Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15. 2007 (or as subsequently
amended.) The following information is included with your permit package:

Your coverage under the General Permit is transferable only through the specific action of DEMLR. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment or decree.

1, Mitch Hayes, conducted a Compliance Evaluation Inspection on November27, 2012. Yourtime and
assistance with this inspection was greatly appreciated. Below is list of findings developed from the
inspection.
1. The subject certificate of coverage NCG020810 under permit NCG020000 was issued February 17,
2012 and expires December 31, 2014. Permit renewal and associated fees are required within 180
days permit expiration date.
2. The site consists of an existing +1- 46,000 square feet excavated sump inside a borrow pit. Sand is
excavated and piled up to allow drying. Water covers approximately 40 percent of the pit. Water in
the pit is lowered using a pump and hose. The discharge water flows into a filtration sock inside a
small sediment basin with rip/rap to allow energy dissipation. The water sheet flows onto a
vegetative cover. The edge of the borrow pit issloped to drain any stormwater back into the pit.
3. A Stormwater Pollution Prevention Plan (SWPPP) had not yet been developed. The SWPPP is
required to be developed and implemented within 12 months of certificate of coverage permit
issuance date.
4. This permit does require quarterly analytical monitoring at the sediment basin discharge outfall.
Semi-annual qualitative monitoring is also required at the discharge outfall. Qualitative monitoring
requirements can be found in Section D, Table 6 and analytical monitoring requirements can be
found in Section E, Table 7.

Comment: COC was issued 02.17.2012. A SWPPP is required to be developed and
implemented within one year of COC permit issuance date. There is one distinct
discharge outfall. Water in a sump from the pit is pumped as needed to maintain a
constant level water level. Water is discharge through a filter sock inside a small
sediment basin. Water flows out of the filter sock through rip/rap for energy dissipatation
and sheet flows out onto a forested ground cover.

In accordance with your application for a discharge permit received on December 2, 2011,
we are forwarding herewith the subject certificate of coverage to discharge under the subject state
— NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality, The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This general permit allows the discharge of stormwater and certain types of wastewater
from your facility. In your application, you specified that only mine dewatering water would be
discharged from this facility. If separate point -source discharges of stormwater occur (i.e.,
stormwater not combined with mine dewatering water), you will be required to adhere to the
conditions in this permit for stormwater discharges.
Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage to stream
buffers, from portions of this site that have been constructed after July 22, 1997, must be
discharged through a correctly designed level spreader or another device that meets diffuse now
requirements per 1SA NCAC 2B .0233. Diffuse flow requirements are described in Chapter 8 of the
North Carolina Stormwater BMP Manual, available at:

This permit does not affect the legal requirements to obtain other permits which may be

No, it didn't affect us. Which permits are you waiting on? I can check their status for you. Even though they show as

Natalie Landry and I went to Braswell Pit, NCG020810, in Johnston County on 12.19.2011. We did not find any streams
or creeks or wetlands 150 feet from the discharge point that was depicted on the site map provided by the engineer. A
401 permit will not be required for this site. One concern we did have is that there is an fuel or oil tank located beside
discharge piping that is used for dewatering. We noted some soil staining from the oil or fuel. This tank should be
removed from its location and located outside the pit and secured to prevent it from falling over causing a spillage.
Perhaps you can write something in the permit to address this. Please contact me or Natalie if you have any questions.

We have received an application for coverage of an existing clay mine under NCG 02 from Richard D. Braswell. The
facility drains to an Moccasin Creek (class C; NSW) in Princeton (Johnston County). They don't have vehicle maintenance
or haz. waste. Their DLR mining permit expired this year and DLR is still reviewing the renewal. The N01 states that
they have mine dewatering within —150' of wetlands. Does the RRO have any concerns about issuing this facility a COC
for this general permit? Do you want to hold the COC until you approve an O&M pumping plan?

For axis tlnp mining sites that require an Authorization to Operate (A TO) wastewater treatment facilities:
This NOI Is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction; modification, or installation of any new treatment components at an existing site requires an
ATC. (If the site Is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC rc for
to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below). The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of
treatment facilities must comply with requirements of 15A NCAC 2H .0138 & .0139. '
Construction of wastewater treatment facilities subject to the ATCIATO requirements in the NCG02 permit
at new orexisting mining sites requires submission of three (3) sets of plans and specifications signed

Natalie Landry and I went to Braswell Pit, NCG020810, in Johnston County on 12.19.2011. We did not find any streams
or creeks or wetlands 150 feet from the discharge point that was depicted on the site map provided by the engineer. A
401 permit will not be required for this site. One concern we did have is that there is an fuel or oil tank located beside
discharge piping that is used for dewatering. We noted some soil staining from the oil or fuel. This tank should be
removed from its location and located outside the pit and secured to prevent it from falling over causing a spillage.
Perhaps you can write something in the permit to address this. Please contact me or Natalie if you have any questions.

We have received an application for coverage of an existing clay mine under NCG 02 from Richard D. Braswell. The
facility drains to an Moccasin Creek (class C; NSW) in Princeton (Johnston County). They don't have vehicle maintenance
or haz. waste. Their DLR mining permit expired this year and DLR is still reviewing the renewal. The NOI states that
they have mine dewatering within -150' of wetlands. Does the RRO have any concerns about issuing this facility a COC
for this general permit? Do you want to hold the COC until you approve an 0&M pumping plan?
