exceeding stream standards. The Dissolved Oxygen was low at
2.8.
It should be noted that results from grab samples taken in Cub Creek at the nearby Range Rd/Clayton Rd Bridge also
indicated the presence of Mn, and the level did exceed the stream standard. Fe was present and a layer of sheen was
present on the surface of the water at this location. The Dissolved Oxygen was extremely low at 0.96. The sheen had
the appearance of Iron Bacteria and/or Organic Decomposition. The origin of the metals, and the cause of "impaired-state—
¢f,the stream" would require further sampling and data analysis.

water, with some sheen present. The stormwater pond connected to this outfall was not
