Since they already have an issued permit I would go ahead and issue it. State Law says if a renewal is pending the original permit is still valid. So, should we wait to issue our permit until after the mining permit is renewed? Typically for pending renewals we do not wait as they probably should have already had a permit. So unless it something weird we will probably go ahead and issue it. It will be up to DWQ to finish up on the storm water permit. Judy and Ashley, I have a stormwater permit application for Low Gap Quarry that has a mining permit which I believe is being renewed by you now (00-26). 1 know with new permits we wait until your permit is issued before we issue ours but I was wondering if we have to do that with renewals. In this case, our permit is only for stormwater and the regional office has completed the mining review sheet and is ok with us issuing the permit. I know in some cases the mining permit might change and therefore the renewal could affect our permit. DEPARTMENT -OF -ENVIRONMENT AND NATURAL RESOURCES DIVISION OF LAND RESOURCES LAND QUALITY SECTION PERMIT for -the operation of a mining activity In accordance with the provisions of G.S. 74-46--through-68, "The Mining Act of 1971," Mining -Permit Rule 15A NCAC 5-8, and other applicable laws, rules and regulations Permission is hereby granted to: Yancey Stone, Irrc. Low Gap Quarry Yancey County -. Permit No. 00-26 for the operation of a Crushed Stone Quarry which shall -provide that the usefulness productivity and scenic values of all lands and -waters affected by this -mining operation will receive the greatest practical degree of protection and restoration. MINING PERMIT EXPIRATION DATE: _July_ 13-2011 Page 2 In accordance with the application for this mining -permit, which is hereby approved by the Department of Environment and Natural Resources hereinafter referred to -as the Department, and in conformity with the approved Reclamation Plan attached to -.and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected bythe permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the -bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This -permit is not transferable by the permittee with the following exception: If another operatorsucceeds to the interest of the permittee in the permitted mining operation,by virtue of -a sale, lease, assignment or otherwise, the -Department may release the permittee from the duties -imposed -upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the, successor operator, provided that both operators have complied with the requirements-of1he Mining Act and that the successor operator agrees to assume the duties of the-permittee with reference to reclamation of the affected land and -posts a suitable bond or other security. . In -the event -that the- Department determines that the permittee or permittee's successor is not complying with the Reclamation -Plan or other terms ands conditions of this -permit, or -is failing to achieve the purposes and requirements of the Mining_ Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as -incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, -unless the context clearly indicates otherwise, terms shall -have the same meanirrg as supplied by the Mining Act, N.C_G.S.-74-49. Modifications May 14, 1993: This permit has been modified to be included under the existing $25,000.00 blanket bond. December 29, 1993: This permit -has been transferred in its entirety from Yancey Sand and Gravel Company to Yancey Stone, Inc. May 16, 1994. This permit has been modified to include the addition and- use of 8 acres of adjoining land across the Cane River for overburden disposal, -stockpiling -and equipment storage. In addition, the modification includes changes to the existing processing area and various sediment and erosion control measures as well as the construction of an access road to the McMahan Cemetery. All modifications are to be made as indicated on Sheets 2 and 4 of 5, last revised April 27, 1994 and Sheet 5 of 5 dated March 1994. Page 3. Februarys, 1995: This permit has been modified to add an additional 60.38 acres of adjoining land and to increase the affected acreage to 20.49 acres as indicated on the Mining Plan, Sheets 1 through 22 dated November 1994 and Sheets 7 and 18 revised January 18, 1995. February 17, 1997: This permit has been modified to eliminate the lower two benches on the west wall of the quarry. November 26, 1997: This permit has-been modified -to increase the permitted acreage by 38 acres and the affected acreage by 2.64 acres as indicated on the mine maps -last revised October 2, 1997. In addition, the reclamation plan has been modified to allow the pit to be -reclaimed-as a lake -area. .July-13,_2001 _ This permit.has been modified to allow expansion of the excavation area, to revise the -erosion and -sedimentation control requirementsfar the reconstructed bridge across the Cane River, and to increase tI a permitted acreage by 3.56 acres -and the affected acreage by 3.06 acres as indicated on the mine maps last revised -May 2, 2001 and in the maintenance and construction specifications submitted -to -this office on May 16, 200.1. April-6, 2004: This permit -has-been departmentally modified -to change the mining permit number from Mining Permit No. 100-26 to Mining Permit -No. 00-26: July 27, 2004: This permit has been modified to increase the permitted acreage to 158.76- acres and the affected acreage at this site to 31.76 acres indicated -on the Mine Maps, Sheets 1 and 3 of 3 prepared March 2004 and Sheet 2 df 3-last revised July 2004. The modification includes an additional overburden placement area along with access roads and the associated erosion and -sediment control measures. November 8 2006: This permit has been modified to increase the affected acreage at this- -site to 40.54 acres -as indicated.orr the Mining Map -dated -October 12, 2006. The modification includes -an additional 8.78 acres to expand the quarry pit. -Expiration Date This permit shall be effective from the date of its -issuance until July 13, 2011. Conditions This Permit shall be -subject to the provisions .of the Mining Act, N.C.G.S. 74-46, et. seq., and -to the.following conditions and limitations: Page 4 OPERATING CONDITIONS: 1. Wastewater and Quarry Dewaterinq A. Any wastewater processing or mine dewatering shall be -in accordance with the permitting requirements and rules promulgated by the N.C_ Environmental Management Commission. B. Any storm water runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee'sresponsibility-to contact the Division of Water Quality to secure any necessary storm water permits or other approval documents. 2. Air Quality and Dust Control A. -Any mining related process producing air contaminant emissions including fugitive dust shall -be subject to the -requirements and rules promulgated by -the .N.C. Environmental -Management Commission and enforced by the Division of Air Quality, B. During processing operation, water trucks or other means that may be necessary shall -be utilized to -prevent dust from leaving -the permitted area. 3. Buffer. Zones A. Any mining activity affecting waters of the State, waters of the U. S., or wetlands -shall be in accordance with the requirements and regulations promulgated -and enforced by the N. C. Environmental Management Commfission. B. . Sufficient buffer shall be -maintained between -any affected land- and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of'the affected land and to preserve the integrity of the natural watercourse or wetland. C. All buffer zones shown on the Erosion -Control Plan, Sheets 11 -through 14 of 22 dated November 1994, Sheets 7, 7A and 8 last revised October 2, 1-997,-Sheets 1 and 2 last revised May 2, 2001, and the buffer zones indicated -on the Mine Maps Sheets 1 and 3 of 3, prepared March 2004 and Sheet 2 of 3 last revised July 2004, and the Mining Map dated October 12, 2006, shall be maintained to protect adjoining property. These buffer zones, with the exception of -the -installation of required sediment control measures and approved earthen berms, shall remain undisturbed. Page 5 D. The buffer zone along the north side of Cane River, upstream of the bridge, shall include the entire plateau (even the portion of the plateau that is more than 100_. feet from the river's edge.) 4. Erosion and Sediment Control A. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, check dams, sediment retarding -structures, rip rap pits, or ditches shall be provided in the initial stages -of any land disturbance and maintained.to prevent sediment from discharging onto -adjacent surface areas or into any -lake, wetland or natural watercourse in proximity to -the affected -land. B. All erosion and -sedimentation control measures shall be installed and maintained as indicated on -the Original Mine Plan, Sheet 1-of 5, dated March 1994, the New Mining Plan, Sheets-2 and 3-of 5, last -revised April 27, 1994 and dated March 1994, respectively, and the Reclamation -Plan, Sheets 4 and 5 of 5, revised April 27, 1994 and dated March 1994, respectively, with the exception that all level spreaders shall:be installed within tire -permitted boundaries. C. The Cane River shall be protected from sediment by establishing erosion and sedimentation control measures on each approach to the existing bridge and by implementing the maintenance and construction specifications submitted to the -Department on May 16, 2001. D. The outlet device in Basin "C" (as indicated on the 8.5 x 11 inch map submitted by fax on May 11, 1994) shall be replaced with an appropriately designed and constructed riser structure -if -the structure fails or if the Department finds the existing structure to be inadequate. In addition, the top of the basin side slopes shall be at elevation 109-as a minimum and the bottom of the'sediment basin shall -be excavated -to elevation 103. E. No excavation shall occur -on the south side of the Cane River. F. All erosion and sedimentation control measures shall -be installed and maintained as indicated on the Erosion Control Plan, Sheets 11 through _13 dated November 1994,-with the -following exceptions: 1) NC DOT Class 2 riprap shall -be utilized in -the Phase l=and 11 ditches, and 2) All silt fence shall be installed outside of the buffer zones. G. A modification request shall be submitted to and approved by the Department prior to in-itiation of any land disturbing activities within the area identified as Phases 11 or III on the Erosion. Control -Plan, Sheets 12 and 13; dated November 1994 with the exception ofthe construction of -the Plant Site. H. A modification request shall be submitted to and approved by the Department prior to initiation of any land disturbing activities on the-28.26 acres east of N. C. 197 on the Boundary Survey, Sheet 2 dated November 1994. Page 6 -Runoff-from the pit expansion and other newly affected areas as indicated on the Mining Map last revised October 12, 2006 shall be -diverted into the existing excavation or to existing erosion -and sediment control measures. -A modification request including erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the -approved application for a mining permit and any approved- revisions to it. Such areas include, but are not limited to, expansion outside of the initial pit area, creek crossings, or expansion of overburden disposal areas. K. Runoff from the pit -expansion and other newly affected areas.(totaling-3.06 acres) as indicated on the mine maps last revised May 2, 2001 shall be diverted - into the existing excavation or to existing or -approved erosion and sedimentation control measures. L. All erosion and sedimentation control measures shall be installed 'and maintained as indicated on the -mine maps -last revised May 2, 2001, and October 12, 2006. -M. -A mine map and reclamation map showing the.entire mine site - including all features and requirements incorporated into the most current permit conditions, as well as any proposed additional modifications - shall be submitted to the Department -with the Annual Reclamation Report due in this office by February 1, 2002. If additional modifications to the existing permit are requested at the time of this submittal, then all information and fees required for the submittal of a formal permit modification request must be submitted at the same time: -N. lFmining activities associated with the additional overburden placement area, including. the installation and maintenance of all erosion and sedimentation control measures, shall -be conducted as indicated on .the Mine Maps, Sheets 1 and 3 of 3-prepared March 2004 and Sheet 2 of 3 last revised July-2004 and Attachments to the 2004 Permit Modification Request received by the Land.. Quality Section on April 1, 2004 with the stipulation that the overburden placement area be constructed from the bottom of the storage area to the top in lifts no greater than four feet. O. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with'the approved application for a mining permit and any approved revisions to it. Such areas include, but are not limited to, expansion outside of the approved pit area, creek crossings, or expansion of overburden or waste disposal -areas. I Page 7 5. Bounda Markers All affected area boundaries (40.54 acres) shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger -spacing intervals. 6. Groundwater Protection Groundwater monitoring wells.shall be -installed and -monitored as deemed appropriate -by the Department. 7. Graded Slopes and Fills A. The angle for graded slopes and-flls shall -be no greater than. the angle which can be retained by vegetative cover or other adequate erosion control. measure, structure, or device. In any event, -exposed slopes or any -excavated channels, the erosion of which may cause off -site damage because -of siltation, shall be planted or otherwise provided-with-groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter o` the pit opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the -top of the rock and at the toe of any overburden slope. C. In hardrock excavations, the bench widths shall be a minimum of 5 feet and. the bench heights shall be a maximum of 30 feet. For proposed bench widths of 50 feet, the bench heights shall be a maximum of 40 feet. The only exception to this condition shall be the elimination of the lower two benches of the west wall of the -quarry as approved -by the Department an February 17, 1397. 8. Surface -Drainage - The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or -foul. Necessary -structures such as drainage ditches or conduits shall be constructed -or installed when required to prevent such conditions. 9. Blasting The operator shall monitor each -blast with a seismograph located at a -distance no -farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismog rap hic. record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Operating Condition Nos, 8B and 8D of this permit). The peak particle velocity of any component shall not exceed 1.0 inch per second, for the purposes of this Section. C. Air blast -With Monitoring: Air blast overpressure resulting .from surface blasting shall not -exceed 129 decibels -linear (dBL) as measured at"the immediate location of any regularly occupied building not owned or leased by_the-operator.outside of the permitted area such as_a dwelling house, church, school, or public, -commercial or institutional building, Unless an alternate level based on the sensitivity of the seismograph microphone -as specifiedbelow is being used: Lower Frequency Limit -of Max Level, Measuring System, in Hz in dBL 0.1 Hz or iower-flat response , 34 peak 2.0 Hz or lower -flat response 133 peak 6.0 Hz or lower -flat -response 129 peak D. Air blast Without Monitoring: In the event of -seismograph malfunction or other condition which prevents monitoring, blasting -shall be -conducted in accordance with the following formulas: To convert U (psi) to P-(dBL): U = 82 (D/WO.33)-1.2 P = 20 x log (U72.9x107 ) Confined Air blast/Overpressure (dBL} for quarry situation: A=-P-35 U = Unconfined air overpressure (pounds per square inch). W = Maximum charge weight of explosives per delay period of 8.0 milliseconds or more (pounds). D = Distance from the blast site to the nearest inhabited building not owned or leased by the mine operator (feet). P = Unconfined air overpressure (decibels). Page 10 A = Air blast or air overpressure for typical quarry situations (decibels). The air blastloverpressure shall not exceed 129 decibels, for the purposes of this -Section. E. Record Keeping_ The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; blast location; distance from blast to closest offsite regularly occupied structure; and weather conditions at the time of the blast. Records shall -be maintained at the permittee's mine office and copies shall be provided to the Department upon request. F. Excessive Ground Vibration/Air blast Reporting If ground vibration or Air blast limits are -exceeded, the operator will immediately report the event with causes -arid -corrective actions to the Department. Use of -explosives at the blast site that produced the excessive reading shall cease until corrective actions approved by the -Department are taken. However, blasting may occur in other.approved areas within the. permitted boundary. Authorization to blast at the blast site may be granted at the time of the verbal reporting of the high ground vibration or high air blast -reading if the circumstances justify verbal approval: Failure to report will constitute a permit violation. G. Flvrock Prevention: The operator shall take all reasonable precautions to ensure that flyrock is not thrown beyond areas where the access -is temporarily -or permanently guarded by the operator. Failure to take corrective measures tc-prevent flyrock and repeated instances of flyrock shall be considered a violation of the -Mining Permit. H. Flvrock Reporting: Should-flyrock occur_beyohd'the permitted -and guarded areas, the operator shall immediately report the incident -to the Department. Further use of explosives .on the mine site shall be suspended until the following actions have been taken: A thorough investigation as to the cause(s) of the incident shall be conducted. Page 11 2. A report detailing -the investigation shall be provided to the Department within 10 days of the incident. The report shall, at a minimum, document the cause(s)_ of the incident along with technical -and management actions that will be taken to -prevent further incidents. The report shall meet with the approval of the Department before blasting may resume -at the mine site. Studies: The operator. -shall provide to she Department a copy of the findings of. any seismic studies conducted at the mine site in response to an exceedence of a level allowed'by these blasting conditions. The _operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. J. Notice: The operator shall, when requested -by the Department, give 24-hour advance notice to-the'Land Quality -Section Regional Office prior to any -blast during a period for which notice is requested. 10. Hiah Wall Barrier A physical barrier consisting of four foot high, three strand barbed wire fencing shall be maintained at all times along the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum 10 foot wide horizontal -safety bench shall -be provided at the junction -between the top of rock and the toe of any overburden cut slope. 11. Visual -Screening A. Existirtg vegetation shall be maintained between the mine and public thoroughfares to screen -the operation from the public. Additional screening methods-, such as constructing earthen berms, shall be employed as deemed appropriate by the Department.- B. In addition to grasses, long leaf and/or -Virginia pines or other acceptable evergreen species shall be planted as deemed appropriate by the Department to improve visual and noise buffering. G. The visual screening berm indicated -on the Reclamation Plan, Sheet 4 of 5 last revised April 27, 1994, shall be -constructed and stabilized as per the construction details and vegetative specifications included on said plan. Page 12 12. Plan Modification A. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be abtained- from the Department prior to on -site implementation of the revisions. B. A modification request shall be submitted to and approved by the Department prior- to initiation of any -land disturbing activities within the areas identified as Phases 1I & III on the Erosion Control Plan, Sheets 12 and 13, dated November 1994 with the exception of the construction of the Plant Site -in Phase I I. 13. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shalt be allowed within the -boundaries of the mining permit area -unless authorization to conduct said disposal has. -first been obtained from both the Division of Waste Management and the Land Quality Section, -Department of Environment and Natural Resources. The method of disposal shallbeconsistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Actof 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered -hazardous shall be disposed of within the permitted area. C. For the purposes of this- permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition -to those specifically listed under-G.S. 74-49 (14) cf the N.C.-Mining Act of 1971):_ 1. on -site generated -land clearing debris 2. conveyor belts 3. wire cables 4. v-belts 5, steel reinforced air hoses 6. drill steel 14 15. -Page 13 D. If mining refuse is to be permanently disposed within the. mining permit boundary, the following information must be provided to and approved by the Division of Land Resources rip or to commencement of such disposal: 1. --the approximate boundaries and size of -the refuse disposal area; 2. a -list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and 5. verification that a permanent vegetative groundcover will -be established Annual Reclamation Report An Annual Reclamation Report shall be submitted on -a form -supplied by the Department by February-1 of each year until reclamation is completed and approved. Bondirm The security, which was posted pursuant to N.-C.G.S. 74-54-in the form of a $40,000.0.0 Assignment of -Savings Account, -a $25,000.00 Assignment of -Savings Account, and a $2,400.00 Assignment of Savings Account, totaling $67,400.00, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit -to be valid. The total affected -land -shall not exceed the bonded acreage. 16.. Archaeo_lo_ ical Resources Authorized- representatives of the Division of Archives and History shall be granted access.to the site"to determine the presence of--sigr-iiftcant archaeological resources. Page 14 APPROVED RECLAMATION PLAN The Mining -Permit incorporates -this Reclamation -Plan, the performance of which is a condition on -the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of -the permittee, which continues beyond -the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be- -consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in ail- -excavations in rock. All overburden and spoil shall be-feft in a_configuration which is in -accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land._ 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. -PerrrriItee shall conduct reclamation activitie§- pursuant to the Reclamation Plan -herein - incorporated. These activities shall be conducted according to -the time schedule included in the plan, -which shall to the extent -feasible -provide reclamation simultaneous with mining operations and in any event, provide reclamation at the -earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two -years -after completion or termination of mining. -RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation Schedule, the planned reclamation shall -be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any high wall, and grade and revegetate any areas in unconsolidated material. 2, The specifications for surface gradient restoration to a surface suitable for the planned future -use are as follows: Page 9 5. A. All areas of unconsolidated material such as overburden or -waste piles shall be graded to a 2 horizontal to 1 vertical -or flatter slope and terraced as necessary to insure slope stability,- S. April 6, 2004: This permit has-been departmentally modified -to change the mining_permq number from Mining- Permit No. -100-26 to Mining Permit No. 00-26: July 27, 2004: This permit has been modified to increase the permitted acreage to 158,75' acres and the affected acreage at this site -to 31.76 acres indicated -on the Mine Maps, Sheets 1 and -3 of 3 prepared March 2004 and Sheet 2 of 3-last revised July 2004. The modification includes an additional overburden placement area along with access roads and the associated erosion and -sediment control measures. November 8. 2006: This permit has been modified to increase the affected acreage at this - site to 40.54 acres as -indicated or7 the Mining Map dated October 12,2006. The modification includes -art additionai-8.78 acres to expand the quarry. pit. Expiration Date This permit -shall -be effective from the date of its issuance until July 13, 2011. Conditions This Permit -shall be subject to the provisibns.of the Mining Act, N.C.GS. 74-46, et. seq., and to -the following conditions and limitations: Page 4 OPERATING CONDITIONS: Wastewater and Quarry Dewatering A. Any wastewater processing -or mine dewatering shall be in accordance with the permitting requirements -and rules promulgated by the N.C_ Environmental Management Commission. .S. Any storm water runoff from the affected areas at the site shall be -in accordance with any applicable permit requirements and regulations -promulgated by -the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's-responsibility fo contact the Divisiorr of Water Quality to secure any necessary stone water permits or other approval documents. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including_ fugitivedust shall -be subject to the -requirements and -rules promulgated -by -the N.C. Environmental -Management C-ommission and enforced by the Division of Air Quality. B. Iguring processing operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the -permitted area. 3. Buffer Zones A. Any mining -activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated arrd enforced by the.N. C. Environmental. Man agement-Comrission. B. S-efficient buffer shall be -maintained between any affected land and any adjoining waterway or wetland to -prevent sedimentation -of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse ar wetland. C. Ali buffer zones shown on the Erosion Control Plan, -Sheets 11 through 14 of 22 dated November 1994, Sheets 7, 7A and 8 last revised October 2, 1-997, Sheets 1 and 2 last revised May 2, 2001, and the buffer zones indicated -on the Mine Maps Sheets 1 and 3 of 3, prepared March_2004 and Sheet 2 of 3 last revised July 2004, and thee-Uning Map dated October 12, 2006, shaRbe maintained to protect adjoining property. These buffer zones, with the exception of_the --installation of required sediment control measures and approved earthen berms, shall remain undisturbed. s Page 5 D. The buffer zone along the north side of Cane River, upstream of the bridge, shall include the entire -plateau (even the portion of the plateau that -is more than 100 feet from the river's edge.) 4. Erosion and -Sediment Control A. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches -shall be provided in the initial stages of any land disturbance and maintained to prevent -sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. B. All erosion and sedimentation control measures shall be installed -and maintained as indicated on the. Original Mine Plan, Sheet 1 of 5, dated -March 1994, the New Mining Plan, Sheets 2 and 3 of 5, last -revised April 27, 1994 and dated March 1994, respectively, and- the Rectamation Plan, Sheets.4 and 5 of 5, revised April 27,994 and dated March 1994, respectively, with the exception that all level spreaders shall be installed within -the -permitted boundaries. C. The Cane River shall be protected from sedin-feat by establishing erosion and sedimentation control measures on each approach to the existing bridge and by implementing the maintenance and construction specifications subntted to the Department on May 16, 2001. D. The outlet device in Basin °C" (as indicated on the 8.5 x 11 inch map submitted. by fax on May 11, 1994) shall be replaced with an appropriately designed and constructed riser 9tructure.if the structure fails, or if the Department finds the existing structure to be inadequate. In addition, the top of the basin side slopes shall be at elevation 109-as a minimum and the bottom of the'sediment basin shall- be excavated -to elevation 103- E. No excavation shall occur on the south side of the Care River. F. All erosion and -sedimentation control measures shall be installed and maintained -as indicated on the Erosion Control Plan, Sheets 1-1 through 13 dated November 1994, with the following exceptions: 1) LNC DOT Class 2 riprap shall be utilized in the Phase I and 11 ditches, -and 2) All silt fence shall be installed outside of the buffer zones. G. A modification request shall be submitted to and approved by the Department prior to initiation of any land disturbing activities within the area identified as Phases il- or -III on the Erosion .Control Plan, Sheets 12 and 13; dated November 1994 with the exception -of the construction of the Plant Site. H. A mocHiication request shall be submitted to and approved by the Department prior to initiation of any land disturbing activities on the 28.26 acres east of N. C. 197 on.the Boundary Survey, Sheet 2 dated November 1994. Page 6 Runoff from the pit -expansion and other newly affected areas as indicated on the Mining Map last revised October 12, 2006 shall be diverted into the existing excavation or to existing erosion and sediment control measures. J. A modification request including erosion and sediment control plan(s) shall -be submitted to the Department.for approval prior to any land disturbing activities not indicated on the revised erosion control -plan -or -mine maps submitted with the approved application for a mining permit.and any approved- revisions to it. Such areas include, but are not limited to, expansion outside of the initial pit area, creek crossings, or expansion of overburden disposal areas. K. Runoff from the pit expansion and other newly affected areas -'totaling 3.06 -acres) as indicated on the -mine maps fast revised May 2, 2001 shall be diverted - into the existing excavation or to existing or approved erosion- and sedimentation control measures. L. All erosion and sedimentation control measures -shall be installed and maintained as indicated orrthe mine maps -last revised May 2, 2001, and -October 12, 2006. M. A mine map and reclamation map showing the -entire mine site - including all -features and requirements incorporated into the most current permit conditions, as well -as any proposed additional modifications - shall be submitted to the Department with the Annual Reclamation Report due in this office by February 1, 2002. If additional modifications to the existing permit are requested at the time of this submittal, then all information and fees required for the submittal of a formal permit -modification request must be submitted at the same time. N. All mining activities associated with -the additional overburden placement area, including the installations and maintenance of all -erosion and sedimentation control measures, shall -be conducted'as indicated, on -the Nine Maps, Sheets"! and 3 of 3 prepared March 2004_and- Sheet 2 of'3 last revised -July20'04 and Attachments to the 2004 Permit Modification Request received by the Land.. Quality Secticn-on April 1...2004 with -the stipulation that the overburden placement area be constructed from the bottom of the storage area to the top in -lifts no greater than -four feet: O. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities. not hdicatedr on the revised erosion control plan or mine maps submitted with the approved application for a mining permit and any approved revisions to it._S-uch areas include, but are not limited to, expansion outside of the approved pit area, cFeek_crossings, or -expansion of overburden or waste disposal areas. Page 7 5. Boundary Markers All affected -area boundaries (40.54 acres) shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. 6. Groundwater Protection Groundwater monitoring wells.shail be installed and monitored as deemed appropriate -by the Department. 7. Graded Slopes and Fills A. The angle for graded slopes -and - fills --shall be no greater than:the angle which can be retained by vegetative cover or other adequate erosion control -measure, structure, or device. In- any event, -exposed- slopes or any excavates channels, the erosion of which may cause off=site• damage -because -of siltation, shall be planted -or otherwise provided with-groundcover, devices or structures. sufficient -to restrain such erosion. B. Overburden cut slopes along the perimeter of the pit opening shall- be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 -days of completion. Furthermore, a minimum ten-(10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of any overburden slope. C. In hardrock excavations, the bench widths shall be a minimum of 5 feet and- the bench heights shall be a maximum of 30 feet. For proposed bench widths of 50 feet, the bench heights shall be a maximurrr of 40 feet. The -only exception to this condition shall be the elimination of the lower two benches of -the west wall of -the-quarry as approved by the Department on February 17, 1.997. -a. Surface, Drain act The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall' be constructed: or installed when required to prevent such conditions. 9. Blastin The operator shall monitor each blast with a seismograph located at a distance no- farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as. provided ;under Operating Condition -Nos. 8B and 8D: of this permit). The following blasting conditions shall be observed by the mine operator to prevent hazard to persons and -adjacent property from surface blasting: A. Air blast Without Monitoring: In the event of seismograph malfunction or other condition which prevents monitoring, blasbngshatl be conducted in accordance with -the following formulas: To convert U (psi) to P (dBL): 82 (DM11.33)-1.2 P = 20 x log (U12.9x10') Confined air blast/Overpressure (dBL) for quarry situation: A = P- 35 U. = Unconfined air overpressure (pounds per square inch). D = Distance from the blast site to the nearest Linhabited building not owned or leased by the mine operator (feet): P = Unconfined air overpressure (decibels). Page 10 A = Air blast or air overpressure for typical quarry situations (decibels).. The air blast/overpressure shall not exceed 129 decibels, for -the purposes -of this Section. E. Record Keepin-g: The operator shall maintain records on each individual blast describing: the total -number of holes;.pattern of holes and delay ofintervals; depth and size of -holes-, type and total pounds of explosives; maximum pounds -per delay interval; amount of stemming and burden for each hole; blast -location; distance from blast to closest offsite regularly occupied structure; and weather conditions at the time of the blast. Records shall -be maintained at -the permittee"s mine office and copies -shall be provided -to the Department upon request. F. Excessive Ground Vibration/Air blast- Reporting: If ground vibration or Air blast limas -are -exceeded, the operator will immediately report the event with causes and -corrective actions to the -Department. Use of explosives at the blast site that produced the excessive reading shiall cease until corrective actions approved by-th-E, Department are taken. However, blasting may.occur. in other approved areas within the. permitted boundary. Authorization to b[ast_at the blast site may -be granted at the lime of the -verbal reporting of the high -ground vibration or high -air blast reading if the circumstances justify verbal approval. -Failure to report will constitute a permit violation. G. Flyrock Prevention. The operator shall take a[I reasonable precautions to ensure that flyrock is not thrown -beyond areas where the -access is temporarily or permanently guarded by the operator. Failure to take corrective measures -to prevent flyrock and repeated -instances of flyrock shall -be considered a violation of the -Mining Permit. H. Flyrock Reporting: Should flyrock occur beyond the permitted and guarded areas, the operator shall immediately report the incidentto the -Department. Further use of explosives on the mine site shall be suspended until the following actions have -been. taken: A thorough investigation as to the cause(s) of the incident shall be -conducted. Page 11 2. A report -detailing the investigation shall be provided to the Department within 10 days of the incident. The report shall, at -a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The, report shall meet with -the approval of the Department before blasting -may resume at the mine site. Studies: The -operator -shall provide to the Department a copy of the findings of any -seismic studies conducted at the mine site in fesponse to an exceedence of a level allowed by these blasting conditions. The pperator shall make every reasonable effort to incorporate the studies' recommendations into -the production blasting -program. Notice: The operator shall, when requested by -the Department, give 24=hour advance notice to the -Land Quality Section Regional Office prior to any -blast -during a period for which notice is requested-. m High -Wall Barrier A physical barrier consisting of four foot high, three strand barbed wire fencing shall be maintained at all times along the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum IG foot wide horizontal -safety -bench shall.be provided at the-jurlction-between the top of rock and the toe of any overburden cut slope. 11. Visual -Screening A. Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation -from the public.- Additional -screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. B. In addition to grasses, long leaf and/or Virginia pines or -other acceptable evergreen species shall be planted as. deemed appropriate by the Department to improve visual and noise buffering. C. The visual screening berm indicated on the Reclamation -Plan, Sheet 4 of 5 last revised April 27, 1994, shall be constructed and stabilized as per the construction details and vegetative specifications included. -on said -plan. Page 12 12. Plan Modification A. The operator shall notify the Department in writing of the desire to delete, -modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit anal -any approved revisions to it. Approval to implement such changes must -be -obtained from the Department prior to on -site implementation of the revisions. B. A modification request shall be submitted to and approved by the Department prior to initiation of any -land disturbing activities within -the areas identified as -Phases I I & III on the Erosion Control Plan, -Sheets 12 and 13, dated November 1994 with the exception of the construction of -the Plant Site .in Phase II-, 13. Refuse Disposal A. No on -site disposal of refuse -or -other solid waste that is generated outside of the mining pefmit area shall- be allowed within --the boundaries of'the mining permit area unless authorization to conduct said disposal has -first been obtained -from both the Division of Waste Management and the Land Quarty Section, Department of -Environment and Natural Resources. The method of disposal shah be consistent with the approved reclamation plan. B. Mining :refuse as defined -by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and -directly associated with the mining activity may be disposed -of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No- petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit the Division of Land Resources -.considers -the- following materials to be "mining -refuse" (in addition to those specifically listed under G.S. 74-49 (14). of the--N.C. Mining Act of 1971): 1. on -site generated land clearing debris 2. conveyor belts 3. wire cables 4. iv -belts 5. - steel reinforced air hoses 6. drill -steel Page 13 D. If mining refuse is to be permanently disposed with in'the-mining permit b-oundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of -such disposal: 1. the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; ,k verification that the refuse.will be disposed -at least 4 feet above the seasonally high water table; and 5. verification that a permanent vegetative groundcover will be established 14. Annual Reclamation Report An Annual Reclamation Report shall be submitted -on -a form supplied -by the Department by February 1 of each year untit reclamation is -completed and approved. 15. Sondina The security, which was posted pursuant to iu 1C:G.S. 74-54 in .the form of a $40,000.00 Assignment of Savings Account, -a $25,000.00 Assignment of SavingsAccount, and a $2,400.00 Assignment of Savings Account, totaling $67,400.00, is sufficient to cover the operation as indicated in the approved application. This security must. -remain in force for this permit to be vafid. The total affected land shall not exceed the bonded acreage. 16.. Archaeological Resources Authorized --representatives of the Division of Archives and History shall be granted access- to --the site -to determine, the presence of significant archaeological- resources. Page 14 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation. Plan, the performance of which is a condition on the continuing validity of that Mining- Permit. Additionally, the Reclamation -Plan is -a - separable obligation of the permittee-, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provrded_By G.S, 74-53 The final slopes in all excavations in -soil, sand, gravel and-otherunconsolidated materials shall be at such an -angle as to minimize the possibility -of slides and be consistent -with the future use of the land. 2. Provisions for safety -to persons and -to adjoining -property must be.provided in all- -excavations in rock. 3. All overburden and spoll shall be left in a -configuration which is- in accordance with accepted conservation practices and which -is suitable for the proposed -subsequent use ofthe land. 4. No small pools of water shall be allowed to -collector remain on the -mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and -reforestation practice& as established by -the North Carolina Agricultural Experiment Station and the -North Carolina Farest Service. 6.-Permittee shall conduct reclamation activities pursuant to -the Reclamation Plan herein. incorporated. These activities shalt be conducted according to the time schedule . -included in the pran,-which shall to the extent feasible -provide reclamation simultaneous with mining operations and in -any event, provide reclamation at the -earliest practicable time after completion or termination of -mining or,. any segment'of the permit area and shall be completed -within two years after completion or -termination of m-ining.- RECLAMATION CONDITIONS; -1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the -quarry excavation. to -fill with water, provide a permanent barricade (fence) along the top of. any high wall, and grade and.; revegetate any areas in unconsofidarted material 2. The specifications for surface gradient restoration -to a surface suitable for the planned future use are as follows: Page 1 5. A. All areas of unconsolidated material such as overburden or waste piles shall be graded_ to a2 horizontal to 1 vertical or flatter slope and terraced as necessary to -insure slope stability. B. ,Any settling ponds and sedimerrt control basins shall be backflled,.graded, and stabilized or cleaned out and made into acceptable -fake areas. C, The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled arid: smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared. before revegetation. E. Na-contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall -be in accordance with -Operating Conditions Nos. 13A through 13D. F. The -affected _land shall be graded to pre-vent.the collection of noxious or.ioul water. 3. Revegetation Flan: Disturbed areas shall be permanently revegetated according to the Re -vegetation Plan included —in the renewal-a-nd modification application dated January 20, 2001. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as -switch grass, Indian -grass-, -bluesten and gamma grass. In addition, the permittee shall consult with a professional wildlife biologist with -the N.C. Wildlife -Resources Commission to enhance -post -project wildlife habitat at the site. r Page t6 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to -the extent feasible. In any event, -reclamation shall be initiated as soon as feasible after completion or termination of -mining of any mine segment under permit.
