On Rescission requested, the Division of Water Quality received your request to rescind your coverage
under Certificate of Coverage Number ncg05O383. In accordance with your request, Certificate of
Coverage Number ncg05O383 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible parry to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

On my list (before getting your more current information), I had Stonewall Packaging NCG050383 classified as active and
owing, so sent them to our DWQ collections (temp) person, Bernard. Because they owe for 2011 (and may now owe for
2012) and they still have an active permit, they technically should be in collections. Regarding the permit itself, if they're
out of business or otherwise no longer operating at that location, our only options are to process a rescission request for
their no longer needed permit (if they request it), or wait until their permit expires (5/31/13) to inactivate it in BIMS to
stop the billing process. You did the right thing by commenting in BIMS- thank you! I guess the rest will hinge on Mr.
Yates's response.
Now, is there a new facility at the site that needs permitting, or are they just gone?

In accordance with your application for a discharge permit received on November 10, 2009, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal
Area Management Act or any other federal or local governmental permit that may be required.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,

to receiving waters designated as Scotts Creek, a class C; Tr water in the Little Tennessee River

set forth in Parts 1, 11, 111, IV, V, and VI of General Permit No. NCG050000 as attached.
This certificate.of coverage shall become effective December 11, 2009.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
