In accordance with your application for a discharge permit received on March 09, 2015, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection
Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the Division of
Energy, Mineral, and Land Resources. The Division may require modification or revocation and
reissuance of the certificate of coverage.
Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall
and groundwater seepage for this type of mining operation. Any discharge of this water (and any
stormwater commingled with it) is subject to the effluent limitations in this permit.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Energy, Mining, and Land Resources, or permits required by the Division of Water
Resources, Coastal Area Management Act, or any other federal or local governmental permit that may be
required.

I would be happy to help you with your questions. The NPDES application (NCGO20885) for coverage (COC) under our
General Permit NCG020000 has been completed and is soon to be issued. We usually wait to see the results of the mining
permit before issuance.
To answer your question about public notice of the Notice of Intent of this application, we do not public notice for
individual NPDES applications for coverage under the general permits. Also note the following:
• The DEMLR mining program already requires that a new mine notify all neighbors of the intent to open a mine.
• Our NPDES stormwater program provides public notice of the General Permit NCG02, but we don't notice each
successive COC, whether being issued as a renewal, or being issued as a first-time authorization to discharge
stormwater. Our interpretation is that noticing the General Permit suffices to meet the public notice
requirements in federal and state rules.
• That's the way we do all of our General Permits, from NCGO1— NCG24.
And lastly, according to the mining folks, the draft for the mining permit has been issued and the mining program waiting
on the bond to issue the final permit.

Another thought on this regarding the larger work flow issue, we had been having such notices sent to Dave Parnell as
well, and he was coordinating our response, if any. In that I do not have that position occupied currently, I do not have an
experienced stormwater staff member to coordinate these matters. I think the best approach will be to continue sending
them to me, and I will begin tracking and directing them to my staff, as appropriate, to ensure that we respond going
forward. Once I have another Senior Specialist in place to coordinate such reviews, I will likely ask you all to adjust the
process. Thanks for reminding me about the need to close the information loop on these matters.

Proposed Vista Hill Quarry Comments
03/30/2015
(1) Based on Thad's notations and comments by Danny Smith (DWR), jurisdictional features,
including the onsite pond extend into the affected area and will be subject to restrictions
regarding use as well as the provisions of the Clean Water Act. The existing pond cannot be
used as a sediment basin; so upland protective measures must be planned to protect the water
features. Further, the pit discharge will need to be addressed from a water quality standpoint,
and all stormwater outlets and protection measures must be specified to address the necessary
NPDES permit process.
(2) The proposed construction entrance detail needs to be changed to reflect the proposed 100 ft.
min. length. Silt fence will not be sufficient alone as S&E in this area. Check dams and outlet
protection must be specified, as appropriate, to control erosion and contain sediment where
access is made to the site. Similarly, additional measures must be proposed to address the
culvert /entrance road/berm construction planned for the stream crossing at the access to the
primary site. Phasing using cofferdams and pump -around techniques should be proposed for
installation of culverts #1 and #2. All protective measures (including erosion control as well as
sediment containment) must be within the affected area designated for the mine.
(3) While skimmer basin designs do not appear out of scale for this site, several issues do need to
be specifically addressed. The construction sequence needs to be expanded to address
retention of the sediment storage area at basin #2 throughout the plant site construction
period. Also, all diversion inlets to the basins need to be shown with properly designed
armoring (suggested in construction detail) to prevent excessive erosion that could prevent the
basins from functioning as intended.
(4) The symbol used for J-Hook silt fence installations is positioned incorrectly for most
installations; the J-Hook must turn into the affected area onsite where it is being used for
containment as indicated in the construction detail.
(5) Although the proposed use of the pond as a sediment basin is not allowed, it should be noted
that the design parameters used are suspect. The pipe sizing is not consistent between the
details and calculations, and the primary spillway capacity appears to be over -estimated.
Finally, the uplift on the concrete base does not appear to be accounted for in the design.
(6) The proposed riprap linings for channels have not been adequately detailed or specified.
Appropriate installation information and dimensional construction details are needed. Typical
stone classification and placement thicknesses should be used. This also applies to dissipators
proposed at this site. It is highly recommended that a tabular data and installation guide be
provided for clarity. This would also be helpful for skimmer basin detailing as well.
(7) Outlet stabilization must be specified for slope drains proposed at the overburden disposal site.

(3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official.

employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if
authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
(2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or
(3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official.
I hereby request coverage under the referenced General Permit. I understand that coverage under this permit will
constitute the permit requirements for the discharge(s) and is enforceable in the same manner as an individual
