On 03/21/2013, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG080140. In accordance with your request, Certificate of Coverage
Number NCG080140, is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Dear Mr. Pelletier
On March 25, 2019, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral,
and Land Resources (DEMLR), conducted a compliance evaluation inspection for Pelton Aggregates Hwy
421 Facility located on 3440 US Hwy 421, New Hanover County, North Carolina.
The following observations were noted during the DEMLR inspection (please see the attached
addendum for additional information about your permit):
A NPDES industrial Stormwater permit has not been applied for coverage by Pelton Aggregates
Incorporated or Wilmington LandCo, LLC Please submit the enclosed Notice of Intent to this office.
Upon approval, the following permit requirements must be complied with:

Site was being cleaned up of concrete waste by another company, since removed from site. Felton Aggregates has moved
in. Previously, new material was not brought onto site. New material is now being brought onto the site.
The site is owned by Wilmington Landco, LLC; which is managed by Waste Industries.
The site is operated by Felton Aggregates Incorporated.
The site has an erosion control plan with New Hanover County, but that permit is held by Wilmington Landco, LLC.
The site discharges to a mine site which discharges to the Northeast Cape Fear River.
