I Spoke with Mr. Blake Day and Linda Wiggs about this site.
Apparently, they have had overflows in the past from their combined WW/SW system that resulted in WW spills to
surface waters that also have contained solids (chicken parts).
They have redesigned their system to direct the majority of SW (after the first 1") to discharge to surface waters.
They are currently under no exposure permit NCGNE0914 (no inspections on BIMS) and will need to obtain a new SW
permit (NCG06? With monitoring? Or Individual?) and are ready to finalize plans to begin construction on a WW system
to exclude all but the first 1 inch of SW along with holding tanks.
They are looking for guidance and possible pre -approval (at least, verbally) from us regarding the design and type of
permit required to discharge stormwater .
Linda Wiggs can help advise on the WW side and willing to meet them offsite but not too keen on visiting the processing
plant itself.
I would be able to accompany someone from the central office for a site visit and help out in any way I can, BUT, being
that my role is as an inspector and this is usually reviewed and permitted out of RO, I will need your valuable expertise
with this one.
Please advise? They are asking to meet next week.

Jean,
I spoke with Brad Boris at the City of Morganton, he said that the City is the issuer of the pretreatment permit for this
site. However, Brad mentioned the person in the Asheville office that has been helping with this project is Linda Wiggs.
I
Additionally, we wanted to go ahead and send you the concept plan for the proposed site improvements and provide
you a brief overview of the project.
In the sites current condition all of the facilities surface stormwater drains to the onsite treatment facility.
Volume:
We are proposing to disconnect the surface stormwater system (excluding a few key areas) from the process
water system to alleviate the treatment load during storm events. To do so we propose to reconfigure the
gravity stormwater network, install two new pump stations, and a new EQ storage tank.
We are proposing to capture the first flush volume IV storm). The two pump stations onsite will send the first
flush volume to a new EQ storage tank near the process water treatment facility. The additional volume above
the first flush will bypass the pump station and discharge to the existing NCDOT network at Fleming. If
necessary, we could monitor the effluent at a location just downstream of the pump stations.
Flow/Pump sizing:
We are proposing to design the gravity pipe system/bypass to convey the 10 year storm intensity. We are
proposing to design the pump stations to convey the first flush volume at a maximum flow rate equivalent to
the flow rate from the i year storm intensity.
Process Water v. Stormwater
Generally, we are proposing to reconfigure the stormwater network to convey the cleaner stormwater
downstream. However, some areas will need to remain process water areas and will continue to discharge
directly to the onsite treatment facility. These process areas are identified on the Concept Plan. We can further
review these areas when we are onsite.
Would you be able to meet us onsite next week to discuss the project, assumptions and direction moving
forward? What days would work best for you?

Thank you David.
One item I would point out is to make sure all of the exposed dirt is removed from the conveyance, otherwise it will be
carried to your treatment unit or the sewer system; it appears there is some dirt at the outlet of the pipe in the
photos. And to make sure you get a good stand of grass, not only where you have recently done work but also along the
curb in the photos; again you (and Morganton) don't want to be treating dirt.
Other than that it looks good and I appreciate your stewardship and efforts.
I will share this information with the Stormwater folks so they are informed of your work, as it relates to the No
Exposure Certification. But please keep in mind as stated below, we do not have an application in house for your facility
to operate under the No Exposure Certification, therefore you will need to submit one.

Thank you for the information and your efforts. Your plan to add the curb and pipe for added protection sounds like a
good preventative measure. Please check with Kenny Fleming before you do this to make sure he does not have any
concerns for your pretreatment permit. Once you have completed that work go ahead and send me another email.
There is some confusion here regarding the submittal of the Case Farms request for No Exposure; we are unable to find
the application. If you have a copy of that please send it to me and I will see that it is properly directed and handled. In
case you need another application I have attached one above. Below is a link in case you need to familiarize yourself
with the No Exposure requirements. Click on the No Exposure tab for info.

The technician in the field the day the complaint was lodged had gathered samples of the water in question. I asked
Cheryl in the Morganton lab to run those samples for general information, not compliance. With the limited amount of
water, I asked that a Fecal Coliform and COD analysis be run. Both were elevated: Fecal Coliform was 2,900
colonies/100 ml and the COD was 1217 mg/I. Because these were run for general information and not run as
compliance samples, I only have a verbal on the results. There are no formal reports to share with you. I am not sure
how familiar you are with these parameters, but if you would like a better understanding of them and want to talk about
them feel free to give me a call. Again I do not plan to use these samples to issue a violation to Case Farms, I want to
make that clear. But they are a relevant indicator that the red water was more likely blood (warm blooded animal
fluids) than say off road diesel or automatic transmission fluid.

I have put some pictures and explanation together for your review, I tried to be as clear as possible. (For some reason
Page 4 appears black and white. I attached the Word version).
We have made the repair to the containment wall at the large tank on the hillside above the ABC store.
This should prevent spillage from run off of heavy rain or a malfunction of the waste water system.
We have evaluated any possible routes that process water or product could transport to the storm drain system and to
the best of our knowledge the only means found would be to flow from our process lot, down the hillside and then
across the lower lots to the storm drains stated it your email. With this being said, we have made the decision to erect a
containment curb and install a drain pipe that would direct any runoff or spillage from the process lot to the facility
process drain system via an existing pit and pump station.
It is our intention to have this completed no later than March 30th weather permitting.
The facility has a security camera system with the capabilities to go back in time and review happenings in and on the
property. In respect to the culvert, we reviewed the early morning hours of the 181h and did not see any evidence of any
type of spillage. There was a large snow bank along the area of the hillside at the parking lot that appeared clean as well.
We have no knowledge or evidence of a spill around this time period but will continue to work towards containment and
do what is needed to protect our neighborhood.
If there were samples taken of the water and residue found, we ask that the results be shared with Case.

HI David,
During my conversation today with you and William Pate we discussed complaints regarding discharges from Case Farms
at Rand St., as well as the No Exposure request in review.
Three complaints have been lodged in the last year and a half. The complaint from 11/2012, you believed to have been
investigated by either Wayne Watkins or Kevin Barnett which was resolved and initiated Case to apply for the No
Exposure. I observed what appeared to be fats (beige debris) on your hillside March 2013.1 reported this to my
coworker Kevin Barnett. Regarding the hillside release you informed me that you have a retaining wall that is
compromised which will be fixed this week. On Tuesday February 18, 2014 a complaint was lodged indicating that blood,
feathers and fats were observed in a culvert/ditch. See the photo attached. This culvert is reportedly across Fleming St
from your facility to the East. The discolored water and debris was intermittent and was no longer present later that day
or the next. Please investigate what may flow from your site to this drainage area and report back to me with your
findings by March 7, 2014. If you have to do a dye study on any of your piping during your inquiry, please contact me
first.

Culvert findings:
Please find the following documents that display our monitoring of the culvert area in
question, the work completed on the wall at the flow equalization basin and the plan for the
containment of the southeastern side of the processing lot to protect from exposure in the
event of spillage run off.
The first photos display the storm drain across the lower lot and the closest to the culvert
area.
I did not see any residue or visual signs of any product in the drain area nor discoloration in
the snow.
I monitored the culvert area for the next five days to see if there were any changes or flow.
The area is clean and free of any debris that I could associate with the poultry processing
plant.
On the fifth day we experience a small rain shower and the run off appeared to be clear
water.
The next photos provide a visual for the path and distance of travel from the processing lot
through the parking lot, storm drains then culvert.
I have included a picture of the repaired containment wall and the broken block that was
removed. This is on the hillside beside the large tank at our waste water facility above the
ABC store.
The next set of pictures explain our plan to erect a containment curb and install a drain pipe
to divert any run off from the processing lot to an existing pit and pump station that pumps
back to our process drains.

In response to your renewal application for continued coverage under the subject permit, the Division
of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215 .l and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions.
m A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area

Farms/B&L Feed Mill (NCG060115) has requested designation of
representative status for one of their outfalls Regional Staff
hereby recommend granting of the requests.
Case Farms (NCG06011G) - I toured the site on October 23, 1997
along with Mr. John Means and his consultant Mr. Barry Frank.
Observations indicated that exposure had been eliminated (or
connected to the sanitary sewer) from the following areas;
handling equipment, activities, raw materials, intermediate
products, final products, waste materials, by-products and
industrial machinery. Consequently, revocation of the subject

Case Farms/B&L Feed Mill (NCG060115) - On October 23, 1997, I
inspected the site along with Mr. Brian Franklin and Mr. Barry

Area" (left side of attached diagram) would be the most
contaminated on the site. Additionally, its constituents would
be representative of any drainage from the site. Therefore,
granting representative status to the "Drainage Area" and

Permit Number NCG06000) is hereby revoked effective immediately.
Should Case Farms of NC, Inc. wish at some future time to

The request for representative outfall status at the B&L Feed
Mill is hereby granted. The representative outfall is the "drainage
area" identified on the attached diagram. That "drainage area" is to
be sampled in accordance with Section B (p. 3 of 6, Analytical
Monitoring Requirements) specified in General Permit Number NCG060000.
Additionally, those visual monitoring requirements specified in
Section C (p. 5 of 6) of the'referenced General Permit must be
conducted at all s,tormwater outfalis. The representative status only
reduces the analytical monitoring requirements. A copy of the General
Permit Number NCG060000 is attached. Any changes in the feed mill's
infrastructure, manufacturing process, or production equipment could
result in the need to monitor additional stormwater outfalls.

prohibitive to enclose items exposed to storm water prior to the construction and

regulations relating to storm water under the SIC Group 20.
Case Farms would like to request the use of the storm drain closest to the tank farm as
being representative of all drains located on the property. Enclosed is a diagram of the

Your assistance and that of Messrs. Brian Franklin and John
Means are appreciated. Points raised during our meeting of
October 23, 1997 are discussed below:
1. Only those industries within Standard Industrial
Classification (SIC) Group 20 which have storm water
discharges associated with industrial activity are
required to have storm water discharge permits.. The
definition of the italicized phrase is found at 40
CFR122.26(b)(14-). A copy of the referenced portion of
the CFR (Code of Federal Regulations) is attached.
2. In accordance with the above referenced.regulation,
the feed mill would be required to continue coverage
under General Permit Number NCG060000 due to exposure
of pallets and materials handling (fat and other
components) outside the building. Monitoring of storm
water outfalls must occur in accordance with the
attached schedule from Permit Number NCG060000. If one
of the outfalls could be designated as
"representative", then only one storm water discharge
point would require monitoring. You may submit the

Prevention Plan and request representative designation
for one outfall. The designated outfall must contain
all contaminants which could be in a storm water
discharge from the facility. Please see attached
permit; note highlights concerning monitoring
requirements.
If the new feed mill could be constructed to prevent
all storm water discharges associated with industrial
activity, and all exposure associated with the old mill
is eliminated, then Case Farms may request voidance of
the feed mill's storm water discharge permit. Among
other things, the new mill's tank farm would be
required to be under roof. Mr. Tony Evans (Storm.Water
Permits Unit) advised the closed and water tight
product conduits and conveyors on the roof of the new
mill would not constitute exposure of storm water to
industrial activity.
3. Since the processing plant appears to have
eliminated all storm water discharges associated with
industrial activity, then voidance of their storm water
permit may be requested. ,Along with the request for
voidance of the permit, please submit the diagram of
the plant detailing that all industrially related storm
water discharges have been„eliminated.
4. Conversation with the Division of Air Quality's Mr.
Steve Maynard revealed the absence of any regulation to
prohibit burning of the old accumulated fats in a heavy
oil boiler. Prior to initiating burning, Mr. Maynard
requested that you advise him of details concerning ghe

Dear Mr. Davis,
In response to the written notice that Case Farms received on July 10, 1997, concerning
the discharge of unpermitted wastewater, the following steps are being taken to assure that
occurrences such as this will be eliminated in the future.
1) All drain lines and the overflow pipe from the upper pit leading to the lower pit will be
sealed, stopping the flow of water to this pit.
2) All lines in question will be re-routed to the upper pit and then pumped to our
wastewater facility.
3) The top of the pit will be completely sealed off eliminating use of this pit entirely.

Case Farms (NCG060116) - I toured the site on October 23, 1997
along with Mr. John Means and his consultant. Mr. Barry Frank.
Observations indicated that exposure had been eliminated (or
connected to the sanitary sewer) from the following areas;
handling equipment, activities, raw materials, intermediate
products, final products, waste materials, by-products and
industrial machinery. Consequently, revocation of the subject
certificate of coverage:is-recommended.
Case Farms/B&L Feed Mill (NCG060115) --On October 23, 1997, I
inspected the site along with Mr. Brian Franklin and Mr. Barry
Frank. Observations revealed that the area labeled "Drainage

Additionally, those visual monitoring requirements specified in

Case Farms agrees with your findings that we all are better served by continuing to
operate with a storm water permit for the next 18 months. It likely would be cost
prohibitive to enclose items exposed to storm water prior to the construction and
operation of a new feed mill facility. The new facility will likely be able to comply with all
regulations relating to storm water under the SIC Group 20.
Case Farms would like to request the use of the storm drain closest to the tank farm as
being representative of all drains located on the property. Enclosed is a diagram of the

Means are appreciated. Points raised during our meeting of
October 23, 1997 are discussed below:
1. Only those industries within Standard Industrial
Classification (SIC) Group 20 which have storm water
discharges associated with industrial activity are
required to have storm water discharge permits.. The
definition of the italicized phrase is found at 40
CFR122.26(b)(14-). A copy of the referenced portion of
the CFR (Code of Federal Regulations) is attached.
2. In accordance with the above referencedregulation,
the feed mill would be required to continue coverage
under General Permit Number NCGO60000 due to exposure
of pallets and materials handling (fat and other
components) outside the building. Monitoring of storm
water outfalls must occur in accordance with the
attached schedule from Permit Number NCG060000. If one
of the outfalls could be designated as
"representative", then only one storm water discharge

for one outfall. The designated outfall must contain
all contaminants which could be in a storm water
discharge from the facility. Please see attached
permit; note highlights concerning monitoring
requirements.
If the new feed mill could be constructed to prevent
all storm water discharges associated with industrial
activity, and all exposure associated with the old mill
is eliminated, then Case Farms may request voidance of
the feed mill's storm water discharge permit. Among
other things, the new mill's tank farm would be
required to be under roof. Mr. Tony Evans (Storm Water
Permits Unit) advised the closed and water tight
product conduits and conveyors on the roof of the new
mill would not constitute exposure of storm water to
industrial activity.
3. Since the processing plant appears to have
eliminated all storm water discharges associated with
industrial activity, then voidance of their storm water
permit may be requested. Along with the request for
voidance of the permit, please submit the diagram of
the plant detailing that all industrially related storm
water discharges have been -,,eliminated.
4. Conversation with the Division of Air Quality's Mr.
Steve Maynard revealed the absence of any regulation to
prohibit burning of the old accumulated fats in a heavy
oil boiler. Prior to initiating burning, Mr. Maynard
requested that you advise him of details concerning ghe

Dear Mr. Davis,
In response to the written notice that Case Farms received on July 10, 1997, concerning
the discharge of unpermitted wastewater, the following steps are being taken to assure that
occurrences such as this will be eliminated in the future.
1) All drain lines and the overflow pipe from the upper pit leading to the lower pit will be
sealed, stopping the flow of water to this pit.
2) All lines in question will be re-routed to the upper pit and then pumped to our
wastewater facility.
3) The top of the pit will be completely sealed off eliminating use of this pit entirely.
We are planning a target completion date of September 1, 1997. If any additional
information is needed please contact Mr. John Means at 704-438-6900 extension 329. Thank you

In accordance with your application for discharge permit received on January 14, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
• December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
