Resources (DEMLR) is forwarding herewith the reissued Certificate of Coverage and
Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently
amended.) The following information is included with your permit package:

keeping. Please review the new permit to familiarize yourself with all changes in the reissued permit.
Significant changes to the General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEMLR. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, State, or local law, rule, standard, ordinance, order,
judgment or decree.

To the best of my knowledge, regarding Mr. West inquiry into DWQ actions with the Blue Rock Materials mine in
Cherokee County I have listed a timeline of events below.
April 2010-ARO DWQ received mining application package from DLR (Shawna) for the Blue Rock Materials/McNabb
Mine.
4/12/2010-ARO DWQ reviewed package and submitted comments on the "Mining Permit Application Review Form"
(09/2005) to DLR. Internal Note: this was the old DWQ comment sheet, which was prior to the September 2010
agreement between DLR and DWQ on the review process.
Jan 2011-ARO DWQ spoke with Roger Moore on January 5, 2011 regarding the mine. Mr. Moore was representing the
mine and inquiring about DWQ permitting. After a lengthy discussion of the mine, Mr. Moore was told a Stormwater
Permit (NCG02) application (NOI) would likely be needed... DWQ went to the,website with Mr. Moore while still on the
phone to make sure he had the correct application for'NCG02.
June 2011-Late in June 2011 DWQ Central Office received the application for the Blue Rock Materials mine. The package
has recently been assigned to a DWQ Engineer in the Central Office for review.

2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the
maps along with their corresponding (approximate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those
activities that are intended to be conducted during the life of the mining permit. All maps must be
of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a
minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be Iocated
including easements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.
d. Outline and width of all buffer zones (both undisturbed and unexcavated).
e. Outline and acreage of all pits/excavations.
f. Outline and acreage of all stockpile areas.
g. Outline and acreage of all temporary and/or permanent overburden disposal areas.
h. Location and acreage of all processing plants (processing plants may be described as to location and
distance from mine if sufficiently far removed).
i. Locations and names of all streams, rivers and lakes.
j. Outline and acreage of all settling and/or processing wastewater ponds.
k. Location and acreage of all planned and existing access roads and on -site haul roads.

m. Location and dimensions of all proposed sediment and erosion control measures.
n. Location of I00-year floodplain limits and wetland boundaries.
o. Names of owners of record, both public and private, of all tracts of land that are adjoining the mining

or leased by the applicant or is owned by the lessor of the mine tract, names of owners of record of
tracts adjoining these tracts, that are within 1,000 feet of the mining permit boundary, must be
provided on the mine map(s). NOTE: "Highway" means a road that has four lanes of travel or less
and is not designated as an Interstate Highway.

Describe in detail the sequence of events for the development and operation of the mine and reference the

2. Describe specific erosion control measures to be installed prior to land disturbing activities and during
mining to prevent offsite sedimentation (include specificplans for sediment and erosion control for mine
excavation(s), waste piles, access/mine roads and process areas), and give a detailed sequence of
installation and schedule for maintenance of the measures. Locate and label all sediment and erosion
control measures on the mine map(s) and provide typical cross-sections/construction details of each
measure. Engineering designs and calculations are required to justify the adequacy of any proposed
measures.

APPLICATION FOR A MINING PERMIT
A buffer will be required between any mining activity and any mining permit boundary or right-of-
way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion &
sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance
within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note
that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary
or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer

A buffer of 50 feet in width is planned for the permit boundary adjacent to the creek, however the
property owner has an established gravel road to access timber within this'area so the buffer will not
be undisturbed.
6. a. Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries
during mining. Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and
minimum 3 horizontal to I vertical slopes or flatter for sandy material are generally required, unless
technical justification can be provided to allow steeper slopes.
As mentioned in C 1 , the initial.material.to_be crushed for aggregate was blasted 25 to 30 years ago
and is piled near the blasting area creating a wide bench. As this material is crushed and stockpiled,
a wide range of material sizes ranging from sand to automobile sized boulders will be uncovered in
the bench. The large material has been stable for the past three decades. As material is removed and
crushed, the slope angles of the excavation will be based on the size of materials exposed. Exposed
rock faces will be left vertical with benching where needed for rockfalI protection. Other finer
materials will be graded to meet the requirements above.

b. Provide a cross-section on the mine map(s) for all fill slopes (berms, wastepiles, overburden
disposal areas, etc.), clearly indicating the intended side slope gradient, installation ofany benches
and/or slope drains (with supporting design information) if needed, and the method of final
stabilization.

c. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes including
specifications for benching and sloping. Cross -sections for all cut slopes must be provided on the
mine map(s).
The working face in blasted material should be no steeper than 1 H to 1 V. For permanent final slopes,
grade material to a 2H to IV slope.
d. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections
of the mine excavation clearly noting the angles of the cut slopes, widths of all safety benches and
mine benches, and the expected maximum depth of the excavation.
The existing rock face is 45 to 60 feet high with little or no benching. Any new excavations in rock
will be benched 5 feet every 10 feet of height.
7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling
house, public road, public, commercial or industrial building from any mine excavation. Locate all such
structures on the mine map if they are within 300 feet of any proposed excavation.

and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder

The old quarry site does not have a high wall barricade. The highest cut nearlyreaches the top of the adjacent
ridge. The entire site is on Mr. McNabb's property and is surrounded by his property. A chain link fence will
limit access to the new rock excavation high wall when additional rock is needed.

submitted at least 90 days prior to construction'.
For existin mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:
This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction, modification, or installation of any new treatment components at an existing site requires an
ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC rp for
to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below). The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of

The Division of Water Quality's Stormwater Permitting Unit received a National Pollutant Discharge
Elimination System (NPDES) permit application for McNabb Quarry on June 27, 2011. The application
included a copy of an associated application for a mining permit submitted to the Division of Land Resources
(DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an
associated mining permit from DLR. Our office will process your stormwater permit application once a
DLR mining permit has been issued for your project.
Please also be aware that if your project is located near wetlands, your NPDES permit will require
dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities
near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available
on our website, http://portal.ncderLr.org/web/wq/ws/sL-/npdessw. See Part Ill, Section E of the permit. An
approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities and may be
required prior to permit issuance. Discharging mine dewatering wastewater without Plan approval will be
subject to enforcement action. A Plan for your facility must be submitted to the Washington Regional Office
within 60 days of your receipt of an NPDES permit. We encourage you to contact the Asheville Regional

NPDES application review.

This is to inform you that you and/or your firm are/is violating the Mining Act of 1971 by operating
a mine without a permit as required by North Carolina General Statutes (hereinafter NCGS) 74-46, et
seq., as amended.
On April 20, 2010, personnel of this office inspected a mining operation being undertaken off
Highway 294 in Cherokee County, North Carolina. Personnel of this office have also determined that
you and/or your firm are the operator of this mine. The area affected at the site by mining -related
activities was measured to be 1.2 acres in size.
Pursuant to G.S. 74-50 of the Mining Act of 1971, no person may operate a mine without first
obtaining a mining permit and also posting a bond to ensure that the site is reclaimed. Mining is defined
by NCGS 74-49 as:
The breaking of the surface in order to facilitate or accomplish the extraction or removal of
minerals, ores, or other solid matter;
Any activity or process constituting all or part of a process for the extraction or removal of
minerals, ores, soils, and other solid matter from its original location; and/or
The preparation, washing, cleaning, or other treatment of minerals, ores, or other solid matter so
as to make them suitable for commercial, industrial, or construction use.
"Minerals" means any soils, clay, coal, stone, gravel, sand, phosphate, rock metallic ore, and
any other solid material or substance of commercial value found in natural deposits on or in the
earth (NCGS 74-49(6)).

Because you are in violation of The Mining Act of 1971 you are directed to immediately halt the
above mentioned_mining operation until You have obtained a valid mining permit from this Department_
Please contact this office immediately at 2090 Hwy 70 Swannanoa, North Carolina, [phone] to
indicate your intention to comply with the Act. In addition, you must take the following corrective actions
to bring this site into compliance:
Pending the decision to approve or deny your application for a permit, you must take the
following corrective actions to restore or repair any damage that has resulted from your
unlawful mining activity:
a. Cease all mining activity; and
b. Stabilize the disturbed areas with an adequate groundcover; and
c. Install sedimentation and erosion control measures which are sufficient to restrain
erosion and prevent offsite sedimentation damage;
2. In the event that your application for a permit is approved, you must post a bond or other
form of security acceptable to the Department to ensure that the affected area will be
reclaimed when your mining operation has terminated. The bond does not have to be
submitted concurrent with the application for a permit.

3. As an alternative to filing the attached mining permit application, you must immediately
initiate reclamation of this site and complete the reclamation wit_hin_30 days of receipt of this
Notice. Should you choose this alternative, you must submit within 30 days of receipt of
this Notice a plan detailing the intended reclamation including a specific schedule for
completion of this work.
Violations of the Mining Act for mining without a permit are subject to a civil penalty of up to
$5,000.00 per day for each day of a continuing violation. A penalty may be assessed for violations
committed prior to your receipt of this notice. A penalty will be assessed for violations committed after
receipt of this Notice. Should you fail to comply with the terms of this Notice within the prescribed time
frames, additional enforcement action will be taken. Such action may result in the issuance of an
injunction or the imposition of a criminal penalty.
The responsibility for understanding and complying with the requirements of the Act rests upon
the individuals and firms who are subject to its requirements. A copy of the Act and the Administrative
Rules is enclosed for your information.

dredging or dipping operations)
For new mining sites that require an authorization to construct (ATC) wastewater treatment facilities: This
NOI is also an APPLICATION FOR an ATC for new wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For exist lna mining sites that require an Authorization to Operate (A TO) wastewater treatment facilities:

To the best of my knowledge, regarding Mr. West inquiry into DWQ actions with the Blue Rock Materials mine in
Cherokee County I have listed a timeline of events below.
April 2010-ARO DWQ received mining application package from DLR (Shawna) for the Blue Rock Materials/McNabb
Mine.
4/12/2010-ARO DWQ reviewed package and submitted comments on the "Mining Permit Application Review Form"
(09/2005) to DLR. Internal Note: this was the old DWQ comment sheet, which was prior to the September 2010
agreement between DLR and DWQ on the review process.
Jan 2011-ARO DWQ spoke with Roger Moore on January 5, 2011 regarding the mine. Mr. Moore was representing the
mine and inquiring about DWQ permitting. After a lengthy discussion of the mine, Mr. Moore was told a Stormwater
Permit (NCG02) application (NOl) would likely be needed. DWQ went to the website with Mr. Moore while still on the
phone to make sure he had the correct application for NCG02
June 2011-Late in June 2011 DWQ Central Office received the application for the Blue Rock Materials mine. The package
has recently been assigned to a DWQ Engineer in the Central Office for review.

PROJECT INFORMATION
Blue Rock Materials, LLC is a company formed in order to permit an abandoned quarry
site off HWY 294 in Murphy NC. The site is located on Shearing Road approximately
3.8 miles north of the intersection of US 64 and HWY 294. The site lies on the western
side of the ridge on the property. Elevations within the development area of the property
range from 1692 to 1652 msl. Hydrologic Soil Groups on the site are primarily group
B. The drainage from the site is tributary to Persimmon Creek which is classified C. See
attached plans for details.
Plans for Erosion Control for the project have been developed by S and G Engineering
Services, Inc. (SGES). The plan for removal of material on this site is to take the existing
bench down to approximately an elevation of 1652 without=removal=in=the=north=or-
ceastern-directions. The plan is to stay within the permitted limits of disturbance and
remove and process material for sale.
CE_x_ Erosion Control Conditions
The site in its current configuration, as was mentioned, is a bench on the western side of
t3r hill. There is an unknown amount of old spoil material on the site below existing
grade. There are some large boulders strewn throughout the site. On the northwestern
side there is a depressed area which is planned to be improved to form a Rock Dam
Sediment Basin to serve the quarry.
A boundary and partial surface survey were combined with NCDOT lidar data to form
the surface model for the site. The survey was performed by WW Land Surveying of
Murphy. Planned limits of disturbance have been noted on the plans. An un-named
tributary to Persimmon Creek lies to the southwest of the quarry site. Surface conditions
on the bench are rocky with minimal soil and vegetation covering. The bench slopes

toward the northwest. Cut faces to the northeast are bare rock and impervious. The top of
the hill lies a short distance to the northeast of the bench.
A hydrological analysis of the site was performed by SGES. Runoff calculations were
performed via the Rational Method. Drainage areas were defined by the natural
watershed which is shown on the plan routing diagram indicates that all flows will
drain to the sediment basin. See Rational Method Flow Calculations for Structures
spreadsheet in Appendix A 1 for results.
Site Drainage
The concept for site drainage is for the site to be graded such that there is at least a
minimum slope of 1% on the bench at all times towards the proposed sediment basin. The
surface of the site will see considerable equipment traffic on a continual basis and cannot
be stabilized due to the limited space. However there is expected to be minimal soils on
the quarry site once operations begin, minimizing the chance for offsite sedimentation.
Rock Dam Sediment Basin
There is a plan for a single Rock Dam sediment basin on the north western side of the site
which will serve as the treatment_BMP for the quarry. A depressed area on to the north
west which has a formed -boulder-darn-on the creek side will be improved to match the
detail and will provide sufficient surface area and volume to serve the site. The down
slope side of the dam consists of large boulders with no soils present and will serve as a
rip rap lined channel to convey runoff down the slope to an outlet protection rip rap
apron. See detail sheet for further information.
Bench Shoulder
The main operational area of the bench will have a formed shoulder to prevent runoff
from traveling down slope to the south west and bypassing the sediment basin. This
shoulder shall be maintained and re-formed as necessary as the bench elevation is
reduced.
