The specific requirements for mine dewatering at facilities near wetlands can be found in Part I 11, Section E of your permit. You must have an approved Pumping Operation and Monitoring (0&M) Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. We understand that the Washington Regional Office has received and approved your Pumping 0&M Plan on May 14, 2013. Please contact that office if there are changes in.operations that may affect that Plan. Any discharge'df this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. Coastal stormwater management rules (SESSION LAW 2008-211) were implemented October 1, 2008. You may be required to apply for an additional Coastal State Stormwater Permit. Per the requirements of the Tar -Pamlico Riparian Buffer Rule, all stormwater drainage to stream buffers, from portions of this site that have been constructed after January 1, 2000, must be discharged through a correctly designed level spreader or another device that meets diffuse flow requirements per 15A NCAC 2B .0259. For the purpose of this permit, a responsible corporate officer means: (a) a president, secretary, treasurer or vice president of the corporation in charge of a principal business function, or any other person who performs similar policy or decision making functions for the corporation, or (b) the manager of one or more manufacturing production or operating facilities employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures. (2) For a partnership or sole proprietorship: by a general partner or the proprietor, respectively; or (3) For a municipality, state, federal, or other public agency: by either a principal executive officer or ranking elected official. I hereby request coverage under the referenced General Permit. I understand that coverage under this permit will constitute the permit requirements for the discharge(s) and is enforceable in the same manner as an individual permit. There is an inactive mine on this property with a discharge permit (NCG020520). I have been in contact with Thom Edgerton of the Washington Regional office in regards to the new operation and discharge permit requirements. An On -site Determination of potential jurisdictional features was performed by the Pitt County Planning Department on October 15, 2012. Mr. Jonas Hill with Pitt County determined that two (2) ditches located within the proposed permitted area showed jurisdictional features and the Tar -Pamlico Riparian Buffer Rule would apply to these features. I have included the letter from Mr. Hill in this submittal. The locations of the ditches and the proposed buffers are also shown on the enclosed site plan. Barnhill Contracting Company -proposes to pump water from a rim ditch into the existing on -site ponds that have been previously mined. These ponds are sufficient in size to handle the pumping operation for this site. Once the 11.0 acre area is mined out, it will then be used for storage of dewatering from the other mining areas. Water will be pumped into these ponds utilizing a 61' submersible pump (Thompson Pump Model 46HST) at a rate of approximately 650 gallons per minute. This pit will be operated for Barnhill Contracting projects only and will not be run on a continual basis. Use will be determined by demand for sand for local projects. Because of the nature of this work, withdrawal rates and discharge will vary greatly from month to month. We intend to dewater only when we are actively mining sand and not on a continuous basis. During times of mining we will typically work 12 hour days and pump during those times. Discharge from pumping operations would only occur during extreme weather events as these ponds are more than sufficient for storage of the pumping operation. Therefore, any discharges will be kept to a minimum. We have also applied for a CCPCUA withdrawal permit through division of Water Resources since this site is within Pitt County. Erosion control measures will be installed onsite prior to any land disturbance taking place. Please reference the site plan for a more detailed depiction of these measures. Topsoil berms will be installed around the complete outer edge of the mining area. Any water within the mining area will be directed to drain towards the pit. Diversion ditches will be installed around the outside edge of the berms to divert shed water from running offsite. There are also diversion ditches with check dams along both sides of the haul road to control runoff from this area. I have contacted Thom Edgerton in the Washington Regional office prior to submitting this Notice of Intent. We have discussed the operation and intent and I will also submit an Operations and Monitoring Plan to his attention. Barnhill Contracting Company proposes to dewater mining operations through the following sequence of events: 1) Erosion Control items will be installed prior to any mining activities on the site. Sediment Basins and Diversion Ditches will be installed per plan design before mining activities begin in the mining area. 2) Mining will begin in on the most western edge (11.0 acre area) of the mine nearest the property line. Any topsoil in this area will be stripped and incorporated into a small berm that would extend around the western edge of the pit. The topsoil within these berms would be used to build any slopes after mining this area. The topsoil berms will be seeded as needed to stabilize. We will strip areas as mining progresses to prevent unnecessary erosion from occurring. Diversion ditches will be utilized to divert shed water towards the sediment basin. 3) As mining activities extend below the water table, water will be pumped as needed into the existing onsite pond. In case excess water flows over the edge of the existing pond bank, a rip rap outlet will be installed at the:lowest point and any discharge will dissipate through the 50' undisturbed buffer to the on -site ditch. 4) After all mining activities in this 11.0 acre area are complete, any remaining topsoil stockpiled will be used to build the slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded. 5) Mining will then begin in the remaining 40.0 acre area in the same manner. Topsoil will be stripped as needed and used for berms around the perimeter of the pit. As mining activities extend below the water table in this area, water will be pumped into the existing on -site ponds. We will also use the newly created 11.0 acre pond for storage of pumped water from the new mining area. Pumping will be shared between the on -site ponds as needed to ensure that discharge is kept to a minimum, if any at all. 6) After all mining activities in the 40.0 acre area are complete, any remaining topsoil stockpiled will be used to build the slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded. The proposed operation has been designed so that any overflow from dewatering activities or extreme rainfall events will take a natural course to the closest ditch. Water will be pumped at a rate not to exceed 936,000 gallons per day, as dictated by our CCPCUA withdrawal permit, utilizing a Thompson 6" submersible pump (model 46HST or comparable). The estimated volume of water withdrawal from dewatering activities will be recorded. Storm water will be managed within the pit utilizing silt fence, diversion ditches, sediment basins, buffers, and berms when topsoil is available. Reference is made to the site plan, which illustrates the design specifications and size of the sediment basin. There will be an undisturbed buffer established between the mine footprint edges and the jurisdictional ditch edge. The 50' undisturbed buffer along the edge of the mine limits will be adequately marked with orange safety fence to ensure that heavy equipment does not enter into this area and land disturbing activities do not occur. Barnhill Contracting Company will work to inspect and monitor the jurisdictional features that appear within the property boundary daily, during times that pumping and discharge are occurring. Barnhill Contracting Company will inspect and monitor the features to reaffirm the presence of the jurisdictional feature and soils, as well as, for the instability, erosion, sloughing, subsidence, collapse, newly formed sinkholes, wetland vegetation degradation, and/or flooding of ditch from discharge activities. Barnhill Contracting Company does not foresee any impacts to the adjacent features or wetlands, but will secure the appropriate 401 Permit if the need arises. There is an inactive mine on this property with a discharge permit (NCG020520). I have been in contact with Thom Edgerton of the Washington Regional office in regards to the new operation and discharge permit requirements. An On -site Determination of potential jurisdictional features was performed by the Pitt County Planning Department on October 15, 2012.. Mr. Jonas Hill with Pitt County determined that two (2) ditches located within.the proposed permitted area showed jurisdictional features and the Tar -Pamlico Riparian Buffer Rule would apply to these features. I have included the letter from Mr. Hill in this submittal. The locations of the ditches and the proposed buffers are also shown on the enclosed site plan. Barnhill Contracting Company.proposes to pump water from a rim ditch into the existing on -site ponds that have been previously mined. These ponds are sufficient in size to handle the pumping operation for this site. Once the 11.0 acre area is mined out, it will then be used for storage of dewatering from the other mining areas. Water will be pumped into these ponds utilizing a 611 submersible pump (Thompson Pump Model 46HST) at a rate of approximately 650 gallons per minute. This pit will be operated for Barnhill Contracting projects only and will not be run on a continual basis. Use will be determined by demand for sand for local projects. Because of the nature of this work, withdrawal rates and discharge will vary greatly from month to month. We intend to dewater only when we are actively mining sand and not on a continuous basis. During times of mining we will typically work 12 hour days and pump during those times. Discharge from pumping operations would only occur during extreme weather events as these ponds are more than sufficient for storage of the pumping operation. Therefore, any discharges will be kept to a minimum. We have also applied for a CCPCUA withdrawal permit through division of Water Resources since this site is within Pitt County. Erosion control measures will be installed onsite prior to any land disturbance taking place. Please reference the site plan for a more detailed depiction of these measures. Topsoil berms will be installed around the complete outer edge of the mining area. Any water within the mining area will be directed to drain towards the pit. Diversion ditches will be installed around the outside edge of the berms to divert shed water from running offsite. There are also diversion ditches with check dams along both sides of the haul road to control runoff from this area. Barnhill Contracting Company proposes to dewater mining operations through the following sequence of events: 1) Erosion Control items will be installed prior to any mining activities on the site. Sediment Basins and Diversion Ditches will be installed per plan design before mining activities begin in the mining area. 2) Mining will begin in on the most western edge (11.0 acre area) of the mine nearest the property line. Any topsoil in this area will be stripped and incorporated into a small berm that would extend around the western edge of the pit. The topsoil within these berms would be used to build any slopes after mining this area. The topsoil berms will be seeded as needed to stabilize. We will strip areas as mining progresses to prevent unnecessary erosion from occurring. Diversion ditches will be utilized to divert shed water towards the sediment basin. 3) As mining activities extend below the water table, water.will be pumped as needed into the existing onsite pond. In case excess water flows over the edge of the existing pond bank, a rip rap outlet will be installed at the lowest point and any discharge will dissipate through the 50' undisturbed buffer to the on -site ditch. 4) After all mining activities in this 11.0 acre area are complete, any remaining topsoil stockpiled will be used to build the slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded. 5) Mining will then begin in the remaining 40.0 acre area in the same manner. Topsoil will be stripped as needed and used for berms around the perimeter of the pit. As mining activities extend below the water table in this area, water will be pumped into the existing on -site ponds. We will also use the newly created 11.0 acre pond for storage of pumped water from the new mining area. Pumping will be shared between the on -site ponds asneeded to ensure that discharge, is kept to a minimum, if any at all. 6) After all mining activities in the 40.0 acre area are complete, any remaining topsoil stockpiled will be used to build the slopes of the pond to a grade of 3:1 or flatter above the water table, and permanently seeded. The proposed operation has been designed so that any overflow from dewatering activities or extreme rainfall events will take a natural course to the closest ditch. Water will be pumped at a rate not to exceed 936,000 gallons per day, as dictated by our CCPCUA withdrawal permit, utilizing a Thompson 6" submersible pump (model 461-IST or comparable). The estimated volume of water withdrawal from dewatering activities will be recorded. Storm water will be managed within the pit utilizing silt fence, diversion ditches, sediment basins, buffers, and berms when topsoil is available. Reference is made to the site plan, which illustrates the design specifications and size of the sediment basin. There will be an undisturbed buffer established between the mine footprint edges and the jurisdictional ditch edge. The 50' undisturbed buffer along the edge of the mine limits will be adequately marked with orange safety fence to ensure that heavy equipment does not enter into this area and land disturbing activities do not occur. Barnhill Contracting Company will work to inspect and monitor the jurisdictional features that appear within the property boundary daily, during times that pumping and discharge are occurring. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the maps along with their corresponding (approximate) acreage. As a reminder, mining permits can only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those activities that are intended to be conducted during the life of the mining permit. All maps must be of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a minimum: a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located including easements and rights -of -way. b. Existing or proposed permit boundaries. c. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion & sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer may be needed depending on site conditions. Show all buffer locations and widths on the mine map(s). A 100' PROPERTY LINE BUFFER WHICH IS REQUIRED BY THE PITT COUNTY ZONING ORDINANCE FOR BORROW PITS WILL BE INSTALLED. PLEASE SEE MAP FOR DETAILS. b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. Depending on site conditions, a buffer wider than 50 feet may be needed. ALL SLOPES ABOVE THE PERMANENT WATER LEVEL WILL BE SLOPED AT A MINIMUM OF 3 TO I (HORIZONTAL TO VERTICAL) ABOVE THE WATER TABLE AND 2:1 BELOW THE WATER TABLE. ALL SLOPES WILL BE SEEDED AND MULCHED AS EXCAVATION WITHIN THE AREAS IS COMPLETED. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling house, public road, public, commercial or industrial building from any mine excavation. No off -site generated waste shall be disposed of on the mine site without prior written approval from the NC Department of Environment and Natural Resources, Land Quality Section and either the Division of Waste Management (DWM) or local governing body. If a disposal permit has been issued by DWM for the site, a copy of said permit must be attached to this application. All temporary and permanent refuse disposal areas must be clearlv delineated of the mine map(s) and reclamation map, along with a list of items to be disposed in said areas. BECAUSE OF LIMITED MINING ACTIVITY AT THIS SITE, NO REFUSE WILL BE GENERATED. ALL MACHINERY ASSOCIATED WITH THE MINING ACTIVITY WILL BE REMOVED FROM THE UPON COMPLETION OF THE EXCAVATION. 12- APPLICATION FOR A MINING PERMIT Describe your plan for revegetation or other surface treatment of the affected areas. This plan must include recommendations for year-round seeding, including the time of seeding and the amount and type of seed, fertilizer, lime and mulch per acre. The recommendations must include general seeding instructions for both permanent and temporary revegetation. Revegetation utilizing only tree plantings is not acceptable. Recommendations can be sought from: a. Authorized representatives of the local Soil and Water Conservation District; b. Authorized representatives of the Division of Forest Resources, Department of Environment and Natural Resources; c. Please be aware that when stormwater comingles with process water or wastewater, a permit for discharge is required. I have attached a few pictures.
