On 8/18/201 1, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG080030. In accordance with your request, Certificate of Coverage
Number NCG080030 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of Stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

As a part of Rescission request, I visited NC Electric Membership Corporation — Buxton Generating Station (NCG080030)
facility on Wednesday, November 2, 2011 and met with the Facility Manager Mr. Paul Fly.
My general impression is that this is one of the cleanest facilities I have ever visited. The facility (over 20 years old) is in
excellent shape. All power generating process is located under the roof, with only switch yard and diesel tank located
outside. There is no traces of spills on site. The outfall is located about 50' from a canal that is connected to Cape Creek
— SA, HOW. Inside of the building is in same general shape as the. rest of facility. The 76,000 gallons diesel tank is in
good shape, with no rust or physical damage present. The tank is located within secondary containment that meets and
exceeds all of our requirements.
Having said all of this I want to conclude by saying that, yes, I agree that the current NCG08 permit does not cover this
particular SIC 4911 and that the permit is not a perfect fit for this facility. I also agree with the fact that this might be a
ground for a possible rescission, however there is a concern about the large diesel tank on site. In case that we grant
them the rescission, we should make sure to ask them to prove to us that this concern will be addressed with some
other measures that this facility is required to do through other permits (OSHA or SPPP plan).
As far as other rescission requests, we will try to get them out as soon as possible.

Dear Mr. Bennett,
The North Carolina Electric Membership Corporation (NCEMC) currently operates a small
power generation facility located on Light Plant Road (SR 1233) in Buxton, NC that is covered
under general permit NCG080000 (certificate of coverage NCG080030). The facility is
bounded to the south by Muddy Marsh Ditch, which is a man-made, tidal ditch that connects to
Pamlico Sound (Figure 1). During a recent Stormwater Pollution Prevention Plan (S WPPP)
update it was observed that the facility Standard Industrial Classification (SIC) 4911 is not
actually covered by NCG080000, nor is it covered by any other North Carolina general permit
classification (Attachment 1). The practices at the facility do not match those activities listed on
the cover sheet of NCG080000, and as such, NCEMC believes that coverage under North
Carolina's general permit program is unnecessary. A discussion that occurred on July 21, 2011
between Mr. Chris Wu (AECOM) and Ms. Bethany Georgoulias of DWQ's stormwater
permitting unit confirmed this assumption.
The Generating Station consists of an enclosed generation building, a switch yard, three
transformers, one auxiliary transformer, a storage building, fuel oil tank storage, and a fuel
loading/unloading area. The primary pollutant source is oil, and the combined oil storage on -
site is 76,270 gallons, all of which is kept within secondary containment. A facility Spill
Prevention Control and Countermeasure (SPCC) plan covers these activities. The SPCC is
updated in accordance with 40 CFR 112 to ensure compliance with state and federal
regulations.
NCEMC respectfully requests that you consider this letter and the Rescission Request Form
enclosed as a request for permit rescission. Please let us know if you feel it would be necessary
or appropriate to send an inspector to evaluate the layout of the Buxton facility before
determining whether a permit is required.

This Certificate of Coverage shall become effective April 2, 1993.

North Carolina Electric Membership Corporation (NCEMC) is submitting its Discharge Monitoring_
Report (DMR) for its Buxton Generating Station in accordance with NPDES permii.NCG080030.
Enclosed are an original and one copy of the DMR conducted in December 2010. While the data was
collected on December 17, 2010, the laboratory report was not sent to Central Files in a timely manner.
We believed we were compliant with Section 1- (1) of NCG080030, which requires submittal of DMRs
within 30 days of receiving laboratory results. "rhe laboratory report, however, was located today; and, as
such, we are expediting the submittal of the DMR. As a result of my conversation with Bethamy
Goergoulias at the central office today, I am forwarding this correspondence to the Central files with a
copy to the regional office.
NCEMC apologizes for the delay in the DMR submittal. The error was made in good faith, and we are
currently analyzing our Environmental Compliance System to ensure that this does not occur again.
