In your letter received on 7/25/2006, you stated that there are no point source discharges of stormwater at your facility. In accordance with your request, NPDES General PerinitNCG100148 is rescinded, effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES Penn it coverage. What we need is some kind of request from the owners (a letter, e-mail, etc.) requesting a recision of their permit, NCG100148. (Our rules really require some sort of request from the owner to do this.) The letter can state they do not qualify for this permit because there are no point sources of stormwater discharge from the property. It can be sent to you, and you can forward it with your okay to Sarah Young's attention in our branch --or, they can send it directly to us (to Sarah's attention), and I'll make sure she has the copy of our correspondence with the ARO in the permit folder. The facility was found to be deficient with regard to permit NCG100148. You will need to prepare and implement a site specific Stormwater Pollution Prevention Plan (SPPP) in order to be in compliance with your permit. Per our discussion, the following items will need to be addressed so that a follow-up inspection can be performed. Mr. Synder o May 16, 2006 Page 2 of 2 During the inspection, an hour and a half were spent looking at the site, discussing the requirements of the permit, development of the stormwater pollution prevention plan (SPPP), preparation of a site map and monitoring, as well as, clean-up activities. Please refer to the notebook, reference materials and diskette provided for detailed assistance. As a reminder, stormwater runoff from the discharge points must be sampled as required in your permit (NCG100148 Part II page 4 of 6). Please prepare a site map and identity the location of each potential discharge point. Be sure to request 'representative outfall status" before sampling so that only one discharge point will have to be sampled, if desired. Qualitative monitoring must be performed twice per year, once in the spring (April -June) and once in the fall (September — November). The first qualitative monitoring event during the coverage of the permit must coincide with the initial analytical sampling event. Details of qualitative monitoring requirements can be found in Part II page 6 of 6 of NCG100148. Qualitative monitoring must be performed at each stormwater discharge outfall, regardless of representative outfall status: The effective date of your permit is May 9, 2003 until August 31, 2007. The' last year of your permit cycle is August 31, 2006 through August 31, 2007. Analytical monitoring is required to be performed during the first and last year of the permit, unless cut-off limits are exceeded. Please submit the analytical results for the last year of the permit cycle with your permit renewal. You will receive a notice for permit renewal that will be due 180 days prior to the expiration of your permit. The deadline for renewal will be February 28, 2007. There is no fee for renewal. There is an annual administering and compliance fee of $80. Please pay this fee within 30 days after being billed by the Division.
