This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part III, Section h of your permit. Your Operation and Monitoring Plan must be adhered to as approved. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. We received finalized.0&M plan on October 4, 2010 and it looks good to me. I am attaching a copy of this O&M plan for your file (couple of plan sheets are not scanned due to size limitations). There is an old reclaimed pit on the south side of this mine that could be considered as a wetland. According to the application, the owner is planning to rehydrate the wetlands with dedicated 4" pump during pumping of the pit number 1. 1 believe that 0&M plan is sufficient for this project and we recommend the issuance of this permit. Please feel free to contact me if you have any questions. Thanks Samir From: Patterson, Robert Sent: Monday, October 18, 2010 10:22 AM To: Dumpor, Samir Subject: NCGO20781 - Hoggard Pit Samir, Please see N01 attached. I am also sending you a copy of the site plan submitted with the NOL We have received an application for coverage of an existing facility under NCG 02 from Rose'Beothers Paving Co., Inc. The facility drains to a UT to Indian Creek (class C) off Hwy it in Bertie County. No vehicle maintenance or haz waste. As you know they will be dewatering near wetlands and have submitted an 0&M plan. Does the WaRO have any concerns about issuing this facility a COC for this general permit? What are your thoughts on the O&M plan? I like they are going to be rehydrating the wetland to the south, but they have not included any monitoring (visual and/or wells) of the wetlands. Thanks!
