NCG020831 - 74-90 - Dupree Pit - American Materials Company, LLC - Pitt County 1. Did they ever submit an approvable Pumping 0&M Plan to you? Yes, I have received adequate information. Today I requested a final O&M Plan (not marked Draft) be submitted. 2. Either way, does WaRO have any concerns with issuing it? WaRO has no concerns with the issuance of the COC. Upon this (Robert Patterson's) request, I notified the consultant stating that I had not received the signed JD map and the required information was promptly submitted. Roberto Scheller (252) 948-3940 stated that he does not see that a 401 PCN has been received (logged in) for the proposed haul road improvements/stream crossings. Roberto stated, that noting the remaining requirements in the permit(s), would eliminate the need to delay issuance. WaRO's recommendation is to issue the COC & DEMLR Permits and note the required. NCG020811 - 37-06 - Eure Sand Mine —John R Lane, Jr. - Gates County 1. Did they ever submit an approvable Pumping O&M Plan to you? When I last spoke to Brian Lowther regarding this operation, he stated that the Mining Permit had been issued without dewatering. I had spoken to the consultant numerous times detailing exactly what was required to create an acceptable 0&M Plan. 2. That A.I. is the last correspondence we have on this application. PO Box 361 Maysville, NC 28555 Dear Mr, Johnson: Division of Water Quality Coleen H. Sullins Director April 13, 2011 Subject: General Permit No. NCG020000 Johnson Mine, NCG020791 Jones County Dee Freeman Secretary The Division of Water Quality's Stormwater` Permitting Unit received a National Pollutant Discharge Elimination System (NPDES) permit application for Johnson Mine on April 4, 2011. The application included a copy of an associated application for a mining permit submitted to the Division of Land Resources (DLR). Please be aware that the issuance of an NPDES permit is contingent upon the issuance of an associated mining permit from DLR. Our office will process your stormwater permit application once a DLR mining permit has been issued for your project. Please also be aware that if your project is located near wetlands, your NPDES permit will require dewatering operations without wetland impacts. The specific requirements for mine dewatering at facilities near wetlands can be found in the text of the general NPDES mining permit number NCG 020000 available on our website, http://portal.ncdenr.org/web/wq/ws/su/npdessw. See Part I11, Section E of the permit. An approved Operation and Monitoring Plan is required for NPDES-permitted mining facilities and may be required prior to permit issuance. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. A Plan for your facility must be submitted to the Washington Regional Office within 60 days of your receipt of an NPDES permit. We encourage you to contact Thom Edgerton at the Washington Regional Office at (252) 946-6481 to address any wetland concerns for your facility in order to ensure a successful NPDES application review. Thom From: James Izzell <ncgeology@yahoo.com> Sent: Monday, March 24, 2014 8:57 AM To: Edgerton, Thom Subject: johnson mine Jones County Hello Thom, I wanted to give you the "heads up" on a permitting issue that may be coming your way. You may recall in 2011, 1 was helping Johnson Contracting with permits for a new sand mine in Jones County. The original application described dewatering and discharge of water collected within the pit. However, they decided that there was such a small amount of water that would be involved that they could simply keep the water onsite. Therefore, they withdrew the NPDES General permit application and agreed to keep the water onsite. However, it was recently discovered that the Mining Permit has language that prevents any dewatering of the excavation at all, even if it stays onsite. Land Quality would not change this language without the submittal of a major modification application. That application was submitted on Friday. The application is exactly the same as the originally submitted application, describing dewatering and discharge of the pit water through a basin. Since they are being required to go through the entire permitting process anyway, it was decided to re -submit the NPDES Permit application again. This is basically the same application that you reviewed in 2011. At that time, they had performed a wetland delineation and I had prepared an O&M Plan. I will send this information to you via mail, because I am certain that you will need it for your review. Please let me know if you need any additional information. thank you, James Izzell Carolina Geological Services, Inc. r I I `i :.j Zl ', " ., . FIT T.-i T j L 3 It Min. 2 (o.
