Lake Park Blvd. Carolina Beach, North Carolina 28428 Subject: NOTICE OF VIOLATION NOV-2009-PC-0964 Town of Carolina Beach Garage NPDES Permit No. NCG080667 New Hanover County Dear Mr. Owens, Dee Freeman Secretary On November 24, 2009, Linda Willis from the Wilmington Regional Office of the Division of Water Quality, conducted a site inspection for the Town of Carolina Beach Garage located at 304 Dow Road in Carolina Beach, New Hanover County, North Carolina. This site was issued an NPDES Stormwater General Permit (NCG080667) on November 1, 2007. The permit requires a written Stormwater Pollution Prevention Plan within 12 months of receiving coverage under the General Permit. The permit also requires qualitative and quantitative monitoring of stormwater discharges from the site. Failure to follow your permit requirements is a violation of North Carolina General Statute 143-215.1(a). The following permit condition violations were noted during the Division of Water Quality inspection: 1) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) has not been developed, recorded, and properly implemented. 2) Qualitative Monitoring Qualitative monitoring has not been conducted and recorded in accordance with permit requirements. 3) Analytical Monitoring Analytical monitoring has not been conducted and recorded in accordance with permit requirements. Other Observations: An area on site had oily asphalt stored on a concrete pad with no containment around it. It was t marginally covered by a tarp but was not protected from stormwater exposure. Recommendment is to store that material in 55 gallon drums for proper disposal or someother area that provides secondary containment. Best solution is not to allow oil contaminated debris to be in contact with stormwater, otherwise a wastewater will be generated and require proper disposal. Governor Brian Stanberry Town of Carolina Beach Garage 304 Dow Road Carolina Beach, North Carolina 28428 Dear Mr. Stanberry, NC®ENR Department of Environment and Natural Resources November 25, 2009 Subject: NPDES Compliance Inspection Town of Carolina Beach Garage NPDES Permit No. NCGO80667 New Hanover County Dee Freeman, Secretary An inspection of the Town of Carolina Beach Garage facility on Dow Road was conducted on November 24, 2009. This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES Permit No. NCGO80667. Mr. William Raymond accompanied me at the site to accomodate the inspection. One immediate area of concern that requires attention is the concrete pad on which oil contaminated asphalt is sitting and exposed to the elements. Please provide adequate containment for this material. Be advised, any oil sheen to surface waters constitutes a water quality violation. It would be prudent to avoid any contact with rainwater, otherwise a wastewater will result which will require proper disposal. An oil fact sheet is enclosed for your information. Permit NCGO80667 was issued on 11/01/2007. A written Stormwater Pollution Prevention Plan is required within 12 months of receiving the General Stormwater Permit. Please provide copies of any analytical and qualitative monitoring conducted at this site, employee training records, and a copy of the Stormwater Pollution Prevention Plan. If you cannot produce the requested records, please provide in writing to this office, the reason for not complying with the permit requirements and a time schedule for when you will begin the proper monitoring, training and develop a written Stormwater Pollution Prevention Plan in accordance with the permit requirements. You must comply with the applicable terms and conditions of this Stormwater Permit, or be subject to enforcement by the Division of Water Quality for any violations of the permit.
