The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) recently conducted a Stormwater and sedimentation and erosion inspection and found the site to be in compliance with all Sedimentation Pollution Control Act (SPCA) and NPDES permit requirements. All site work under the issued permits, ONSLO-2012-145 and ONSLO-2012-015, is complete and DEMLR has deemed the project closed. MCIEAST-MCB CAMLEJ no longer needs to maintain the issued NPDES Stormwater permit, CoC #NCG020834 and requests a permit rescission. Enclosure (1) contains the NPDES Rescission Request Form. Lutheran' { I Subject: RE: IPBC (P-032) Borrow Pit 44 Hay Dana, It looks like the monitoring exemption you quoted refers to the requirements for the monitoring for the stormwater discharges only and does not apply to wastewater discharges from mine dewatering and the process areas. See Section E "Mine dewatering requirements apply to all mines that dewater from pits including quarries, clay brick, sand & gravel, borrow pits, and refractory mining, as well as mines with similar discharges. Note that for Construction Sand and Gravel or Industrial Sand mines, "mine dewatering" wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage." BUT keep in mind that for both Stormwater and wastewater monitoring Section E, Table 9 footnote 2 states that: "If no discharge occurs during the sampling period, the permittee must record "No Flow" or "No Discharge" within 30 days of the end of the three-month sampling period in their SPPP. No Flow" or "No Discharge" shall be reported on the Annual Summary Discharge Monitoring Reports (DMR)." I hope this helps. Brian Lambe from DEML is the inspector for that site and he is planning a visit next week. I can arrange to make a site visit but am not available on Tuesday. My question, relates to the level of monitoring required under the NCG020000 for this pit. To date, this pit has never discharged, even with the record rainfall we received last week. In fact, it is far from discharging. In researching the monitoring requirements under the NCG020000, I came across language that reads: If the pond is designed to contain the 25 year / 24 hour storm without discharging and it can gain capacity to hold such within 5 days time through means other than discharging, monitoring is not required. When applying for the permit , we did not prepare calcs to illustrate the pond was designed for the 25 year / 24 hour storm, and we have no intention of doing that, as it would be costly. With all that said, is it possible to get released from monitoring without the calcs. And, if not, what level of monitoring is the site required to perform? Thanks a bunch.
