National Pollutant Discharge Elimination System application for exclusion from a Stormwater Permit based
on NO EXPOSURE:
Submission of this No Exposure Certification constitutes notification that your facility does not require a
permit for stormwater discharges associated with industrial activity in the State of North Carolina because
it qualifies for a no exposure exclusion. A condition of no exposure at an industrial facility means all
industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to
prevent exposure to rain, snow, snowmelt, and/or runoff.
For permitted facilities in North Carolina, DEMLR must approve your application for No
Exposure Certification before this exclusion is effective. Until you are issued a No
Exposure Certification and your NPDES permit is rescinded, your facility must continue
to abide by the terms and conditions of the current permit.
Industrial materials or activities include, but are not limited to: material handling equipment or activities,
industrial machinery, raw materials, intermediate products, by-products, final products, or waste products.
Material handling activities include the storage, loading and unloading, transportation, or conveyance of
any raw material, intermediate product, final product or waste product. A storm resistant shelter is not
required for the following industrial materials and activities: drums, barrels, tanks, and similar containers
that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means
banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained
vehicles used in material handling; and final products, other than products that would be mobilized in
stormwater discharges (e.g., rock salt).
A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In
addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual
outfalls. If any industrial activities or materials are, or will be, exposed to precipitation, the facility is not
eligible for the no exposure exclusion. By signing and submitting this No Exposure Certification form, you
certify that a condition of no exposure exists at this facility or site and are obligated to comply with the
terms and conditions of 40 CFR 122.26(g).
If approved, your conditional No Exposure Exclusion has no expiration date
BUT MUST BE self re -certified at least annually.

I certify under penalty of law that I have read and understand the eligibility requirements for claiming a condition of "no
exposure" and obtaining an exclusion from NPDES stormwater permitting.
I certify under penalty of law that there are no discharges of stormwater contaminated by exposure to industrial activities or
materials from the industrial facility or site identified in this document (except as allowed under 40 CFR 122.26(g)(2)).
I understand that I am obligated to maintain no exposure conditions and complete a Self -Recertification form at least once
each year, and if requested, provide this certification to the operator of the local municipal separate storm sewer system
(MS4) into which the facility discharges (where applicable). I understand that I must allow the North Carolina Division of
Energy, Mineral, and Land Resources, or MS4 operator where the discharge is into the local MS4, to perform inspections
to confirm the condition of no exposure and to make such inspection reports publicly available upon request. I understand I
must keep a copy of annual re -certifications on file at the facility.
In the event that the site no longer qualifies for a No Exposure Exclusion, I understand that I must obtain coverage under
an NPDES permit prior to any point source discharge of stormwater from the facility. Additionally, I certify under penalty of
law that this document and all attachments were prepared under my direction or supervision in accordance with a system
designed to assure that qualified personnel properly gathered and evaluated the information submitted. Based on my
inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is to the best of my knowledge and belief true, accurate and complete. I am aware
that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for
knowing violations. -

NCDEQ Regional Office prior to issuance. The Regional Office may inspect your facility for
compliance with no exposure conditions prior to that approval. The Regional Office may also
inspect vour facility at any time in the future for compliance with the No Exposure Exclusion.
North Carolina General Statute 143-215.6 B(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other
document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false
statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly

The site is no longer conducting vehicle maintenance and has installed covered dock bays to limit exposure to stormwater.
Mr. Kevin Olsen stated that no other vehicle maintenance is being conducted on site.
I recommend rescission of the permit.

The rescission request form may be somewhat confusing since we ask the permittee to list the address where they'd like their

Inspection Summary:
Spoke with nancy Bowmont. She is the environmental contact when Joseph Stearns is out. We discussed their proposal
for handling vehicle wash water on site. They will utilize the wash water as dust depressant in their gravel lot and use
wash water for vegetative irrigation. They will monitor the discharge during the times they are irrigating with the water.
The stormwater pollution prevention plan will be updated to incorporate this practice. Given the Governor's ok to irrigate
with grey water, this should not pose any threat to surface waters of the state.

general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area

The North Carolina Division of Water Quality conducted a site visit of the FedEx Ground Package
System, Inc. facility at 2414 North 23rd Street, Wilmington, North Carolina on May 7, 2008. The Division of Water
Quality Stormwater Per Unit had requested a site visit in response to a notice of intent from Fed Ex Ground
Package System, Inc. for coverage under the NC General Permit NCG080000.
The contract vendor providing vehicle washing service was on site at the time of the inspection and was
pumping water from the wash bay via a sump pump to the stormdrain. The discharge was foamy indicating the
presence of surfactant/soap. The discharge was immediately discontinued upon notification that it was an illegal
discharge.
The Wilmington Regional Office has concerns regarding the present plan being utilized at this facility to
manage the wastewater. The vendor does not have a storage tank of sufficient volume to handle the contents of
the wash bay requiring several trips from the disposal site to the facility. The disposal site is the vendor's lawn,
which poses other concerns about improper disposal of wastewater. The wash bay is not protected from
stormwater. When wastewater mixes with stormwater, all become wastewater requiring proper disposal. It is not
evident that a good plan exists to handle the wash bay wastewater. Please provide this office with a written plan
demonstrating that disposal of washwater and contaminated stormwater will be provided and that no discharge
will ultimately occur from this wash bay at any time to the nearby stormdrain. Your response should be sent

compliance with the conditions and limitations specified in NPDES Permit No. NCG080817.

Inspection Summary:
During the site inspection, the vehicle washing contractor was on site pumping from the wash bay containment area to a
stormdrain within a couple feet away. The discharge was foamy indicating the presence of surfactants/soap. The facility
manager was present during this inspection and both (contractor as well) were instructed not to discharge any of the
washing bay's contents to the stormdrain at any time. The contractor thought, that since the water in the wash bay was
from a rain event, the discharge would be considered rain water. After conversing with the contractor, it was learned that
the vendor is supposed to dispose of the wash water left in the bay after washing activities are complete. However, the
storage lank for wash water in his vehicle is not large enough to accomodate the disposal of all the washwater making it
necessary for him to make several trips. The vendor disposes of the wash water on his lawn. Any residual washwater left
in the bay can comingle with rain water creating a difficult situation with discharging that water as rain water. The
permittee was asked to remedy the problems associated with this situation in an expedient fashion. It does not appear
that the current practice is a good long term solution.

Comment: This site has a wash bay on the backside of the property in the paved
area. A vendor comes on site to wash the trucks in the bay. The vendor vacuums the
washwater into a holding tank (not large enough to hold all of the wash water
generated), requiring several trips to the site for disposal. During the inspection the
vendor was pumping rainwater from the wash bay into the nearby stormdrain. The rain
water had residual soap in it evidenced by a foamy discharge. The vendor was asked
to discontinue the discharge. It was recommended that washing take place under roof
and or disposal to the sanitary sewer would be the best solution long term. A follow up
call will be made to the permittee to discuss their resolution for this problem.

Comment: This site has a wash bay on the backside of the property in the paved
area. A vendor comes on site to wash the trucks in the bay. The vendor vacuums the
washwater into a holding tank (not large enough to hold all of the wash water
generated), requiring several trips to the site for disposal. During the inspection the
vendor was pumping rainwater from the wash bay into the nearby stormdrain. The rain
water had residual soap in it evidenced by a foamy discharge. The vendor was asked
to discontinue the discharge. It was recommended that washing take place under roof
and or disposal to the sanitary sewer would be the best solution long term. A follow up
call will be made to the permittee to discuss their resolution for this problem.
