Please note that this office is requiring a 1D for the site. Our comments from the original application indicated that wetlands were present but a JD was not asked for. A site visit indicated that it appeared that wetlands are on site or shows characteristics of wetlands on site. The site has had the trees removed, but has not been grubbed. Our original review also asked for a O&M prior to dewatering. A pump is on site and it appears that the site has discharged water from the site. Also, based on BIMS, the NCG02 permit is still in review from 2015. The permit has gone statutory, but BIMS still shows it as in review. If you should have any questions, please let us know. Thanks! This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Energy, Mineral, and Land Resources. The Division may require modification or revocation and reissuance of the certificate of coverage. Mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at -facilities near wetlands can be found in Part 111, Section E of your permit, and require that you have an approved Pumping Operation and Monitoring Plan (Pumping 0&M Plan) before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Pumping O&M Plan approval will be subject to enforcement action. We understand a Pumping O&M for your facility was submitted to the Washington Regional Office and approved by Mr. Roberto Scheller prior to issuance of this permit. If you have any questions about this Plan, please contact Pat McClain at the Washington Regional Office at (252) 946-6481. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. 1612 Mail Service Center, Raleigh, North Carolina 27699-1612 • Telephone 919-707-9220 / FAX: 919-733-2876 512 North Salisbury Street, Raleigh, North Carolina 27604 - Internet: http://portal.ncdenr.org/web/Ir/land-quality An Equal opportunity 1 Affirmative Action Employer — 50% Recycled 110% Post Consumer Paper Mr. Franklin A. Brown, Jr., Brown's Land Developing, Inc., 182 Winfall Blvd., Hertford, NC 27944 Job Location: M & L Sand Mine, Wynne Fork Road, Hertford, NC 27944 County: Perquimans County Prepared by: Ken Elliott, consulting Date: January 27, 2015 This plan defines responsibilities for operating, inspecting, and maintaining equipment and structures used for constructing and dewatering the M & L Sand Mine safely, and that dewatering will not degrade or negatively impact any wetlands or waters of the state. Description and Operation of the M & L Sand Mine: The M & L Sand Mine is a proposed 6.97-acre sand mine excavation operated by Franky Brown, Brown's Land Developing, Inc., in a 21.52 acre permit area located near the intersection of Wynne Fork Road and Skinner Road 2.5 miles south of Hertford, NC in Perquimans County. The permit area is on high sandy farm and woodland owned by Franky Brown, Jr. At this time Mr. Brown is submitting a mining permit application with the NCDENR Division of Energy, mineral and Land Resources to construct the sand mine and begin operation in April 2015. Mr. Brown is also submitting an application for rezoning and a Conditional Use Permit from the Perquimans County Planning and Zoning Department for construction of this mine. Sand Mine Dewatering: It will be necessary to dewater the excavation as it is being excavated to allow the excavating equipment to enter the excavated area and safely and efficiently remove the sand from the pond bottom. This will allow for full depth excavation and proper reclamation of the edges of the pond. It is the intention of Mr. Brown to only dewater the excavation as needed, which will not entail full-time dewatering. For excavation purposes, dewatering will occur roughly every 30 days which will allow excavating equipment to remove approximately 150 loads up to ground level where it will be stockpiled for later use. When the stockpile is depleted from usage, the excavation area will again be dewatered, and another quantity of sand will be excavated. The operator plans to construct a 0.25 acre sedimentation pond located 20 feet from the north end of the main excavation, within the boundary of the final 6.97 acre excavation. The 6 foot deep pond will be excavated and constructed with 2-ft tall by 10-ft wide sand berms surrounding it which will have full groundcover installed. Dewatering the main pond will allow for full depth excavation and proper reclamation of the edges of the pond. It is the intention of Mr. Brown to only dewater the excavation as needed, which will not entail full-time dewatering. The operator will install a 6-inch dewatering pump between the 2 ponds at the north end of the main excavation. Discharge from the dewatering pump will enter the sediment pond on its east side, and there will be a constructed water height control device (see attached diagram) discharge point located on the west side of the sediment pond. The discharge point will release clear water to a 20 foot long constructed riprap-stabilized ditch, leading to existing farm irrigation ditches 0.44 miles to Raccoon Creek wetlands, thence 1.5 miles to Raccoon Creek, and then 1.3 miles to the Perquimans River (see attached map for outflow route and discharge point location) Water will be pumped from the main pond to the sediment pond by a 6in gasoline -powered transfer pump operating at idle speed. Estimated maximum flow from the pump will be 10,000 gallons/hour. It is the intention of Mr. Brown to drop the water level in the main pond approximately 20 feet below natural ground level when needed. The overflow from the sediment pond will be controlled by a water height control device constructed in the west sediment pond berm, 1 foot below natural ground level. This control structure will allow water to flow through the baffle into a 25ft long x 15" wide buried PVC pipe leading west to an existing 6ft wide irrigation and drainage ditch running north and west 2.0 miles to Raccoon Creek and then 1.3 miles to Perquimans River. For erosion control, the overflow water will exit the water height control discharge onto a 20ft long riprap-lined apron in the ditch. Time and distance will allow all sedimentation to occur to acceptable levels before the overflow water reaches outfall and then the waters of the State. Water will have to travel a minimum of 150 feet to reach the overflow point which will give enough surface area to allow sufficient sedimentation to occur. There will be a minimum 2ft tall berm around the perimeter of the sediment pond to prevent offsite stormwater from entering the sediment area and damaging sedimentation rates. Sedimentation and Erosion Control The closest wetland swamp (Raccoon Creek wetlands) listed with the US Fish & Wildlife Service is located 1600 feet northwest of the proposed excavation area. Dewatering the M & L Sand Mine should have no impact on this wetland. The operator will maintain a minimum 75ft undisturbed area (no disturbance of any kind) inside the perimeter of the entire permit area. This buffer will be maintained by the operator as pasture with grass and pine tree ground cover. In addition there will be a 25ft unexcavated buffer (may contain roadways, stockpiles, and sediment & erosion control devices) around the entire excavation area, between the excavation and the undisturbed buffer. Sediment pond overflow will drain into an existing 6ft wide farm ditch that leads 2.0 miles through field irrigation ditches to Raccoon Creek and then 1.3 miles to Perquimans River. Overflow into the farm ditch will be stabilized by riprap installed in the ditch at the overflow (see diagram) to prevent erosion of the ditch. All erosion and sedimentation will remain inside of the permit area. During mining operations and dewatering, the majority of the water leaving the main excavation will remain inside of the permit area and will only overflow from the sediment pond occasionally. The sediment pond will be approximately 10 feet deep, and there is a sand layer below the bottom of the area. The porosity of the soil under the sediment pond will allow most of the water pumped into the pond from dewatering to seep back into the ground naturally. Any excess water overflowing from the sediment pond will flow downstream through existing irrigation and drainage ditches 2.0 miles towards Raccoon Creek, and then 1.3 miles to the Perquimans River. Maintaining the Sediment Pond Overflow Control Structure, Settlement Pond and Ditches Inspections and maintenance are required to obtain the intended function of safely dewatering the sand mine, and to maintain the life of any adjacent wetlands or waters of the State. Items to inspect and maintain during the 10 year life of the mine dewatering permit are: • Inspect the water control structures regularly, especially following heavy rains and runoff, or during periods of operation of the structure. • Remove accumulated debris from the concrete block overflow control structure. • Inspect the structure for excessive settlement or seepage. • Inspect all components of the structure, including appurtenances, and repair or replace any damaged items as needed. • Inspect embankments, berms and appurtenant structures, and repair as needed. • Repair any damage to vegetated areas or berms with compacted earth fill, reshaping, sodding, reseeding and mulching as needed. • Inspect riprap outlet stabilization structures in ditches regularly, replace dislodged rock as necessary. • Promptly repair all leaks in delivery facilities by replacing valves, fittings, gaskets, and worn or damaged parts. • Maintain all screens, filters, valves, timers and other electrical and mechanical equipment in good operating condition, following manufacturer's recommendations Monitoring the Process and Effects of Dewatering Analytical and qualitative monitoring of mine dewatering wastewater will be in accordance with the NCG020000 permit, as follows: • All ponds in the M & L Sand Mine permit area will be inspected daily by the operator to identify any abnormal conditions. • All berms and erosion control and sedimentation control structures will be inspected following significant (1/2-inch) rainfall events for damages, and all structures will be repaired immediately. • Special inspections will be conducted immediately following severe storms, vandalism, and other significant events. 0 Dewatering process will be inspected daily during periods of dewatering the excavation. • Overflow of wastewater process will be inspected daily during periods of dewatering the excavation. • Outflow of dewatering wastewater will be monitored quarterly at the overflow exit stabilization structure for pH, settleable solids, turbidity, and total flow. Samples will be collected and tested onsite for pH, and the remainder will be tested for the remaining parameters by a North Carolina certified lab. • Rain gauge data will be collected by monitoring rain gauge data monthly and after each rain event. Records Data will be collected as follows: • Data will be collected from samples taken from the wastewater point source discharge in operation at the time. • Point source discharge data: data from the site taken quarterly, date & time, general weather conditions, pH of sample, status of process at point source, inlet or outlet, other DWQ required data. • Visual monitoring of adjacent farmland for potential dehydration during mining or dewatering activities will take place weekly. Solutions to any degradation caused by any mining activity will include alteration of dewatering process. DWQ will be consulted as needed; alterations to process will be recorded. • Elliott Consulting will maintain the following records in a permanent file at the Elliott Consulting office at PO Box 112, 202 Elliott Road, Aydlett, NC 27916: a record of all significant actions taken; as -built drawings; permits; analytical results from sampling; and related material. Copies of all inspections, monitoring reports and lab analyses shall be provided to NCDEMLR on a regular basis and as requested. BMP Conditions • The permittee will utilize best management practices to ensure that dewatering the M & L Sand Mine will not degrade or negatively impact any wetlands or waters of the State. • The permittee shall obtain authorization from the Director of the NCDEMLR prior to utilizing any chemical flocculants at M & L Sand Mine. • Promptly repair all leaks in delivery facilities by replacing valves, fittings, gaskets, and worn or damaged parts. e Maintain all screens, filters, valves, timers and other electrical and mechanical equipment in good operating condition, following manufacturer's recommendations Monitoring the Process and Effects of Dewatering Analytical and qualitative monitoring of mine dewatering wastewater will be in accordance with the NCG020000 permit, as follows: • All ponds in the M & L Sand Mine permit area will be inspected daily by the operator to identify any abnormal conditions. • All berms and erosion control and sedimentation control structures will be inspected following significant (1/2-inch) rainfall events for damages, and all structures will be repaired immediately. • Special inspections will be conducted immediately following severe storms, vandalism, and other significant events. • Dewatering process will be inspected daily during periods of dewatering the excavation. BMP Conditions The permittee will utilize best management practices to ensure that dewatering the M & L Sand Mine will not degrade or negatively impact any wetlands or waters of the state. The permittee shall obtain authorization from the Director of the NCDEMLR prior to utilizing any chemical flocculants at M & L Sand Mine. Signed, Ken Elliott for Franklin A. Brown, Jr. / Brown's Land Developing, Inc. January 27, 2015 Water Height Control: Construction Details NRCS Code 587 M & L Sand Mine Wynne Fork Road, Hertford, NC Perquimans County DESCRIPTION A structure in a water management system that conveys water, controls the direction or rate of flow, maintains a desired water surface elevation or measures water. Water height control structure Is standard structure used by agricultural and horticultural farms in North Carolina to raise or lower water height in ditches and ponds per need. PURPOSE To convey water from one elevation to a lower elevation within, to, or from a water conveyance system, such as a ditch, channel, canal, or pipeline designed to operate under open channel conditions. Typical structures: drops, chutes, turnouts, surface water inlets, head gates, pump boxes, and stilling basins. CONSTRUCTION (SEE ATTACHED DIAGRAM) Structure consists of 25' x 15" horizontal PVC plastic outflow pipe running under farm path. A concrete block 4' x 4' box is attached on the north end of the PVC outflow pipe and has a 6" PVC plastic tee allowing adjustable height of the water level in the adjacent pond. Water flows through the 6" tee, into the control box, through the buried 15" outflow pipe and discharges into the outfall ditch. overflow ditch is lined with riprap for 20 feet down its length. Existing slopes adjacent to the outfall are heavily grassed with natural grass and weeds with no erosion present. MAINTENANCE Structure will be visually inspected daily during dewatering of the excavation for proper operation. Stricture will be checked and necessary maintenance, including removal of debris, shall be performed after major storms and monthly. Bradley, let's follow up on that piece so we can get BIMS straightened out (and info. to the permittee if necessary). Here are copies of the cover letter and COC, and I found the official signed copy in the permit files. I also found copies of email correspondence from Thom Edgerton from April 13, 2015 confirming that Roberto Scheller in DWR approved the O&M Plan. I neglected to add those event dates in BIMS at the time and have done that. That info. was included in the cover letter. A site visit indicated that it appeared that wetlands are on site or shows characteristics of wetlands on site. The site has had the trees removed, but has not been grubbed. Our original review also asked for a 0&M prior to dewatering. A pump is on site and it appears that the site has discharged water from the site. Also, based on BIMS, the NCG02 permit is still in review from 2015. The permit has gone statutory, but BIMS still shows it as in review. If you should have any questions, please let us know. Thanks!
